55 Center Street/ Laura Hanson
Applicant/Owner is seeking a Special Permit relief under Zoning By -Law 139 -33A. to allow the
alteration of pre- existing nonconforming house by lifting the house to install a new foundation
and basement. In addition, the Applicant/Owner will be constructing a conforming addition to
back of the house. The construction of basement will not create any new nonconformities and
will not make the nonconforming setback distance more nonconforming.
The house is sited as close as +3.4 feet from the northerly side lot line and has a height of 30 feet
8 inches. There is also a pre- existing nonconforming garage sited as close as 0.3 feet from
southerly side lot line, and pre- existing nonconforming shed sited on the northerly side lot line.
The Locus is a conforming lot sited at 55 Center Street and is shown on Assessors Map 42.4.3 as
Parcel 72. Evidence of the Owner's title is recorded with Nantucket Registry of Deed in Book
856, Page 197. Locus is zoned Residential Old Historic (ROH)

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals held on August 11, 2016
at 1:00 P.M., in the Conference Room, at 4 Fairgrounds Road, Nantucket, Massachusetts, the
Board made the following Decision on the application of LAURA F. HANSON, c/o Cohen &
Cohen Law, P.C., PO Box 786, Nantucket, MA 02554, File No. 31 -16.
2. Applicant is requesting Special Permit relief pursuant to Zoning By -law Section 139 -
33.A to allow the alteration of the pre- existing nonconforming dwelling in order to lift the
structure, place it on a new foundation, and install a new basement. Applicant also proposes to
construct a conforming addition to the rear of the dwelling which does not require relief. The
Locus is situated at 55 Center Street, is shown on Assessor's Map 42.4.3 as Parcel 72. Evidence
of owner's title is registered in Book 856, Page 197 on file at the Registry of Deeds. The site is
zoned Residential Old Historic (ROH).
3. Our decision is based upon the application and accompanying materials, representations,
and testimony received at our public hearing. There was no Planning Board recommendation.
One letter in favor of the application was submitted to the Board. No opposition, written or oral,
was presented at the hearing.
4. As presented to the Board by the Applicant's representative, the Applicant is seeking
approval to replace the foundation of a pre- existing non - conforming dwelling. The proposed
work will consist of raising the dwelling to construct a new foundation and install a crawl space
under the front the portion of the structure and full basement under the rear portion. A
conforming addition is also proposed to the ell at the rear of the dwelling.
5. Locus, as shown on "Mortgage Inspection Plot Plan ", dated October 29, 2003 and prepared
by Richard K. Earle, is improved with the subject dwelling and two accessory structures having a
total ground cover ratio of approximately 29% in the ROH district where 50% is allowed. The 2V2
story dwelling contains approximately 1,550 square feet of ground cover, is sited as close as 3.4 feet
from the northerly side lot line where five (5) foot setbacks are required, and has an approximate
height of 30 feet 10 inches, where the maximum allowed height is thirty (30) feet pursuant to Section
139 -17.A. There is also a said -to -be pre- existing nonconforming garage sited as close as 0.3 feet

from southerly side lot line, and said -to -be pre- existing nonconforming shed sited on the northerly
side lot line.
6. Based upon the foregoing presentation, the Zoning Board of Appeals made the finding
that the proposed extensions, alterations, and additions to the pre- existing nonconforming
dwelling upon the locus would not be substantially more detrimental to the neighborhood than
the pre- existing, nonconforming conditions thereon. The proposed alterations will not make the
pre- existing nonconforming setback distance more nonconforming. Furthermore, the overage in
height could be considered de minimis and the proposed alteration will not result in a substantial
increase thereof.
7. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested SPECIAL
PERMIT relief to alter the pre- existing nonconforming dwelling by raising the structure to place
it on a new foundation, subject to the following conditions:
a. Alterations to the dwelling, the southwest corner of which is sited within the side
yard setback, shall be limited to crawl space foundation in those portions of the
dwelling that lie within required setback areas;
b. Installation of the new foundation shall not increase the height of dwelling more
than one (1) inch; and
c. There shall be no exterior construction between Memorial Day and Labor Day of
any given year relative to the construction contemplated under this decision.
