Chairman BOARD OF APPEALS TOWN OF NANTUCKET BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 DECISION: At a meeting of the BOARD OF APPEALS held on Friday, October ?, 1982 ub the Town and County Building in the matter of the Application of BRENNER REALTY TRUST (046-83), the BOARD finds: 1. This is an application seeking a VARIANCE from the Intensity Regulation(Setback) of Section 5 of the Zoning 8y-Law. The Applicant's house is located only two (2) feet from the legal location of a road known as Gardner Road. The property is currently zoned LUG-1. 2. Based upon a review of the Application, supporting documents, plans testimony and a view of the site, the Board finds that the applicant's house apparently sits 45 feet from 'Gardner Road". "Gardner Road" is only a paper road and is not maintained by the Town. In other words, the present "Gardner Road" in the vicinity of Applicant's house is simply a path of travel which has been used over the years. If "Gardner Road" were properlysituated on the ground, Applicant would be only 2 feet from it.Further, as the Town of Nantucket owns the land abutting Applicant's lot, if it decided to take "Gardner Road" and maintain it, there would be no need to make it run only two (2) feet from the Applicant's house, ample land being owned by the Town to run it further away. Owing to the above circumstances, the nature and shape of Applicant's land would impose a substantial hardship by virtue of an essentially technic~2l and abstract flaw in title, by virtue of making it unmortgagable. moreover, the requested relief has been recommended by the Planning Board, support by an abbutea and opposed by no one. Further, the requested relief would in no way derogate or undermine the intent and purpose of the 8y-law nor derogate the quality of the neighborhood or the welfare of the citizens of Nantucket. To deny relief would impose a grievous hardship upon the Applicant. 3. For the reasons stated above, the BOARD hereby GRANT5 the Applicant's request for a setback VARIANCE reducing the setback to two (2) feet, by Unanimous vote. Dated: Nantucket, mass.
