been filed with the office of the Nantucket Town Clerk.
An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a notice of
appeal, specifying the grounds thereof, with the Town Clerk, pursuant
to Nantucket Zoning Bylaw Section 139- 29.C.(6)

1. Upon review of the Application submitted by the Applicant, the Zoning Administrator
determined pursuant to Nantucket Zoning By -Law Section 139- 33.A(1)(b) that the
proposed alteration to the pre- existing nonconforming structure on the pre- existing
nonconforming lot will not increase the nonconforming nature of the structure or the lot,
and will not create any new nonconformities.
2. The Applicant is proposing to alter and relocate an existing unenclosed deck on the
northeast elevation of the dwelling structure. The deck in its current configuration and
location is sited as close as 2.4' from the northerly lot line. The proposed deck will be
sited 2.5' from the northerly lot line, resulting in a slight reduction of the existing setback
encroachment. The project benefits from Nantucket Historic District Commission
approval by virtue of Certificate of Appropriateness No. 66582.
3. Pursuant to Zoning By -law Section 139 -16.A, the lot is pre- existing nonconforming
having a "Calculated Area" of 4,836 square feet in the Residential Old Historic (ROH)
zoning district where minimum lot area is 5,000 square feet, and having 48.68' feet of
frontage where 50 feet is required. The existing structure, recently converted from
commercial use as a lodging house to residential use as a single family dwelling unit, is
pre- existing nonconforming with respect to the northerly side yard setback, being sited as
close as 2.4' from the northerly side yard lot line in a zoning district which requires a five
(5) foot side yard setback. The existing ground cover is approximately 1,000 square feet
for a ground cover ratio of 20.7% in a district that allows a maximum ground cover ratio
of 50 %. Two stacked parking spaces are provided where one is required pursuant to By-
law Section 139 -18.B.
4. Based upon the submitted site plan, entitled "Zoning Exhibit Plan; #7 North Water Street
in Nantucket, Massachusetts ", prepared by Nantucket Surveyors, LLC, dated October 18,
2016 ", a reduced copy of which is attached herewith as "Exhibit A ", the Zoning
Administrator finds that the unenclosed deck in its proposed location will be sited no
closer than the existing dwelling to the northerly side yard lot line and will increase the
pre - existing nonconforming setback distance from 2.4' to 2.5', thus reducing the setback
intrusion.

5. Therefore, based upon the foregoing, the Zoning Administrator finds that the proposed
alterations and relocation, all as shown on the above - referenced "Exhibit A ", will not
increase the nonconforming nature of the lot or structure, and will not create any new
nonconformities and hereby issues the permit as requested. This approval is subject to the
following conditions:
a. There shall be no exterior construction between Memorial Day and Labor Day
of any given year relative to the construction contemplated under this
decision; and
b. The proposed alterations shall be performed in accordance with Certificate of
Appropriateness No. 66582 granted by the Nantucket Historic District
Commission, as the same may be amended from time to time.
