Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY,NOV- EMBER 13, 1987 at 1:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of E.J. AND ROBIN HARVEY (118 -87) address 6 Helen Drive, Nantucket, MA 02554. 1. Applicants seek a SPECIAL PERMIT under Zoning By -Law SECTION 139 -7C to construct and provide a 2- bedroom Accessory Apartment within the basement of their single - family residence now being built. The premises are located at 5 MEADOW VIEW DRIVE, Assessor's Parcel 56 -091, Lot 94 of Land Court Plan 14830 -W, zoned RESIDENTIAL -2. 2. Our findings are based upon the Application papers, letters, viewing and testimony and representations received at our hearing. From these, we find that Applicants propose fully to conform with each of the requirements of Section 139 -7C, "Exception for Accessory Apartments' Letters and testimony were favorable including the Planning Board's recommendation. Required off - street parking is available. 3. The basement floor plan on "Floor Plans" for the Harvey Residence, dated 10/21/87 and marked our Exhibit "A ", shows two bedrooms connected by hallway to a living /dining room and thence to an outside stairway. A kitchen and a bathroom open onto the living /dining room. Besides the dwelling unit, the basement has two storage rooms plus a laundry. Since an Accessory Apartment is limited to 800 SF maximum (not to exceed 40% of gross floor area), we condition the Special Permit on exclusion of the storage areas from Accessory Apartment use. 4. We find that Special Permit relief here is in harmony with the general purpose and intent of the zoning code and specifically the Accessory Apartment By -Law. A, (118 -87) -2- 5. Accordingly, by UNANIMOUS vote, this Board GRANTS to Applicants the requested SPECIAL PERMIT under SECTION 139 -7C to install and use the two - bedroom Accessory Apartment in substantial conformity to Exhibit "A ", subject to the above condition barring storage room use.
