Walker Auditorium, 10 Surfside Road, on November 4, 2013. Nantucket High School Senior James Roggeveen was the official Time Keeper. Monday, November 4, 2013 – At the close of the voter registration deadline, there were 8481 registered voters. Meeting called to order at 6:07 PM. There were 260 registered voters present. Ultimately, 319 registered voters were in attendance. Per Chapter 44, Article II, §44-8 of the Code of the Town of Nantucket, special Town meeting quorum requirement(s), if needed, would be 5% = 424; and 3% = 254. Passage of the budgetary amendments is necessary for the budget changes contained in the warrant to be in compliance with DOR guidelines. In the extreme, failure to pass the associated article may prevent expenditures from the referenced funds. Typically, when a special town meeting is to be called, the Board takes into consideration any other articles that could or should be addressed before the annual town meeting; citizens are also provided the opportunity to submit additional articles. Citizen warrant articles for special town meetings require the signatures of 200 100 registered voters (vs the 10 required for annual town meetings). For this special town meeting, there are 13 articles: 2 budgetary articles, 8 real estate-related (including 3 citizen submittals), 1 zoning article, and 2 bylaw amendments (including 1 citizen submittal). This guide is meant to explain the purpose of the articles in “layman’s terms”. The Town of Nantucket has a local requirement that appropriations and transfers of funds at special town meetings require quorums. Appropriations require a quorum of 5% of registered voters; transfers require 3%. For this special town meeting, those quorums are approximately 422 424 and 253 254 respectively. The only two Articles that will require a quorum are Articles 1 and 2 and the necessary quorums are is 3%are 5% and 3% respectively. TERMS Fiscal Year A fiscal year for a municipality in Massachusetts runs from July 1 through June 30. Fiscal Year Actual This phrase refers to expenses and receipts that were actually incurred or received by the Town following the close of the Fiscal Year. Fiscal Year Projected These are projections made in order to prepare budgets for the upcoming fiscal year – they are assumptions and estimates based on trends, actual receipts and expenditures from prior fiscal years. _______________________________________________________________________ Town of Nantucket Guide to November 4, 2013 Special Town Meeting Warrant Articles Page 2 of 6 Retained Earnings Retained earnings in an enterprise fund is a combination of unexpended funds from prior years plus any excess of revenues over expenditures in the most recent fiscal year, less any other funding obligations of the enterprise fund. Retained earnings are certified annually by the Department of Revenue and cannot be spent without a vote of Town Meeting. Technical Amendment Technical Amendments are generally corrections to Motions, which are presented at the start of the Town Meeting. These corrections are often found or arise after the warrant has gone to print, but which need to be corrected in order for a vote to be proper. Sometimes, additional information comes in after the warrant has gone to print which changes a motion entirely. Town Code The Town Code is a compilation of bylaws that have been adopted by the Town through Town Meeting. They are intended to govern various actions of Town agencies and regulate certain Town activities. Town bylaws may only be amended by a vote of Town Meeting. Once adopted, bylaws must then be approved by the state Attorney General’s office in order to be legally effective. Article 1 (Fiscal Year 2014 Enterprise Fund Operating Budget Amendments) Municipalities in Massachusetts typically adopt their operating budgets for the upcoming fiscal year at a spring town meeting. The Town of Nantucket’s Fiscal Year (FY) 2014 budgets were adopted at the 2013 Annual Town Meeting held in April, 2013. In the fall, municipalities generally set their tax rates for the current FY, once end-of-year revenues for the prior fiscal year are known. Setting of the tax rate requires the state Department of Revenue’s (DOR) approval. Towns are not permitted by the DOR to increase revenue estimates for the current FY by any more than what was received in the prior FY without certain specific types of documentation. The budgets in this Article do not meet the level of documentation required – hence the need for amendment. The Finance Committee is recommending that the four affected enterprise fund budgets be amended as follows: 1) Our Island Home . Actual revenue for FY 2013 was approximately $360,000 less than the projection for FY 2014; therefore, per the DOR guidelines, this budget must be adjusted. The means to adjust the budget is to reduce the revenue projection by the $360,000 and use retained earnings in the same amount which have been certified for Our Island Home already, for use in FY 2014. 2) Sewer Enterprise Fund (SEF). The SEF actually took in more revenue in FY 2013 than anticipated. While this is certainly welcome, the DOR has indicated that this budget should be adjusted so as to add the additional revenue to the FY 2014 SEF budget (approximately $669,000). The budget adjustment in the Finance Committee Motion reflects this addition but does not require it to be spent. If not spent in FY 2014, the funds will become SEF retained earnings. 3) Sconset Water. The Sconset Water budget has a similar problem as Our Island Home, with a revenue difference between FY 2013 actual and FY 2014 projected of _______________________________________________________________________ Town of Nantucket Guide to November 4, 2013 Special Town Meeting Warrant Articles Page 3 of 6 approximately $279,000. The approach for this budget is to reduce expenses for FY 2014 by that amount. 4) Wannacomet Water . Similarly to Sconset Water and Our Island Home, Wannacomet Water has a difference of $154,000. As with Our Island Home, certified retained earnings in the same amount will be used to balance the budget for FY 2014. The Finance Committee is recommending approval of these enterprise fund budget adjustments. None of the approaches proposed above to address the budget issues will result in increased taxes. Note: per the Town Code quorum requirement for transfers made at special town meetings (referenced above – Chapter 44 of Town Code) this article will require a 3% quorum of registered voters. Article 2 (Wannacomet Water - Transfer of Unspent Bond Proceeds) Due to a discussion that recently surfaced about the potential use of Wannacomet Water land for the Nantucket Cottage Hospital, a plan to construct a new Wannacomet administration building was put on hold and Wannacomet is proposing to utilize this existing $1,200,000 appropriation for other purposes, namely Hummock Pond Road water main extension and/or costs associated with the Phase II-B Downtown Sewer Rehabilitation Project. Passage of this Article will permit the transfer of funds into the other projects. The Finance Committee is recommending approval of this change of use for the appropriation. There are no additional costs to the taxpayers or ratepayers associated with this Article. Note: per the Town Code quorum requirement for transfers of funds made at special town meetings (referenced above – Chapter 44 of Town Code) this article will require a 3% quorum of registered voters. Article 3 (Long-term Lease Authorization/Sconset Water Tank) Leases of Town property longer than 5 years require the approval of Town Meeting, per Chapter 46 of the Town Code. Sconset Water issued a Request for Proposals (RFP) for use of the Sconset Water tank for communications purposes (ie, cell service). One bidder responded (Verizon) for a lease term of 20 years. Under other terms of the lease, $1.2 million is expected to be received over the 20-year lease period. A rendering of what the communications equipment would look like on the water tower will be available at Town Meeting. The Finance Committee is recommending the approval of granting the 20-year lease authorization. Article 4 (Zoning Map Change: Southwest Quarter Limited Use General-3 to Moorlands Management District) The Town has been approached by various conservation groups concerned about environmental fragility of land in the southwest quarter of the island located near Sheep Pond Road and south of the Madaket neighborhood. This zoning change would _______________________________________________________________________ Town of Nantucket Guide to November 4, 2013 Special Town Meeting Warrant Articles Page 4 of 6 incorporate the properties into a Moorlands Management District (MMD) which is consistent with its present use. Since 1970, various conservation groups have actively purchased properties in this area and have assembled a large area free from development. The general area contains a globally rare area of moorlands and sand plain grasslands that these groups feel is worthy of the highest level of protection. The land meets the criteria of the special zoning district known as the MMD which is the lowest density district, requiring a 10-acre minimum lot size and allowing a low 0.5% groundcover. The average lot size of this area is in fact 11 acres and the majority of the 1,200 acres to be re-zoned is owned by the Nantucket Islands Land Bank and Nantucket Conservation Foundation. Two privately-owned vacant parcels and land owned by local, state and federal governments are also included within the proposed district. The Planning Board will provide its recommendation at the Special Town Meeting. Article 5 (Real Estate Acquisition: “Beachside Streets”) As a result of a property owner blocking off an access to the water routinely used by Brant Point residents and the public (off Hulbert Avenue - James Street), it has been recommended, to permanently preserve this and other accesses to the water along Hulbert Avenue, that the Town take the necessary easements leading to the water by eminent domain. This action is in furtherance of the Town’s One Big Beach access program. Research shows that the Town was authorized by a prior Town Meeting (in 1913) to acquire the ways but the record-keeping and proper follow-up recording was not adequate to accomplish this purpose. There is no appropriation recommended to fund the costs that this Article would result in, if the Board of Selectmen were so authorized to proceed with the takings; however, it would give the Board that authorization now and it could seek a future appropriation when the costs have been more fully identified. It is hoped that the process of assuring access in perpetuity will be friendly and not cost the Town or the adjacent property owners significant funds. The Finance Committee is recommending the approval of this Article. Article 6 (Real Estate Disposition: “Beachside Streets”) This is a companion article to Article 5 and would allow the Board of Selectmen to convey back to affected property owners portion(s) of property in Article 5 not needed for public access purposes. Most of the ways are over 30 feet in width, not all of which is necessarily needed to achieve the goal of providing pedestrian access between Hulbert Avenue and Nantucket Harbor. Some portions of these ways contain buildings, bulkheads and landscaping that are of concern to abutters. In all cases, the conveyances will require the retention of permanent access and beach easements on the ways and allow the Board of Selectmen to avoid litigation and damage awards. The Finance Committee is recommending the approval of this Article. Article 7 (Bylaw Amendment: Parking) This amendment to the Parking Bylaw would allow the Board of Selectmen to change boundaries of the Resident Parking Permit district and/or the dates and times in the district during which parking is restricted. If it decided to make any such changes, the Board would be required to follow the public hearing process as required in the Town _______________________________________________________________________ Town of Nantucket Guide to November 4, 2013 Special Town Meeting Warrant Articles Page 5 of 6 Code. Passage of this Article will allow for timely changes in parking regulations that respond to issues identified by citizens or Town officials during the year. The Finance Committee is recommending passage of the amendment. NOTE: There is likely to be a Technical Amendment to Article 7 at Town Meeting, in order to clarify the intent of the Article. Article 8 (Real Estate Conveyance: 81-83 Washington Street) This article would allow for a 4-foot parcel of land to be exchanged with the abutting property owner for an easement to finalize the construction of a sidewalk along Washington Street to be built by the Great Harbor Yacht Club as part of its Special Permit. The Finance Committee is recommending approval of the Article. Articles 9 - 11 (Bylaw Amendment: Board of Sewer Commissioners/Town Sewer District Map Changes) Articles 9 – 11 all seek to expand the Town Sewer District. Two of the Articles (10 and 11) are citizen petitions; Article 9 is sponsored by the Board of Selectmen at the request of a citizen. When the Board discussed the citizen request, it was generally agreed that the parcels proposed to be included are either logical and reasonable to include and/or, technically should probably already be in the District. The Finance Committee is recommending each Article, subject to a positive recommendation from “an administrative workgroup” (which was not available at the time the warrant was sent to print). This is a staff group comprised of the Director of Planning, Public Works Director and Health Officer who (through a policy adopted by the Board of Selectmen in 2007) are charged with applying established criteria to properties seeking to be added to a Sewer District to determine whether or not they should be included. The Nantucket Sewer Act also requires that a public hearing be held by the Board of Selectmen acting as Sewer Commissioners in order to expand a sewer district, subject to a vote of Town Meeting. If the Board were so inclined not to approve such expansion, the vote required at Town Meeting would be two-thirds. At a public hearing held on October 23, 2013, per the recommendations of the administrative workgroup, the Board of Selectmen voted to expand the Town Sewer District to include all of the parcels listed in Articles 9 and 10 but not 11. The parcels identified in Article 11 are not contiguous to the Sewer District and do not have failed septic systems. Therefore, a majority vote is required to adopt Articles 9 and 10 and a two-thirds majority is required to adopt Article 11. Article 12 (Real Estate Acquisition: Capaum Road) This is a citizen petition seeking Town acquisition of a portion of Capaum Road. The Town already maintains this section of road, and subsequent to submittal of the petition, it was recommended that the matter be referred to the County Commissioners. The Finance Committee Motion approves referring the matter to the County Commissioners. _______________________________________________________________________ Town of Nantucket Guide to November 4, 2013 Special Town Meeting Warrant Articles Page 6 of 6 Article 13 (Bylaw Amendment: Coastal Properties Owned by Town, Management of) This citizen submittal seeks to amend Chapter 67 of the Town Code so that a Town Meeting vote would be required for the leasing or licensing of any Town-owned coastal property to a “non-governmental body” that intends to construct an erosion control project. Currently, the bylaw requires such leasing or licensing to be approved by Town Meeting only for erosion control projects that are “for private erosion-control protection purposes”, even if the project will be located on Town land. Town Counsel has interpreted the current bylaw to not require Town Meeting approval of a lease or license if the project primarily has a public purpose: i.e., the protection of public infrastructure such as Town roads and utilities. The proposed bylaw amendment would remove the word “private” in the current bylaw so that approval of Town Meeting would be required for a lease or license of Town-owned land to a non-governmental entity regardless of whether the project is for private or public purposes. The Finance Committee is not recommending this bylaw amendment. Prepared by: Town Administration Prepared by: Town Administration Effective December 2012 Endorsed by Board of Selectmen: December 12, 2012 Endorsed by Finance Committee: December 4, 2012 Guide to Writing a Citizen Warrant Article The Town of Nantucket has a healthy tradition of citizen-submitted warrant articles for town meetings. Per Massachusetts General Law (Ch. 39, s. 10), citizen articles require the signatures of 10 registered voters (registered in the Town of Nantucket) for an annual town meeting and 100 registered voters (or 10% of registered voters whichever is less – generally 100 is less) for special town meetings. The Board of Selectmen generally “opens” the warrant to citizen articles within a certain time frame prior to a town meeting in order to allow citizens time to submit articles. Well in advance of the town meeting, the Board endorses a timeline prepared by Town Administration which is meant to contain what actions are to be held leading up to the town meeting, including meetings, hearings, notices, publications. The Town of Nantucket has taken the unusual step of providing legal assistance in the preparation of citizen warrant articles. The timeline will contain when the legal assistance is available. Generally it is between 2-4 weeks prior to the deadline for citizen article submittals. The timeline for Annual Town Meetings may be found on the Town website www.nantucket-ma.gov under the “Town Meetings” link. We encourage citizens to take advantage of this unique opportunity for special assistance. Sample warrant article formats are attached. When your warrant article is ready to be submitted, please proceed as follows: 1. Obtain the required number of signatures. Your article will not be accepted without valid signatures of the required number of voters registered in Nantucket. You may obtain more signatures than required, but not less. Please make sure the signatures are legible and that the names are legibly printed next to the signature. The first signature on the warrant article will become the sponsor of the article. It is best to be sure that signature is that of someone who can represent and speak to the article. 2. Submit your article to the Town Administration office, where it will be stamped in as “Received”, it will then be handed back to you for submittal to the Town Clerk’s office, where you may then submit it. 3. If at all possible, please provide your article to the Town Administration office in MS Word format. Some things to remember when preparing your warrant article: 1. Your article will be printed in the warrant “as is”. This means that any spelling, grammatical, punctuation or typographical errors will be printed in the town meeting warrant document. 2. You may be asked a lot of questions about your article by the various boards/committees/town agencies that may be reviewing it. Most likely, these questions will be coming from the Finance Committee, Board of Selectmen or Planning Board (if it is a zoning article). It is recommended that you “do your homework” on the article and attend the meetings that are held about it. The attached “Basic Information Request for Town Meeting Appropriation Articles” has been developed to assist you with information that the Finance Committee and/or Board of Selectmen is likely to want if you are seeking town funds. 3. If your warrant article is something that would normally go through a Town process, such as a capital item, you may ultimately be referred back to the Board of Selectmen to seek its concurrence for the item to go through that process. For example, if you are proposing to fund a bike path project that has not gone through the Town’s review process (which can be quite lengthy) you may find that Town agencies and departments recommend against such a proposal until it has gone through that process. The reason for this is that annually the Town prepares a list of capital projects that will go through a rigorous review process through several agencies and those projects will be prioritized in order of need, funding availability, legal mandate, etc. The agencies are likely to find that your project simply does not fit in anywhere without the established review process. You may disagree and lengthy discussions about what is/isn’t a “priority” tend to follow. Your appointed and elected town officials are in place to conduct reviews and make decisions and recommendations about a wide variety of projects and must take a wider perspective perhaps than you do about your project. Additional general information about warrant articles: 1. Depending on what your warrant is meant to achieve (ie, bylaw amendment, home rule petition) it may require additional action from other agencies, such as the Commonwealth of Massachusetts if it is approved at Town Meeting. Do not assume that it will go into effect immediately upon passage. Bylaw amendments (general and zoning): require the approval of the state Attorney General’s office before taking effect, although there are special rules relating to the application of zoning bylaw amendments, to specific developments. Home rule petitions: require the approval of the state legislature (this has been known to take years) Financial appropriations: funding is generally available in the fiscal year specified – either the current year or the next fiscal year beginning on July 1 2. If your warrant article is NOT recommended by the Finance Committee and you still want to proceed with it, you will need to prepare a positive motion for it and submit it to the Moderator in writing prior to Town Meeting.
