DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals ( "Board "), at 1:00
P.M. on Thursday, June 8, 2017, (continued from a public hearing held on Thursday,
May 11, 2017, at 10:00 A.M.) at 4 Fairgrounds Road, Nantucket, Massachusetts, the
Board made the following Decision on the application of 8 DERRYMORE, LLC, Post
Office Box 192, Nantucket, Massachusetts, 02554, File No. 012 -17.
2. Applicant seeks Variance relief pursuant to Zoning By -law Section 139 -32 from
the front yard setback requirements in Section 139 -16.A. Specifically, applicant seeks a
waiver to validate a front yard setback distance of 8.8 feet in a zoning district which
requires a minimum distance of ten (10) feet. The dwelling is otherwise dimensionally
compliant with the provisions of Section 139 -16. The Locus, an undersized lot of record,
is situated at 8 Derrymore Road, is shown on Assessor's Map 41 as Parcel 244, and as
Lot 6 upon Plan Book 1, Page 25. Evidence of owner's title is in Book 1514, Page 24 on
file at the Nantucket County Registry of Deeds. The site is zoned Residential 1 (R -1).
3. Our decision is based upon the application and accompanying materials,
representations, and testimony received at our public hearings. There was no Planning
Board recommendation on the basis that no matters of planning concern were presented.
There was no opposition, written and oral, presented at the public hearing and one letter
of support was submitted from an abutter.
4. The locus, as shown on plot plan entitled, "As -Built Plot Plan; 8 Derrymore Road
in Nantucket, Massachsetts ", prepared by Earle & Sullivan, Inc., dated November 9,
2016, and attached herewith as "Exhibit A ", is a pre - existing nonconforming undersized
lot containing approximately 3,915 square feet in the Residential 1 (R -1) zoning district
where the minimum required lot size is 5,000 square feet. The premises is improved with
a two story historic wood frame dwelling having an approximate ground cover of 1,145
square feet. The structure is conforming as to southerly rear, easterly and westerly side
yard setbacks, as to ground cover, with a ground cover ratio of approximately 29.2%
where 30% is allowed, and as to parking.

5. At the hearing on May 11, 2017, the applicant's representative explained that the
house was built circa 1924 on a 5 %2 foot rubble foundation. Applicant bought the
property in 2014 and subsequently filed Building Permit No. 863 -15 for renovation
which consisted of raising the house and installing a new foundation (the permit also
allowed addition of second floor over an existing sun room, third floor dormers, and a
new kitchen with bedroom above). The new foundation raised the house approximately
eight (8) inches, necessitating the addition of a step to meet Building Code. The
installation of the extra step caused a roughly fourteen (14) inch front yard setback
violation, being sited as close as 8.8 feet from the northerly front yard lot line in the R -1
district which requires a minimum ten (10) foot front yard setback.
6. Applicant provided color photographs of locus and other dwellings adjacent
thereto to illustrate the prevalence of similarly sited steps and stoops. According to the
representative, the Derrymore Estates Area was built out circa 1930s and, at that time,
steps were built right up to street.
7. During the course of the discussion, the Board asked whether or not the steps had
been built to the minimum standard in the context of the Building Code requirement. In
an effort to address that and other concerns with the requested relief, the Board asked the
applicant to submit supplemental information to include; 1) clarification on Building
Code requirements regarding steps, 2) a better version of the GIS map to show the
neighboring houses in relation to their distance from road layout, and 3) a previous
survey showing As -Built conditions prior to the renovation work, specifically with
dimensions to the base of the building.
8. At the continued hearing on June 8, 2017, the Applicant provided the requested
supplemental information in addition to more color photographs of Locus and
surrounding houses. Further, the Building Inspector submitted a letter and documentation
in which he stated, "With regard to the landing and steps at 8 Derrymore Rd., under
section R311.3 (Floors and landings at exterior doors), the landing is required to be no
less than 36" with a width equal to or greater than the door it is serving. Under
R311.3.1 (Exception), an exterior landing serving an egress door, which is not at grade,
shall be provided with a ramp or stairs to grade."
9. After hearing testimony from the applicant, the Board recognized that the raising
of the house necessitated the installation of an additional step, that the footprint of the
structure had otherwise not changed upon the locus in relation to the front of the house,
and that evidence shows that the proximity of the stoop to the road was not an anomaly in
this neighborhood which was originally developed well prior to the local adoption of
zoning regulations.
10. Therefore, based upon the history and configuration of locus and the adjacent lots
which have similar steps and stoops sited in close proximity to the layout of Derrymore
Road, and in light of the necessity for an additional step to meet Building Code, the
Board made the finding that owing to circumstances relating to the shape and
configuration of the structure upon the undersized lot and especially affecting it but not

affecting generally the zoning district in which the lot is located, a literal enforcement of
the provisions of the By -law would involve substantial hardship, fmancial or otherwise,
to the applicant, and that the requested relief by Variance may be granted without
substantial detriment to the public good and without nullifying or substantially derogating
from the intent or purpose of the By -law, and granted variance relief as requested.
11. Accordingly, by a UNANIMOUS vote of the sitting Board, the Board grants the
requested relief by VARIANCE to validate the siting of a step with a front yard setback
distance of 8.8 feet in a zoning district which requires a minimum distance of ten (10)
feet.
