At a Public Hearing of the Nantucket Zoning Board of Appeals held
at 1 :00 P.M. , Friday, July 11 , 1997, in the Selectmen' s Meeting Room,
Town and County Building, Broad Street, Nantucket, Massachusetts, on the
Application of KIRIL AND JUDY COONLEY, of 72 Cabot Street, Newton, MA
02158, Board of Appeals File No. 043-97, the Board made the following
Decision:
1 . Applicants are seeking a SPECIAL PERMIT under Nantucket Zoning
By-Law §139-33A and a FINDING that the alteration/expansion of a
pre-existing non-conforming structure will not be substantially more
detrimental to the neighborhood than the existing non-conforming
structure. Applicants propose to alter a one and one-half story existing
24.3+ ' x 16. 2+ ' garage structure by eliminating the garage use by
constructing a secondary dwelling unit, with one ( 1 ) bedroom, within the
existing 395+ square-foot space, adding a 14+ ' x 14+ ' storage area and a
14+' x 11 . 6+ ' deck, both on the westerly side of the existing garage .
The current ground cover ratio is 17.7+ and the proposed ground cover
ratio will be 19.4+%, under the maximum 30% ground cover ratio allowed
for this 11 ,930+ square-foot lot which also contains a 1714+ square-foot
principal dwelling unit. The garage is non-conforming as to side line
setback, being sited 5.9+ feet at its closest point to the easterly side
yard lot line in the R-1 district that requires a minimum setback of ten
(10) feet for corner lots abutting any street or way, whether constructed
or not; and the principal dwelling is non-conforming as to side yard
setback being sited 8 . 5+ feet at its closest point from the easterly side
yard lot line.
The premises is located at 75 CLIFF ROAD, Assessor 's Map 30, Parcel
162, Plan Book 14, Page 40, Lot 10. The property is zoned Residential-1 .
2. The Decision is based upon the Application and materials submitted
with it, and the testimony and evidence submitted at the Hearing. There
was one ( 1 ) letter on file in support of the Application and the Building
Commissioner spoke in favor of the proposed plan. There was no Planning
Board recommendation.
3. Applicants propose to convert the existing garage structure into a
secondary dwelling unit that would contain one ( 1 ) bedroom. A storage
area and deck would also be added onto the westerly side of the
structure, away from the easterly side yard setback. There will be no
increase in overall height of the structure and the two (2) required

parking spaces would be provided on site . The Planning Board has issued
approval of the secondary dwelling and the Historic District Commission
has issued Certificate of Appropriateness No. 29411 for the alterations
as proposed to this Board . The 12-foot scalar separation required between
primary and secondary dwellings would be maintained. The only
non-conformity concerning the Locus involves the easterly side yard
setback distance, with the garage being sited only 5 .9+ feet from the
side lot line in a district that requires a minimum of ten ( 10) feet for
a corner lot . Applicant would have met the five-foot side yard setback
requirement for this district had it not been bounded by more than one
( 1 ) street .
4. Therefore, the Board finds that there will be no increase in the
non-conforming nature of the Locus and further finds that the proposed
alteration/extension of the structure and use would not be substantially
more detrimental to the neighborhood than the existing non-conformity.
5. Accordingly, by a unanimous vote, the Board GRANTS the requested
SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A to alter the garage
use by eliminating the garage use and constructing a secondary dwelling
with one ( 1 ) bedroom and adding a deck and storage area as proposed,
subject to the following conditions:
a. There shall be no exterior construction between June 15 and
September 1 of any given year;
b. The plan shall be constructed in substantial conformance with
the plan done by Emack Surveying, dated June 1 , 1997, marked as Exhibit A
and attached hereto; and
c. The plan shall be done in substantial conformance with
Historic Distric) C ' ssion Certificate of Appropriateness No. 29411 .
