The Owners/Applicants, George and Faith Breen (hereinafter referred to as
"Breen") are the owners of 65 Miacomet Avenue ("the Premises") by virtue of a deed
recorded in Book 1439, Page 128. Breen is requesting a modification to the Variance
granted by the Board of Appeals in Decision No. 048-13, recorded in Book 1439, Page
31 at the Nantucket Registry of Deeds. Specifically, Breen is requesting to modify
Paragraph 6(a) in order to update the site plan to show the shell parking remaining in
substantially the same location it has been since 1998.
The Premises, a lot containing approximately 10,000 square feet in the R-20
zoning district, was originally 15,000 square feet but was subdivided prior to Breen
purchasing said Premises. The Premises has the benefit of a Secondary Residential Lot
Subdivision Special Permit from the Nantucket Planning Board restricting 65R Miacomet
Avenue (the back lot) to affordable housing purposes and a Variance from the Zoning
Board of Appeals validating the two sub -minimum lots (the Premises and 65R Miacomet
Avenue). A copy of the Zoning Board of Appeals Variance is attached as Exhibit B and
a copy of the Planning Board Special Permit is attached as Exhibit C.
As part of a condition of Variance relief, the Board of Appeals required in
Paragraph 6(a):
"That dimensions of the lot, parking configuration, and screening shall be
substantially in compliance with the plan entitled "Site Plan to Accompany a Special
Permit, #65 Miacomet Avenue in Nantucket, Massachusetts," prepared by Nantucket
Surveyors, LLC, dated August 6, 2013 and revised September 9, 2013 attached hereto as
`Exhibit A"'
The site plan referenced in Paragraph 6(a) shows the shell parking to be
abandoned. Breen would like to retain the location and material of the shell parking. The
shell parking has been in existence since before 1998 and solely services the Premises. A
copy of the GIS from 1998 is attached hereto as Exhibit D.
Breen also has a letter of support from the owner of 63 Miacomet Avenue relative
to maintaining the location of the driveway in its current configuration.
Therefore, Breen requests a modification to the Variance relief granted to replace
the site plan reference with the site plan enclosed in this application.

1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, September 12, 2013, at 12:0 P.M., 4
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of ACCESS , INC.

02554, File No. 048-13:
2. Applicants are requesting Variance relief :pursuant to
Section 139-32 (Variances) from the intensity regulations in
Section 139-8.C.(2)(e) (minimum lot size for; secondary
residential lots fory ear -round residents) in order to validate
the newly subdivided lots on the Locus. The two :sub -minimum
lots are 10,000 square feet and 5,000 square feet, respectively.
Section 139-8.C.(2)(e) .requires that the lot sizes fdr secondary
residential lots for year-round residents be 12,000 :square feet
and 8,000 square feet in the Residential -20 zoning district.
The Locus is situated at 65 Miacomet Avenue, is shown on
Nantucket Tax Assessor's Map 67 as Parcel 84, is shown in Plan
Book 18, Page 9, and evidence of Owner's title is recorded at
the Nantucket County Registry of Deeds in Book 411, Page 80.
The site is zoned Residential - 20.
3. Our decision is based upon the application and
accompanying materials, representations, and testimony received
at our public hearing. There was no Planning Board
recommendation on the basis that no matters of planning concern
were presented.
4. Attorney Lori D'Elia represented the Applicant at the
hearing. Attorney D'Elia explained to the Board that the
Applicant seeks a Variance relief under Nantucket Zoning Bylaw
(the "Bylaw") Section 139-32 (Variances) from the intensity

regulations in section .139-8.C.(2)(e) (minimum lot size for
secondary residential lots for year-round residents):to validate
the subdivided lots on the Locus. The Applicant, Access
Nantucket, Inc. has applied to the Planning Board for Special
Permit relief pursuant to Section 139-8.C. (secondary
residential lots for year-round residents) in order to subdivide
the property into two (2) .lots. Pursuant to Section 139-8.C.,
the Planning Board may allow the subdivision of property to
create two sub -minimum lots if one of said lots is subject to
the Nantucket Housing Needs Covenant. The Applicant is a non-
profit entity.
The Locus is conforming as to all intensity regulations of the
Residential -20 (R-20) zoning district except for: lot size,
having 15,000 square feet of lot area in a zoning district that
requires a minimum lot size of 20,000 square feet.
Pursuant to Section 139-8.C. of the Bylaw, the Planning Board
can grant the subdivision of lots in the R-20 district if the
minimum secondary lot size is 12,000 square feet and'the minimum
primary lot size is 8,000 square feet. However, :because the
Locus is undersized for the R-20 zoning district, the proposed
primary and secondary lot sizes are 10,000 square feet and 5,000
square feet, respectively. Although the Planning Board can
grant this subdivision, the lots will not be deemed buildable
because they do not meet the minimum lot size requirements in
Section 139-8.C.(2)(e). Accordingly, the Applicant is
requesting the Board of Appeals grant Variance relzef pursuant
to Section 139-32 from the intensity regulations in Section 139-
8.C.2(e) to validate the sub -minimum primary and secondary lots
as buildable.
5. Therefore, after a discussion with the Applicant, the
Board finds that Variance relief pursuant to Nantucket Zoning
Bylaw Section 139-32 in order to validate the 'sub -minimum
primary and secondary lots as buildable may be granted because
the unique circumstance of utilizing Section 139-8.0 on an
already undersized lot would not affect generally the R-20
zoning district and a literal enforcement of the provisions of
this Bylaw would involve substantial hardship on theApplicant -
a nonprofit organization - and desirable relief may' be granted
without substantial detriment to the public good 'and without
nullifying or substantially derogating from the` intent or
purpose of the Zoning Bylaw.
b. Accordingly, by a UNANIMOUS vote of the sitting Board,
the Board of Appeals GRANTED Variance relief to validate the

sub -minimum primary and secondary lots as buildabje upon the
following conditions:
a. That dimensions of the lot, parking configuration, and
screening shall be substantially in compliance with the
plan entitled "Site Plan to Accompany a Special Permit,
#65 Miacomet Avenue in Nantucket, Massachusetts,"
prepared by Nantucket Surveyors, LLC, date4 August 6,
2013 and revised September 9, 2413 attached hereto as
"Exhibit A"; and,
b. That no more than one shed per the two subdivided lots
shall be permitted.

Findings:
"11ie Planning Board, at its October 1', 2013 meeting, found that the proposal was in keeping with
section 139-8C of the Zoning Bylaw and that the proposal advances the purpose and :intent of the
Nantucket Zoning; Bylaw.
The. Board notes their concern regarding the representation that the lots will be serviced by an on-
site septic system(s). The lot is located in the Public Wellhead Recharge District, the Town Sewer
District, and withinan area generally accepted as the Mincomet fond watershed. Town water will
not be extendedto these lots, which increases die Board's concem for public health, safety, and
welfare. Although the Board did not include connection to the public sewer and water sc�stem as a
condition of their decision, those connections are strongly encourages and should be given thorough
consideration when planning future improvements to the site.
Decision and Vote:
On October 17, 2013, a motion was made and duly seconded to APPROVE the requested Special
Permit to create a secondary reside.niial lot for year-round residents subject to the follovating
condition, and waiver:
1. That b:,t 13.A shall be subject to an NHNNC-Ownership Form (Nantucket
Housuig Needs Covernant), which shall provide, without limitation, thatthe
owner and any occupant of any dwelling erected thereon, shall `earn at or below
1.50'!,'o of the Nantucket (:;ounty median household income;
2. That .Lots 13A and 13B shall be limited to one (1) dwelling unit per lot;
3. That Lots 13A and 13B shall comply with the ground cower ratio, front yard
setback, side and rear yard setback of the underlying zoning district, or as
otherwise specified in 139-8(;; and,
4. 'The lots shall he established .in substantial compliance with the plan entitled
"Site Plan to Accompany a Special Permit, #65 Miacomet .'tvenue in Nantucket.
Massachusetts," prepared by Nantucket Surveyors, LLC, dated August b, 2013

As follow-up to our brief conversation, this is to confirm my support for the request for a parking
variance that would keep the shell parking area located at 65 Miacomet as it is. Keeping the
shell parking located in its current location would minimize the number of cars using the
driveway; and, thereby reduce the associated noise.
