He did additional research in regards to the flood zone and found the structure could be designed to the A -B Zone standards as opposed to the wind velocity standards. The structure will be removed to the 15Y -floor decking then rebuilt and remove the curved portion of the decking and the garage portion. It will be a full 2 -story structure, 24 feet to the ridgeline. This has not been to the Historic District Commission (HDC). The least intrusive foundation would be to supplement the existing pilings with helical anchors. Erisman – Her concern is the increase in glass area impacting birds and wildlife. Looks like there is a new deck extending out into the buffer. Santos – If the extended deck needs to be pulled back, they'll do that. Golding – His concern is the mass and extra 7 -feet of height. Asked if they could put up ridge poles to see the height. The Ottison property was purchased by Nantucket Islands Land Bank (NILB) specifically to protect the wetland scenic views. Bennett – Appreciates staying on the existing footprint. Champoux – We will want a detailed construction protocol when the time comes. Lennerton – Town residents want to protect the harbor views; if the construction and additional height doesn't impede on the view from OIH, there are no concerns. If the view is impacted, then we have a concern. Golding – There is also public way. Santos – Asked for a two-week continuance; when this comes back up, he'll renotice the abutters. Staff OIH property is owned by the Town; it's public in intent and should be taken into consideration. Motion Continued June 27 by unanimous consent. Vote N/A 3. Asked for a continuance to July meeting to put together a revised plan and submit a protocol. Steinauer – He'd like to see how the slope will be stabilized; it's very steep now. Haines — It was mostly brush; the root systems of everything cut are still intact Erisman — Doesn't want the walking path to impact large trees or cedars. Claflin — A huge pitch -pine root ball was pulled and left in the no -disturb zone. Gifford — Shared a memo from Mr. Madden summarizing his client's areas of concern: the applicant should provide additional detail on proposed grade changes within the 100 -foot buffer, silt fence is being overrun by soils; should have a stormwater retention area down -grade should be incorporated in the plan; should submit information on proposed monitoring for invasive species management in revegetated areas; and no discharge of pool water within the 100 -foot buffer. Buckley — Second Mr. Gifford's comments. Looking forward to seeing a plan to deal with rain runoff Staff This can be conditioned that no tree over a certain diameter will be cut within the area of jurisdiction. Provided letter and updated plans in response to Massachusetts Natural Heritage (MNH): limit of work, construction fencing delineating area of work, no vent necessary, time of year restriction in regards to protection of endangered birds. Representative Art Gasbarro, Nantucket Engineering & Survey Justine Kenney, trustee Public None Discussion (4: 4) Gasbarro — This is for coastal stabilization of the top of the bank; reviewed letter and revised plans submitted in response to questions and concerns in regards to the top of bank conditions and the protruding old foundation pieces. Explained why he believes it does not constitute a Coastal Engineering Structure (CES). This is a short-term solution for top of bank erosion; looking to approval of the extended geo-tube structure to stabilize the bank. The Construction Protocol is included in the letter as well as how sand will be distributed. They intend to break off foundation pieces extending out over the bank; they don't want to remove something that would further destabilize the top of the bank. Reviewed protected interests. Explained the results of an alternative analysis. There was a request for a profile view and transect; that is shown to scale and at 20 scale both vertically and horizontally. There will be some continued erosion under the rolls; wants to be able to add more sand under this order. Kenney — This area is subject to dramatic winds; this project uses that to advantage to help stabilize the top of bank. Erisman — Asked if there are old plans that show where the previous house foundation is located. Gasbarro — That is included in the NOI; it's well documented. Steinauer — The house is close to the property line; what happens if it keeps slumping to go back to the stable angle of repose. Gasbarro — The property will continue to erode unless the pending geo-tube application is approved and it stabilizes the toe. We are trying to keep this on the applicant's property at this time. The house is at the farthest point from the erosion. Golding — There will be a substantial amount of weight on the rolls. Asked if they should try to displace the pressure on each cable to keep them from cutting into the bluff. Gasbarto — If we find any pressure on the cable, we can use a rubber seat to distribute the weight. Explained how installation of the cable will distribute the weight in such a way as to prevent that and hold the rolls. The cables will have to be retensioned as a part of regular maintenance. He's talked to the contractor and has been assured they can do this work. Erisman — Noted it looks like one cable is suspended in a public way. Gasbarro — That's a proprietor's road. He believes the proposed sacrificial sand is a greater amount than the bluff would provide. It will slide down and feed into the next lower area. Erisman — She worries that these structures are diminishing the amount of potential habitat for swallows; you can't build an artificial habitat for them; it would take a year for the swallows to return. All the work is adding to that loss. Bennett — Thinks that half the bank will still be available. Gasbarro — There is a large stretch of bluff to the south that is potential habitat Showed a photo of the house in the previous position. She'd like to think that if the bank stabilizes, the swallows will come back. Staff There was concern and discussion in the previous move NOI about removing the foundation and destabilizing the bank. Public None Discussion (5:00) Rits — This is a retreat project to remove structures within the 50 -foot buffer to an eroding bank; they will move landward outside the 100 -foot buffer. He reconfigured the gravel drive to reduce it from 1400 square feet (SF) to 600 SF inside 50 -foot buffer to north coastal bank. Within the 25 -foot buffer, a small area will be allowed to revegetate; they are keeping a small path to beach stairs. One structure within the north 50 -foot buffer will move to just outside the south 50 -foot buffer. Placement of the structures is worked around the location of the two septic systems. Erisman — She is very concerned about moving the driveway closer to a protected resource area. Golding — Asked where the pilings for the sheetwall are located. They aren't on the plan. Rits — He has a plan showing where it was; it's existing and was installed outside jurisdictional areas; it is now partially just inside the 100 -foot buffer. When it was installed, it was within an alteration envelope allowed by MNH for site work and relocation. The MNH lines have since moved; this plan reflects those changes. At the time it was constructed, he and Mr. Carlson confirmed it was outside the jurisdictional area. Golding — This is not a pre -1978 house and is now within our jurisdiction; we can condition the pilings be removed from within our jurisdiction. Erisman —They should be located on the current plan. Topham — Asked about the foundations. Rits — One house has a full foundation; the old cottage is sitting on the ground. Champoux — Asked if there is case law that references putting in a CES before it becomes jurisdictional. Golding — There was a complete disregard of the environment al issues for future generations and he wants a legal opinion about conditioning it now that it is within our jurisdiction and the owner has come before ConCom. He wants the move of the house conditioned upon undoing potential damage by removing the CES. The intent here was different and he has no sympathy for that intent. He'd like to see it undone to prevent long-term damage to the beach. Rits — The project before ConCom right now is a project that the commission has wanted to see on every coastal property. They are voluntarily removing the structures from areas of jurisdiction. This is a net benefit and has always been treated favorably in the past. They aren't asking to do any work on the CES. Erisman — Asked if there is any way to move the driveway completely outside the 50 -foot buffer. Rits — That's the best we can do because of the need to maintain maximum separation for the two septics; this board has previously allowed pervious driveways within the 50 -foot and outside the 25 -foot MNH said they have no Take issues under Massachusetts Endangered Species Act (MESA) and Wetlands Act Golding — Feels the logic that asks for a foundation to be taken out when a house is removed can be applied for these pilings. Topham — Asked about the rate of erosion. Rits — The erosion rate the average was about 1.5 to 2 feet per year. It hasn't been uniform across the beach. Steinauer — Just because someone did something we don't like, we shouldn't stop them from doing good things while we have the chance. When this other thing becomes a problem and we have an opinion from Town Counsel, then we confront that issue. Golding — He would like this continued to for two more weeks to come up with a resolution. Champoux — Agrees with Mr. Golding. Dale — His client wants to do the right thing. He is authorized to by his client to ask for a two-week continuance. Steinauer — Asked that a positive order be drafted for the proposed work. Staff He confirmed that the edge of excavation for the sheetwall was outside ConCom jurisdiction at time of construction. There is no case law in regards to installing a CES when it wasn't within ConCom's purview; when it was originally installed, we called different departments and tried to find a permit that would be required to no available. Objects come into ConCom jurisdiction all the time; the intent isn't a secret and believes the opinion will be that pre-existing structures that come into jurisdiction are allowed to persist in their existing condition until there is a clear negative impact or something that causes a significant replacement Pointed out that this driveway provides access to three other properties to the west. ConCom doesn't have the ability to continue for something we want if the applicant wants to close. Motion Continued for two weeks by unanimous consent. Resource areas are bordering vegetated wetland and isolated vegetated wetland. Golding — Asked if the abutters were notified Rits — The abutters were properly notified and proof is on record. Erisman — Asked if there will be a swale to prevent runoff going down the steep slope into the wetlands to the east. Bennett — Agrees with Ms Erisman; thinks there might be more siltation prevention necessary on that one side. Rits — If a swale will help, he can put one in. Champoux — Agrees about the need for mitigation to prevent runoff going into the wetlands. He'd like to see more detailed landscaping showing grading, swale, terrace, retainage, etc. He'd also like to have grading stakes. Golding — He would like to see those details for both the east and the west side. Rits — Pointed out that all the existing man-made materials are being removed. He'll provide grading information. There is no vegetation currently, unkempt privet was removed. Three abutters are impacted. Have HDC approval. Erisman — Deer love arbor vitae and will bare it to their head height. Champoux — Emerald green arbor vitae is a variety that deer don't eat. Price — When the old bush was removed, that opened her view. She doesn't mind the fence; she minds the trees that will end up blocking her view. She's okay with the fence alone or a plant that won't grow higher than the 6 -foot fence. Santos — The attempt is to provide screening for the other two abutters of the Marine Home Center structures. He'd like to shoot a view line from Ms Price's deck to ascertain the height to limit the plantings. The red maples he'd like down at the wetland end. Champoux — There is an arbor vitae species that doesn't grow as tall. Staff The path of action is to review the application for the impact on the buffer zone; if there is an agreement among the property owners in regards to height of plants, that's okay. Discussion (6: ) Art Gasbarro, Nantucket Engineering & Survey — Coir/plant array at the end of Fargo Way. No sand was lost in the first storm; ice held down the waves. Next storm all nourishment was delivered with no loss of plants on the upper area. It's holding up with no noticeable scouring. Erisman — It is clear there is fresh water coming from the bank. Asked about that. Gasbarro — Along this bank, there are several areas where fresh water seeps onto the beach; that is due to a confining strata of soil holding water from the wetland; there is one such spot on this property.
