Representative Roger Michniewicz, Coastal engineer — This is for a public park to be installed in this location and removal of a residence. Reviewed the proposed landscaping. Rachel Freeman, Nantucket Islands Land Bank (NILB) — Explained that after review of the planting plan they are comfortable with the proposed species; in regards to use of cultivars, feel downtown is not under threat of invasive species. Glenn Wood, Counsel — In regards to the wetland scenic view, the protected area here is the bulkhead as a coastal bank. The definition of the scenic view states, "as from a public way." There is a lease with two more years for the residence and they have to go through Chapter 91 licensing, so work won't start of a while. Public None Discussion (4:04) Champoux — Agrees about the use of cultivars downtown and the plants chosen that can withstand the salt and wind environment. Steinauer — Agrees with Mr. Champoux. Bennett — He doesn't have further comments on this. Golding — His concern is about the sightlines; he wonders why NILB isn't willing to keep this open. Freeman — Some of the thought was, when looking at comfortable places, they looked at the grass area with trees such as Children's Beach. This has been approved by the Historic District Commission (HDC) with one minor change in the positioning of a plaque. Topham — He doesn't think there will be a problem with the scenic view. Steinauer — Given NILB's mission, this will be more attractive to the summer people with shade and benches. If this were a sensitive area, he would agree with Mr. Golding; but this isn't. With the removal of the structure, it could be argued this is a net benefit to the scenic view. Staff The Department of Environmental Protection (DEP) determined this is a water -dependent use. Representative Brian Madden, LEC Environmental — This is a redevelopment of two residential parcels. Located at the northwest tip of the Lily Pond wetland system; the wetland system has been flagged. This has been identified as local land subject to flooding, which extends into the existing lawn area. The Lily Pond wetland drains into the Town storm water system just off site; there are also a series of on-site catch basins. As a result of all that, there has been a major redesign of the project; reviewed the redesign. Explained the proposed driveway enhancements and the drainage along the driveway from Lily Street; parking will be pervious with the driveway to be two strips of cobblestone and a grass strip between and the apron cobblestone. Explained the dexvatenng for the construction within land subject to flooding. Reviewed the planting plan for the mitigation areas. Runoff on 36B will be directed to the pipe under the driveway. This is a significant improvement over existing conditions. Dwellings will be on mono -slabs due to high ground water; the slab hasn't yet been designed by a structural engineer. Dewatering would be directed to dirt bag encircled by hay bales in the corner of the lawn. Public Arthur Reade, Reade, Gullicksen, Hanley, & Gifford LLP for the Lown_ -s at 40 Lih- Street; Dr. & Mrs. West at 35 North Liberty Street, and the Grays at 32 Lily Street Tom Lowry, 40 Lily Street Emily Molden, Nantucket Land Council Discussion (4:18) Golding — He's looking for more area to catch runoff and wonders where displaced water is going. Madden — By excavating the rain garden down, water will seek its level increasing the flood storage capacity_-; it was over designed to account for greater square footage for the lost area. Champoux — There's 16 cubic yards of material and 1720 square feet (SF) for the rain garden. Steinauer — Asked how often the area floods. Madden — The abutters submitted photos from April 1. He assumes during the spring there is some standing water. Another photo of standing water was submitted September 21 following five days of rain. Golding — He walks the path frequently and 95% of the time it has standing water. Asked about where the hydric -soil test holes were dug. Madden — There was a little bit of redox but the hydric -soils were not present. Not proposing use of fertilizer in the area 5 to 10 feet from the NILB property. Reade — His clients have a lot of concerns; they appreciate the changes that have been made and identification of resource areas and mitigation plans. One remaining concern is the Way leading into the proper_- and the use of cobblestones; the Way is used by a lot of people to access the Lilv Pond; cobblestones aren't easy to -walk- on. walkon. His clients say the existing house was located at the back of the lot for a good reason, to avoid the flooding occurring in the area the new structure is proposed. Lowry — The previous drawings showed the Way as being elevated; that seems to have disappeared. Madden — The way has been slightly lowered and the pitch softened. Lowry — He'd like to see a cross section of the proposed way between the two abutting properties; if it's too high, it will drain onto his property. Asked what would happen of the drainage doesn't -work as planned and the water runs onto his property. Noted that north on the site plan is wrong. Golding — He is concerned the cobblestone will channel rainwater. Madden — It will have the grass strip; technically cobblestone is pervious. If the commission desires something else, they will consider that. They want the runoff channeled into the cobble tracks to prevent erosion. Staff — Asked if they had looked into a geo-grid with grass for the parking area. Madden — Didn't consider that because there should be no collection of runoff at that location. Golding — He has a sample of permeable asphalt that could be used for the wheel tracks. It would be more pedestrian friendly. He'd like to see a cross section of the drive and Way within the 100 -foot buffer. Molden — Their main concern is this is the last point for this watershed before it enters the storm -water system and drains into the harbor; there should be no use of fertilizer or herbicides on the lawn. Champoux — Suggested using cobble interspersed with sand; that would still channel the water. Madden — They are willing to entertain a more pervious material for the wheel tracks. Asked for a tnvo-week continuance. Staff During the staff review of the original plan, he did three sets of transects through the lawn and up the slope looking for the change from hydric- to upland soil; their findings revealed it was wet and indicative of poorly drained soil but there was no hydric -soil. He feels comfortable with the wetland delineation on site; resource areas are accurately depicted on this plan. Lily Pond is on the NILB invasive species treatment plan but wway at the bottom of the priorities list. If there is a violation to the order of conditions, intentional or not, the commission can issue an enforcement action and dictate how and when it will be fixed. Representative Paul Santos, Nantucket Surveyors — This is an amendment to an expired order of conditions to complete originally permitted work with a modification; the applicant would like to leave the driveway- in place. Submitted at the table a buffer restoration plan with the invasive species removal plan superimposed over it; reviewed the invasive species removal plan and buffer -zone restoration plan leaving the gravel driveway in place. The Russian olive and honeysuckle between the two structures is a mature stand his client x;would like to leave in place; all other invasive species will be removed. Asked for a two-week continuance to provide an additional planting plan. Public None Discussion (5:09) Discussion about where the location cedar stand and invasive species and the historic limit of the lawn. Steinauer — If the driveway were slid east, most of it could be pulled out of the 25 -foot buffer. Golding — It bothers him not to uphold the original work condition. Bennett — He agrees. Champoux — Asked how much restoration was achieved. Santos — None of it. Champoux — That also has to be considered. There is a lot of restoration going on within the 25 -foot buffer; he thinks there is room to move the driveway over a bit and plant along it. Staff Part of the question is what an amended order might have looked like if it came in while the original permit were still active. When they couldn't get a Certificate of Occupancy- they came in and were told the Certificate of Compliance could not be issued under the existing circumstances. The original waiver called out that given the existing conditions, the reestablishment of the 25 -foot and removal of invasive species was a net benefit. Representative Arthur D. Gasbarro, Nantucket Engineering & Survey — This is a residential redevelopment of multiple -acre properties divided by a bordering vegetated wetland. It was continued for sign off from 'Massachusetts Natural Heritage (MNH); we received their conditional letter of no take. Submitted a lighting plan; no lighting proposed within the 50 -foot buffer Seth Wilkinson, Wilkinson Design — Reviewed the INH recommendations: flagging construction areas, long- term asset management, and submission of a compliance report within 30 days of completion of work. Public None Discussion (5:27) Golding — ,\Is Erisman asked about the lights and thinks she'd be pleased with this. Asked this lie conditioned that pool lights are turned off at 10 p.m. Steinauer — We typically avoid lights shining into the wetlands. This is one of the better land management plans we've seen. Staff Typically with MNH conditions, we include a condition that references the letter then attach the letter. It is very difficult to regulate when a private pool can be used. Representative Paul Santos, Nantucket Surveyors — This is a bank stabilization project using a fiber -roll array at the bottom - of -the -bank and coastal -beach interface. It was continued for Natural Heritage Endangered Species Protection (NHESP) review, we have their letter of requirements. Also there was a question about the amount of nourishment; Wilkinson Design provided that. Seth Wilkinson, Wilkinson Design — Reviewed the NHESP requirements and the nourishment protocol plan. Public None Discussion (5:37) Steinauer — Asked about nesting Piping Plovers. Staff The closest the Plovers have nested is east of Capaum Pond and west of Steps Beach; here it's not good habitat. Representative Paul Santos, Nantucket Surveyors — This is for work within land subject to coastal storm flowage and a 100 - foot buffer to a coastal bank, that being a constructed bulkhead. This is to elevate the dwelling and cottage to elevation 10 in compliance with flood regulations and move the dwelling away from the property line with 41 Hulbert Avenue; current flood zone elevation is elevation 9 designated as moderate wave action. Foundations will be pass-through. Raising them requires additional steps; he put in a waiver request for the main dwelling under no reasonable alternative to increase to 150 square feet (SF) for the stairs. No grade change is proposed along the westerly or northerly boundaries; they would be asking to increase grade one foot -Within the courtyard area to minimize the number of steps. He will provide a detailed grading plan and infiltration plan. Asked for a two-week continuance. Public Amanda Cross, 41 Hulbert Avenue — She is concerned about a section in front of the boathouse where water pools; since construction of the cottage, that area has flooded more, and she doesn't want the problem exacerbated. Stated that the main dwelling is about 100 years old. Discussion (5:47) Discussion about where water collects. Staff None Motion Continued to November 29 by unanimous consent. Representative Paul Santos, Nantucket Surveyors — This is for the relocation of existing boathouse, on the north side of the property, to the west; reposition the driveway; remove the stone turnaround; revegetate vacated areas; and relocated the stairs. This area has a stabilized rip -rap coastal bank with a set of beach stairs and a platform. The stabilized bank does not extend the length of the property. The buffer is the setback from the coastal bank. This falls within the limits of NHESP mapping. Once the boathouse is moved, there will be an at -grade path to the beach stairs. Asking for waivers for work within the 25 -foot no disturb area to relocate the stairs and construct the footpath; there would be a net benefit within that area. Thev wish to leave the existing septic system in place. There is a bordering vegetated wetland along the leeward side but all work is outside the 100 - foot buffer for that. Asked for a two-week continuance. Public None Discussion (6:03) Golding — Asked that sand be added to the bottom of the bank to maintain the walkable beach. Asked for a two-week continuance. Public None Discussion (6:17) Champoux — There is an area the retaining wall and pool are 45 feet from the coastal bank. He'd like to see the actual 50 -foot wetland encroachments and what the trade-offs would be. With a minimal amount of effort, everything could be outside the 50 -foot buffers. Representative Brian Madden, LEC Environmental — This is for wetland restoration, buffer zone enhancement, and two additions on residential structures. While reviewing the wetland, he noticed that some changes had been made to the wetland, so he looked into the history; reviewed the history of activities in the area of the wetlands going back to 1995. The objective is to bring this site into better compliance. Reviewed the proposed steps of restoration. Public Emily Molden, Nantucket Land Council Discussion (631) Champoux — It looks to be a significant improvement over the current condition. Bennett — If we are to approve this, all necessary departments must permit the septic system. Golding — Feels the ameliorations are such as to improve the situation. Champoux — Asked if any structures within the buffer zones are going to be moved or removec. Madden — There are opportunities to move some of the sheds and the greenhouse. Noted twc buildings that might be problematic to relocate; he'd have to talk to the owner about that. Champoux — Suggested Mr. Madden talk to his clients and perhaps come up with a compromise. Golding — Suggested a site visit since this is such a complex application. Molden — Echoed the point that a lot has been done that is inappropriate; this is the time to correct and/or mitigate the problems. The 1995 aerial shows the isolated vegetated wetland which no longer exists and the existing wetland. The commission should talk about the amount of wetland filled in and how to quantify that to maintain consistency with other projects. Asked the commission to discuss whether or not tl=e leech field is in compliance with Title V, and bear in mind it is not in a location the commission would have permitted. Discussion about ways to make wetland mitigation and replication successful. Golding — Compared the 1995 aerial to more current aerials and what was there and what was not. Madden — Reviewed the information the commission is looking for. ,asked for a two-week cont_nuance. Staff Gave a summary on how agricultural wetland work under the Wetland Protection Act on the agricultural property as opposed to an abutting property. Nothing shown on the site plan has ever received a permit. Explained how this came to the attention of staff The proposed additions are legitimately proposed. Explained what constitutes agricultural status; this lot is not deemed agricultural. First the commission must deal with the resource areas themselves; then deal with the addition and anything else that needs to be addressed to bring it into compliance. Wetland mitigation has varied from project to project; some are two to one and the greatest was five to one; there is no regulatory requirement. Motion Continued to November 29 by unanimous consent. Representative Mark Rits, Site Design Engineering — This is a request for a pool, patio, grading, retaining wall, and steps all outside the 50 -foot buffer to a wetland. Most work is in lawn area; some clearing was done between the 25 - buffer and 50 -foot buffer. The finished pool will be at elevation 28.5 and the wetland is at elevation 1-. Clarified the fence position and the silt fence location. There is about 100 feet outside the 100 -foot buffer for discharging pool water. The grade is being built up on the wetland side to create a level area for the pool. Public Jeff Ballinger, owner 39 -Millbrook Road — Their cottage is about 20 feet from the corner of the pool. The area in front was brought up three or four feet several years ago and it is coming up further. All drainage from the house dumps into our yard already; also since this compound was built, the guy- across the street ended up with pond every time it rains; he has to pump it. Paul Quirke, tenant 39 Millbrook Road — Addressed a serious issue with the run-off and direction of flo«-. Discussion (7:28) Golding — Looking at the topography, water discharged outside the 100 -foot buffer would run back toward the wetland. Bennett —The flat surface with patio will increase the run-off. Rits — They can install infiltration and channeled drains. Golding — Asked for a continuance to come up with a revised drainage plan and for the board to take a look. Champoux — Would like to have some grade stakes put in place. Rits — There is a significant vegetated buffer on the way to the wetland. Requested a two-week continuance.
