An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139-29.C. (3)
Any action appealing the Decision must be brought by filing a notice of
appeal, specifying the grounds thereof, with the Town Clerk, pursuant
to Nantucket Zoning Bylaw Section 139-29.C. (6)

DECISION:
1. Upon review of the Application submitted by the Applicant, the Zoning Administrator
determined pursuant to Nantucket Zoning By-Law Section 139-33.A(1)(b) that the
proposed alteration to and partial demolition of the pre-existing, nonconforming structure
on the lot will not increase the nonconforming nature of the structure and will not create
any new nonconformities.
2. The Applicant proposes to alter the pre-existing nonconforming accessory structure
which is sited within the northerly side yard setback. The work consists of demolishing a
portion of the structure on the southerly elevation which lies outside of the setback. The
portion of the structure which lies within the setback will remain unchanged. Other
dimensionally compliant alterations of the primary dwelling and garage, to be converted
into a secondary dwelling, are proposed which do not require relief. The overall ground
cover of the three structures will increase from 2,072 square feet to approximately 2,260
square feet where a maximum of 3,042 square feet, or a ground cover ratio of 50%, is
allowed. The proposed alterations have been granted Historic District Commission
approval by virtue of Certificate of Appropriateness 66037.
3. The Locus, as shown on plot plan entitled, "Existing Conditions Plan in Nantucket,
Massachusetts; #11 Lily Street", prepared by Bracken Engineering Inc., dated December
30, 2015, has an approximate lot area of 6,084 square feet in the Residential Old Historic
(ROH) district where the minimum required lot size is 5,000 square feet, and 52.51 feet
of frontage where fifty (50) feet of frontage is required. It is improved with three
structures consisting of a dwelling, the subject accessory structure, and a garage. The
1,323 square foot primary dwelling will be altered and expanded to contain
approximately 1,440 square feet. The 400 square foot garage will be converted into a 600
square foot secondary dwelling. The subject 349 square foot accessory structure is pre-
existing nonconforming as to side yard setbacks being sited on the northerly lot line
which abuts Snake Alley, a private variable width cul-de-sac. The premises will contain
two parking spaces in compliance with the requirements of Section 139-18.B.
4. Based upon the submitted site plan, entitled "Proposed Site Plan in Nantucket,
Massachusetts; #11 Lily Street", prepared by Bracken Engineering Inc., dated October
12, 2016, (showing both existing and proposed conditions on the Locus) and attached
herewith as "Exhibit A", the Zoning Administrator finds that the proposed work

consisting of alteration by removal of a 129 square foot section of the pre-existing
nonconforming accessory structure will decrease the massing of the nonconforming
structure, will not increase the nonconforming nature of the structure, and will not create
any new nonconformities and hereby issues the permit as requested. This approval is
subject to the following conditions:
a. There shall be no exterior construction between Memorial Day and Labor Day
of any given year relative to the construction contemplated under this
decision; and
b. The proposed alterations shall be performed in accordance with Certificate of
Appropriateness No. 66037 granted by the Nantucket Historic District
Commission, as the same may be amended from time to time.
