Upon review of the Application submitted by the Applicant, the Zoning Administrator determined pursuant to Nantucket Zoning By -Law Section 139 - 33.A(1)(b) that the proposed alteration to and partial demolition of the pre- existing, nonconforming structure on the lot will reduce the nonconformities of the structure, will not increase the nonconforming nature of the structure, and will not create any new nonconformities. 2. The Applicant proposes to demolish the southern portion of the structure currently encroaching into the southerly rear yard setback and over the southerly lot line onto abutting Locus (shown as Lot 5A upon record Plan No. 2015 -36 and No. 2014 -74), while retaining the remaining portion of said structure, all in accordance with Certificates of Appropriateness No. 66222 as revised by No. 66479 issued by the Nantucket Historic District Commission, as the same may be amended from time to time. As so altered, the structure will remain pre- existing nonconforming as to front yard setback with the northeastern corner sited in and over the front yard lot line which abuts the new layout of Bartlett Road. 3. The Locus contains approximately 7,303 square feet in the Residential Commercial 2 (RC -2) zoning district which requires a minimum lot area of 5,000 square feet. The subject commercial structure on the Locus is pre- existing nonconforming as to front and rear yard setbacks, being sited over the respective lot lines, where minimum front yard setback distance is ten (10) feet and minimum rear yard setback distance is five (5) feet. The structure and the locus are otherwise conforming with the dimensional provisions of the Nantucket Zoning By -law. 4. As proposed, the downsizing of structure will cure the rear yard setback encroachment. As so altered, the southern setback distance will be 9.2 feet at its closest point, as shown on site plan entitled "Zoning Exhibit Plan; #2 Bartlett Road in Nantucket, Massachusetts ", prepared by Nantucket Surveyors, LLC, and dated September 26, 2016. The northeast corner of the structure will not be altered and as such will remain pre- existing nonconforming. 2 Based upon the submitted site plan, attached herewith as "Exhibit A ", the Zoning Administrator finds that the proposed removal of the southern section of the building will both cure the existing rear yard setback nonconformity and will reduce the overall massing within the setbacks, will not increase the nonconforming nature of the structure, and will not create any new nonconformities and hereby issues the permit as requested.
