At a public hearing of the Nantucket Zoning Board of Appeals held on July 14, 2016 al 12:00 P.M., in the Conference Room, at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the application of JOHN N. JORDIN, III AND JULIE M.JORDIN, File No. 22-16: 2. The Applicants are requesting Special Permit relief pursuant Zoning By-law Section 139- 16.C, either by reducing the required ten (10) feet side yard setback to five (5) feet on both sides of the lot, or to validate a unintentional intrusions into the required side yard setback, for a garage that is located 9.3 feet at its closest point from the side yard line, and a Jacuzzi tub that is 8.2 feet from the side yard line, in a district where a ten (10) foot side yard setback is required. In the alternative, Applicant requests a Variance pursuant to §139-32 of the by-law, to allow for the siting of same. The Locus is situated at 28 Lovers Lane, is shown on Assessor's Map 68 as Parcel 145, and is shown as Lot 90 on Land Court Plan No. 16514-R. Evidence of owner's title is Certificate of Title No. 20283 at Nantucket Registry District. The site is zoned Residential-20 (R-20). 3. Our decision is based upon the application, accompanying materials, and representations, testimony, and photographs received at our public hearing. There was no Planning Board recommendation, on the basis that no matters of planning concern were presented. There was no opposition, written or oral, to the application. Abutters at 26 Lovers Lane and 15 Greglen Avenue submitted letters in support of the application. As presented to the Board through Applicant's attorney, prior to its construction, the garage location was staked by the contractor, using a surveyed building location plan on file in the building department. Because of thick vegetation along the lot line, the contractor also measured from the building corners of the existing house to ensure compliance with the side yard requirements. Inadvertently, the stakes were moved, and the garage upon completion was found to be 9.3 feet from the side yard line, rather than the required ten (10) feet. As shown on the photos presented, the Jacuzzi tub is a small, free standing plastic tub, which looks more like a children's wading pool, surrounded on three sides by, but not supported by, a low, stone, 2 landscaping wall. It is filled as needed with a garden hose, and powered in a manner similar to how outdoor fountains, bird baths, or artificial fish ponds would be when in use. The Jacuzzi tub was placed in its current location by the owner, not thinking that any type of side yard setback requirement was applicable to this type of ornamental water feature. 4. Pursuant to By-law Section 139-16.0 (2), the Zoning Board of Appeals is empowered to grant a Special Permit to validate unintentional setback intrusions not greater than five (5) feet into a required yard and not closer than four(4) feet from a lot line, provided that the Board fmds that the burden of correcting the intrusion substantially outweighs any benefit to an abutter of eliminating the intrusion, and the structure was sited based reasonably upon a licensed survey. 5. The Board made the specific finding that the unintentional setback intrusion of the garage was reasonably based upon a licensed survey, was not greater than five (5) feet into a setback area, nor closer than four (4) feet to a lot line, and that the burden of correcting the de minimis intrusion would substantially outweigh any benefit to any abutter of eliminating the intrusion. The Board further found that this particular Jacuzzi tub does not meet the definition of "structure" under the by-law, and is not required to meet side yard setback requirements, since because of its small size, the Jacuzzi tub is not built-in, is free standing, and does not require a fixed location on the ground to be used. 6. Accordingly, by a UNANIMOUS vote (5-0) of the sitting Board, the Zoning Board of Appeals GRANTS a SPECIAL PERMIT pursuant to Zoning By-law Section 139-16.0 (2) to validate the unintentional side yard setback intrusion of the garage, and further finds that no relief is necessary as to the Jacuzzi tub, both as shown upon plan entitled "Existing Conditions Site Plan to Accompany Zoning Board of Appeals Application in Nantucket, Ma.", dated June 8, 2016 and prepared by Blackwell & Associates, Inc., a reduced copy of which is attached herewith as "Exhibit A".
