1. Call to Order, Approval of the Agenda, Approval of Minutes, and Public N
Comments. r
A. Chair Allen Reinhard called the meeting to order at 4:00 pm. In attendance were Rick
Atherton (left at 4:33 pm), Nelson (Snookie) Eldridge, Leslie Forbes, Allen Reinhard, Bert
Ryder, Lee Saperstein, John Stackpole, Stephen Welch (left at 4:51 pm); there was a quorum at
all times.
B. Public Comment. None.
C. Minutes. Approval of minutes from July 18, 2017. Snookie Eldridge moved and John
Stackpole seconded approval of the minutes. The vote in favor was seven to one with Stephen
Welch abstaining.
2. Update list of Public Way monuments and development of a maintenance plan.
Allen Reinhard introduced the current public way monuments list and Lee Saperstein projected
the existing list that can be found at the Committee's web site (http://nantucket-
ma.�-1ov'/DocumentCenter/View/1097). Snookie Eldridge reported that there is one lying on the
ground behind the `Sconset Market. Stephen Welch suggested that the DPW might be able to
get us GPS coordinates for the monuments in place of the current latitude and longitude
numbers. Allen Reinhard said that the DPW would like to create a maintenance plan,
particularly for brush cutting. It was suggested that cutting should be at least twice a year and,
perhaps, three times. Lee Saperstein said that he will look for updates of monument placements
in copies of past minutes. He will work on updating the existing file to give it to IT for posting
on our web page. Rick Atherton wanted to know if the maintenance could be extended to the
entire way indicated by the monument. Leslie Forbes agreed to keep a copy of the list on her
computer. As the committee closed this item, several members reported on instances of ways
that might be taken by the Town. One such was 48 Shimmo Pond Road. Rick Atherton said that
this property was under consideration by the Conservation Commission for a Chapter 91 License
for a pre-existing structure. [Action: Lee Saperstein to bring existing plan up to date and include
suggested maintenance]
3. Chapter 91 next steps.
Lee Saperstein said that the report on Chapter 91, including suggestions for action, had been
forwarded to the Town Administration for inclusion in a future agenda of the Board of
Selectmen and we are awaiting a response. Stephen Welch pointed out that, if the Town filed a
home -rule petition, that the portion of the Massachusetts Code of Regulations dealing with
delegation of authority to towns for permits for incidental structures, 310 CMR 9.07(3), might
provide a model for it.
Rick Atherton suggested that we ask the Town to have the existing licenses scanned and put into
a digital and accessible file. [Action: Check with Town on status of our report.]
4. Roadway encroachments and road -patching bylaw.
When next a representative from the DPW attends, we can review the Town's encroachment
policy with him. Members of the committee are concerned about enforcement of the policy,
particularly for construction vehicles that block sidewalks. A similar concern is for compliance
with the road -patching bylaw that requires restoration of a disturbed road surface as soon as is
practicable (Chapter 127). The bylaw requires approval by DPW of the completed repair. Allen
Reinhard will communicate our concern to the DPW and if necessary will bring it back to the
agenda. [Action: Allen Reinhard to meet with Director of the DPW on problem of construction
vehicles blocking roads and sidewalks.]
5. Washington St. Ext. parking.
Allen Reinhard said that he had spoken with Andrew Vorce, Planning Director, about
encroachments in front of 112 and 114 Washington Street as asked by Stephen Welch. Andrew
Vorce said that these properties were not a problem.
6. Cliff Road sidewalk project.
Although this topic was originally intended for a discussion of sidewalks needed along Cliff
Road, it turned quickly to a discussion of blockages along Cliff Road and its multi -use path.
Allen Reinhard pointed out that there are a number of physical encroachments along Cliff Road.
Also, he pointed out that we are getting a number of workers' trucks parked along Cliff Road and
onto the bike path. Leslie Forbes suggested that we find a way to ask the Town to enforce the
rules as well as repairing damage to the shoulder. A blocking permit and performance bond is a
possible solution but she said, that in a conversation with Chief Pittman, she learned that
blocking permits are only used in areas posted as no parking. This conversation re -raised the
issue of parking on sidewalks. Bert Ryder suggested that, where there is blocking, the property
owner be asked to tell the contractors to clean up. The building permit would have the owner's
name. Stephen Welch said that we should pass the message about our concern for blocking and
encroachments to Traffic Safety and see if they would consider no parking signs along Cliff
Road. Leslie Forbes will talk with Chief Pittman about the nature of an enforceable bylaw that
we might propose to the Board of Selectmen.

Coming back to the original intent of this item, we need to consider a recommendation to build a
sidewalk along Cliff Road. Allen Reinhard will talk to Andrew Vorce about the next steps that
we might take on this. [Action: Allen Reinhard will talk to Andrew Vorce about a Cliff Road
sidewalk; Leslie Forbes will ask about an enforceable bylaw.]
7. Old, New or other business: Access to Historic Coloured Cemetery.
Allen Reinhard reported that the road to the cemetery remains clear even while substantial
construction is happening on the new hospital.
8. Adjourn.
With the agenda complete, the committee adjourned at 5:02 pm. The next meeting is at
4:00 p.m., September 19, 2017, at 2 Fairgrounds Road.
