An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a notice of
appeal, specifying the grounds thereof, with the Town Clerk, pursuant
to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the Application submitted by the Applicant, the Zoning Administrator
determined pursuant to Nantucket Zoning By -Law Section 139- 33.A(1)(b) that the
proposed extension, alteration, and change to the pre- existing, nonconforming structure
on the pre- existing, nonconforming lot will not increase the pre- existing nonconformities
of the structure, will not increase the nonconforming nature of the lot, and will not create
any new nonconformities.
2. The Applicant proposes to demolish the pre- existing, nonconforming structure and to
construct a new expanded dwelling in substantially the same footprint, all in accordance
with Certificates of Appropriateness No.s 66381 and 66770 issued by the Nantucket
Historic District Commission, as the same may be modified and amended from time to
time.
3. The Locus is nonconforming as to lot area, containing approximately 2,677 square feet in
the Residential One (R -1) zoning district which requires a minimum lot area of 5,000
square feet. The premises contain a dwelling which is pre - existing, nonconforming as to
front yard setback, being sited as close as .9 feet from the front yard lot line abutting
Prospect Street where a ten (10) foot front yard setback is required. The 484 square foot
dwelling is conforming as to side and rear yard setbacks, as to ground cover, with a
ground cover ratio of approximately 18.1% where 30% is allowed, and as to parking
providing one conforming space in the southwest corner of the lot.
4. The Locus benefits from prior relief by virtue of Special Permit granted in Zoning Board
of Appeals File No. 078 -03, on file with the Nantucket Registry of Deeds at Book 868
Page 155. Said decision allowed the reconfiguration of the Locus by altering the common
lot line between the Locus and the adjacent lot to the north to cure the northerly side yard
setback intrusion and to increase the lot area, thus decreasing the pre- existing
nonconforming lot size.
5. Applicant proposes to demolish the single story dwelling, said to have been built circa
1955, and reconstruct a new dwelling in substantially the same footprint as the existing
structure with an addition on the rear elevation which will be compliant as to setbacks.
The expansion will result in a ground cover increase from 484 square feet to 751 square
feet for a new and dimensionally compliant ground cover ratio of 28.1 %.

6. Based upon the site plan entitled, "Zoning Administrator Decision; Plan in Nantucket,
MA. ", drawn by Michael Connolly & Associates, Inc., dated September 29, 2016,
showing proposed conditions on the Locus, a reduced copy of which is attached herewith
as "Exhibit A ", the Zoning Administrator finds that the proposed work will not increase
the nonconforming nature of the lot or the structure, and will not create any new
nonconformities and hereby issues the permit as requested. This approval is subject to
the following condition:
a. No exterior construction or hardscaping in connection with the project
approved herein shall occur between June 15 and Labor Day of any given year.
