The Applicant seeks permission to increase the pre- existing nonconforming ground cover on the Premises. I have also enclosed the filing fee required by the Town of Nantucket in the amount of $450, a certified abutters list and mailing labels. Please mark this matter for hearing by the Nantucket Zoning Board of Appeals at its December 7, 2016 Public Hearing. Sincerely, Richard Beaudette RPB /lld VoAlo Enclosures cc: Linda Mason ED ADDENDUM TO ZONING APPLICATION 23 Monomoy Road The Applicant, Linda Mason (hereinafter the "Applicant "), is the contract purchaser of 23 Monomoy Road, Nantucket, MA 02554 (the "Premises "). The Premises is shown as Lot 17 on Land Court Plan 10937 -C registered at the Nantucket Registry District of the Land Court and as Parcel 205 on Nantucket Town Assessor's Map 54. The Applicant hereby requests Special Permit Relief pursuant to Sections 139 -33 (A)(2) and (4) of the Nantucket Zoning By -Law (the "By- Law"). The Premises is located in the Limited Use General -1 ( "LUG -1 ") Zoning District and is currently improved with a dwelling. The Premises is pre - existing nonconforming as to lot size, ground cover ratio, as well as front and side yard setbacks. The existing conditions of the Premises are shown on a plan prepared for Linda Mason by Bracken Engineering, Inc., dated November 8, 2016 (the "As Built "), a copy of which is attached hereto as Exhibit "A ". As shown on the As Built, the Premises consists of a 12,695 + /- square foot lot in a zoning district that requires a minimum lot area of 40,000 square feet; has a front yard setback as close as 33.8 + /- feet to the front yard lot line in a zoning district that requires a front yard setback of 35 feet; a side yard setback as close as 9.0 +/- feet to the front yard lot line in a zoning district that requires a side yard setback of 10 feet; and a ground cover ratio of 14.3 % (1,810 + /- square feet) in a district where 7% (1,500 square feet for lots of record) is the maximum ground cover ratio allowed. The Premises complies with the zoning regulations in all other respects. The Applicant, of advancing age, wishes to construct a dwelling with first floor bedrooms which will allow her to access the master bedroom without going up and down the stairs as she ages. As shown on the proposed site plan prepared for Linda Mason by Bracken Engineering, dated November 8, 2016, a copy of which is attached hereto as Exhibit "B ", the Applicant proposes to remove and rebuild the Premises, increasing the ground cover for the existing dwelling from 1,810 + /- square feet to 2,245 + /- square feet. As a result of the proposed work, the existing front and side yard setback violations on the Premises will be cured. Under Section 139 -33A (2) of the By -Law: An extension, alteration, or change to an existing structure or new structure that will result in an increase in the pre - existing nonconforming ground cover ratio of a lot may be allowed through the issuance of a special permit, provided that the special permit granting authority makes the following findings: (a) The increase in ground cover ratio will not be substantially more detrimental to the neighborhood that the existing nonconformity; (b) The resulting ground cover ratio is consistent with the character of the surrounding neighborhood; and, (c) The extension, alteration, or change to the existing structure or the new structure is conforming to other dimensional requirements of this chapter. Granting the proposed Special Permit under the above referenced Sections of the By Law for the proposed work will not be substantially more detrimental to the neighborhood than the pre- existing nonconformity on the Premises. The proposed plans are suitable for the Premises as they are consistent with the character of the surrounding neighborhood. As a result of the proposed work, the existing front and side yard setback violations will be cured. Finally, by granting the requested Special Permit, the Board would be acting in a manner consistent with the spirit and intent of the Zoning By -Law.
