At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1:00 P.M.,
Friday, August 10,2001, in the Conference Room, Town Annex Building, 37
Washington Street, Nantucket, Massachusetts, on the Application of ROBERT J.
RAMOS, of 11 Ramos Court, Nantucket, MA 02554, Board of Appeals File No. 059-01,
the Board made the following Decision:
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw
Section 139-16C( 1). Applicant is asking the Board to reduce the easterly side yard
setback distance from ten (10) feet to about 8.44 feet to validate that portion of an
attached garage structure that is sited within the required ten-foot side yard setback area
at about 8.44 at its closest point.
The Premises is located at 11 RAMOS COURT, Assessor's Map 55, Parcel 81,
Lot 1, Plan Book 23, Page 21. The property is zoned Residential--l0.
2. The Decision is based upon the Application and materials submitted with it and
the testimony and evidence presented at the hearings. The Planning Board made no
recommendation. There was one (1) letter on file in favor and one (1) abutter was present
at the hearing and spoke in support of the Application.
3. Applicant represented that he had constructed an addition onto the easterly side of
his attached garage, which is attached to a single-family dwelling. He had unintentionally
sited a corner of the addition within the required 100foot easterly side yard setback area at
about 8.44 feet at its closest point, with most of the addition sited outside of that area.
The Locus, garage and dwelling otherwise all comply with zoning requirements. The
addition was constructed in about 1990 and is now arguably protected by the 10-year
curative provisions in Mass. General Laws Chapter 40A, Section 7, from any
enforcement action. However, as the structure now has non-complying status, Applicant
is seeking relief to validate the setback intrusion by Special Permit.
4. Therefore, based upon the foregoing, the Board finds that the siting of the
addition was unintentional and de mmimus with only a small portion of the addition sited
within the required 100foot side yard setback area. The Board further finds that due to the
fact that the Locus is situated within the Residential-lO zoning district, Special Permit
relief is available to validate said intmsion and a grant of relief would be consistent with
relief granted in similar cases in the same area and in harmony with the general purposes
and intent of the Zoning Bylaw. In addition, the Board finds that the burden of correcting
the intmsion substantially outweighs any benefit to an abutter of eliminating the
intrusion, and the addition would have little impact upon the neighborhood, especially as
the property is located within an area with property substantially owned by other family
members.
5. Accordingly~ by a unanimous vote, the Board GRANTS the requested SPECIAL
PERMIT under Nantucket Zoning Bylaw Section 139-l6C(1) to reduce the required 10-
foot side yard setback distance to about 8.44 feet to validate the siting of the addition,
upon the following conditions:
a. The siting of the structure shall be in substantial conformance with the site
plan done by John J. Shugrue, dated July 20, 2001~ a reduced copy of which is attached
hereto and marked as Exhibit A; and
b. There shall be no further building within the required 10-foot easterly side
yard setback area.
