PUBLIC MEETING A. Announcements B. Public Comment — 1. Stan Humphries, LEC Environmental, for Madaket Marine — He is working with the Department of Environmental Protection (DEP) to delist the property on Little Neck Way as a barrier beach; he submitted information about the soils and hydrology. The listing was done in the 1980s based upon information from the 1970s. There is no plan for development of that property; most activities are light weight. DEP made the point that we need to publish a notice of Public Hearing and hold the Public Hearing. At that hearing, DEP would do their presentation supporting our argument. Carlson — Once the hearing is done, Madaket Marine would come back with an NOI and at that time the new status of the property would be memorialized. 2. Emily Molden, Nantucket Land Council — There are two projects, Hulbert Avenue and Consue Springs, that required temporary dewatering, which has resulted in Type II bleed out directly into the Town storm drains. This is something that should be on ConCom's radar when conditioning downtown projects. Installing pipes that discharge directly into the harbor or a wetland or go into the stormwater system which drains into the harbor is technically work within ConCom jurisdiction. Carlson — The project on Hulbert Avenue was brackish water. He has been working with Roberto Santamaria at the Health Department to develop regulations governing discharge from pools and dewatering. ConCom will have to roll those regulations into our regulations as it pertains to protected resource areas. Further discussion on the problems associated with discharging into storm water drains that empty into resource areas. II. PUBLIC HEARING A. Notice of Intent 1. Our third -party reviewer is anticipating having his report submitted in mid- January. Representative Art Gasbarro, Nantucket Engineering & Survey Public None Discussion (4:29) Gasbarro — We were waiting for a file number, which we now have. Reviewed the proposed project Erisman — It has recently come out that these types of structures are not completely bio -degradable. Asked about the material of the mesh encapsulating the coir logs. Gasbarro — The mesh is a synthetic material, but it isn't plastic. The coir roll is a coconut fiber material encapsulated by a synthetic mesh, which gives the logs strength. The stainless-steel tags are attached to the mesh to identify where it came from should it be ripped loose. The mesh provides stability to the log. Erisman — The mesh is comparable to fishing net and that is a very serious concern Champoux — We should review these types of arrays again; this mesh material is potentially catastrophic. Gasbarro — Doesn't think there is the concern of the mesh breaking loose at this location in the harbor. There is not a lot of wave energy. Topham — We originally thought that after a while the logs would he gone, now there is this synthetic mesh. Golding — This is a slippery slope for our protected interest and to protect a post -1978 house. Steinauer — This is relatively new information that changes the game. Short coconut fibers break down quickly. Champoux — Asked if there is an alternative. He'd like to know if there is a more organic option. Gasbarro — He can explore that. There is a benefit to having a material that has some strength and helps retain the logs; cited years ago where the ropes were required to be natural and they kept breaking. Feels if the logs break loose, that could have a greater impact on the protected interests. Not all of these structures are to protect house; some are protecting resource areas. Bennett — Suggested viewing an older site to see how the material is holding up. Gasbarro — He can accommodate that; it's possible to uncover some logs. He can get the specification on the mesh material. Asked for a continuance to January 9, 2019. Staff He will schedule a site visit for January 7, 2019. Representative Stan Humphries, LEC Environments Public None Discussion (4:55) Humphries — This was held for a file number and to hear from MNH. MNH suggested a number of conditions. There was discussion of construction access from the end of Hummock Pond Road; the contractor can do all work from the site. Provided a sample and specifications on the mesh material Champoux — He doesn't like that mesh, especially in this environment. Erisman — That's a plastic polymer. Steinauer — This level of information on material would allow us to call these CES and restrict them to pre - 1978 homes. Humphries —The alternative is to triple wrap the coir logs in coconut -fiber mesh. Topham — He agrees with Mr. Champoux about this location with the higher wave energy. Bennett — This material is no worse than that used in 'Sconset and the environment is similar. Erisman — If we approve this, it would be on us should the array break up. She's not comfortable with this. Golding — After the March storms, there was coir all over from Hoicks Hollow to Low Beach. Humphries — This coir/mesh construction has been approved previously; feels they need to consider consistency. Erosion over the last four years was 20 feet. LaFleur — He'd like to see the alternate proposal of wrapping the logs in the coconut -fiber mesh. Humphries — Asked for a continuance to January 9, 2019. Representative Jeff Blackwell, Blackwell & Assoc. Public None Discussion (5:08) Blackwell — This came before ConCom in 2014 for placing a cottage on a new foundation; that work was never done. Also in 2014, expansion of the deck was permitted on the main house. A 1971 photo documented an existing lawn where the wetland delineation is. This request is to expand the deck and include a spa; that reduces the setback from the buffer from 37 to 28 feet. They also propose to install a shed on a concrete slab at grade and place two fences and plantings within disturbed 25 -foot setback to the wetland. A waiver is requested for the spa within land subject to coastal storm flowage; it would displace 122 cubic feet of water in a storm, which is similar to a house without flood vents. Erisman — Sees no way the waiver can be granted without requesting restoration of the wetland. Steinauer — The spa could go on the existing deck which already pushes the boundaries. Golding — This area is all built on fill; back in the day it was one large wetland. Blackwell — Asked for a continuance Staff The existing wetland is about 90% phragmites; if restoration is contemplated, you have to control the phragmites. This wetland incurs across several properties, so several neighbors would have to get involved. Motion Continued to January 9, 2019 by unanimous consent. Vote N/A 12. This is for lifting 8/101' of a foot, renovation, and expansion. Part of the structure is within the 50 -foot setback to the bordering vegetated wetland; but the expansion would be outside. Public Emily Molden, Nantucket Land Council Discussion (5:31) Bracken — This is across the street from a pond and bordering vegetated wetland; the 100 -foot buffer encroaches on the property. This is for residential redevelopment with work within the 100 -foot buffer. All work is within existing lawn area and the area of work will be delineated by erosion control- The septic was upgraded to an I/A system; that was outside the buffer zone. No work is within the 50 -foot buffer. Erisman —The road has a pinch point. Bracken — Bassett Road is on the other side and this uses a shared driveway for access. There is no access point between the property and wetland. Molden — She had a conversation with Lucy Dillon, an abutter, whose concern is discharging the pooL There is another pool in the area that is supposed to pump out the water to be trucked off site; apparently that isn't happening. She wants to know if there is a way to track and document that pumping water is being done. Champoux — Pools can be pumped outside the 100 -foot buffer. Staff Read letters of concerns from abutters about the pool water being pumped out and impacting the pond- Pointed ondPointed out that this pool is located outside ConCom jurisdiction. Otherwise at 4 p.m. the meeting location moves around. Recommends changing the starting time at 5 p.m. in the Training Room.
