ADDENDUM 15 Black Fish Lane
Applicant requests Special Permit relief, to accommodate the
siting of the existing garage, located at its closest point, 9.5
feet from the side yard line in a district that requires a 10
foot side yard setback, pursuant to (a) §139 -16C (1) of the by-
law to reduce the required 10 feet side yard setback from the
easterly boundary of the Premises to 5 feet; or (b) pursuant to
§139 -16.0 (2) of the by -law to validate an unintentional
intrusion into the required side yard setback. In the
alternative, Applicant requests a Variance pursuant to §139 -32
of the by -law, to allow for the siting of the garage in its
current location. At the time the garage was constructed in
2014, a surveyed plot plan showed the side yard line of the
garage to be 10.1 feet, in conformity with the required yard.
Prior to sale by the Applicant to the Owner, and in reliance on
such plan, Owner commenced the construction of stairs and
platform at the rear of the garage. A subsequent plot plan of
the Premises, completed immediately prior to Owners' purchase of
the property, disclosed that the 2014 plan was incorrect, and
that portions of the initial garage structure, as well as the
portions of the stairs and platform, are actually located less
than 10 feet from the side yard line.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals held on July 14, 2016 at
12:00 P.M., in the Conference Room, at 4 Fairgrounds Road, Nantucket, Massachusetts, the
Board made the following Decision on the application of EK Associates LLC as Applicant,
and Mark Bono and Elizabeth Gilbert-Bono, as Owner, File No. 23-16:
2. The Applicants are requesting Special Permit relief pursuant Zoning By-law Section 139-
16.C, either by reducing the required ten (10) feet side yard setback from the easterly boundary
of the Premises to five (5) feet, or to validate an unintentional intrusion into the required side
yard setback, for a garage that is located 9.5 feet at its closest point from the side yard line, in a
district where a 10 foot side yard setback is required. In the alternative, Applicant requests a
Variance pursuant to §139-32 of the by-law, to allow for the siting of the garage in its current
location.
The Locus is situated at 15 Black Fish Lane, is shown on Assessor's Map 73 as Parcel 108, and
is shown as Lot 3 on Plan No. 2007-55 at Nantucket Deeds. Evidence of owner's title is
recorded deed at Book 1540 Page 9 Nantucket Deeds. The site is zoned Sconset Residentail-20
(SR-20).
3. Our decision is based upon the application, accompanying materials, and representations
and testimony received at our public hearing. There was no Planning Board recommendation, on
the basis that no matters of planning concern were presented. There was no opposition, written or
oral, to the application. An abutter at 16 Black Fish Lane submitted a letter of support of the
application.
As presented to the Board through Applicant's attorney and surveyor, the garage was constructed
in 2014. An as-built plan showing a setback for the garage at 10.1 feet from the side yard line
was filed at the building department at that time, and a certificate of occupancy issued.
Applicant recently entered into an agreement to sell the property to Owner. Prior to the sale,
Owner was authorized to construct a second floor deck with staircase access at the rear of the
garage building, and in doing so, relied upon the setback distances shown on the 2014 as-built
plan. Subsequently, an updated plan was prepared by a different surveyor, showing the main

garage structure setback to actually be 9.6 feet from the side yard line, with the new deck and
staircase 9.5 feet from the side yard line. Upon further review and measurement, both surveyors
agreed that the initial 2014 as-built plan was incorrect, and reliance thereon by the Owner,
resulted in the new construction at the rear of the garage not meeting side yard setback, either. A
corrected plan, showing the side yard setbacks for the garage as presently improved, being 9.5
feet at its closes point to the side yard line, and entitled "As-Built Plan in Nantucket,
Massachusetts", dated June 10, 2016, and prepared by Bracken Engineering, Inc., is attached
herewith as Exhibit A.
4. Pursuant to By-law Section 139-16.0 (2), the Zoning Board of Appeals is empowered to
grant a Special Permit to validate unintentional setback intrusions not greater than five (5) feet
into a required yard and not closer than four (4) feet from a lot line, provided that the Board finds
that the burden of correcting the intrusion substantially outweighs any benefit to an abutter of
eliminating the intrusion and the structure was sited based reasonably upon a licensed survey.
5. The Board made the specific finding that the unintentional setback intrusions in this
matter were reasonably based upon a licensed survey, were not greater than five (5) feet into a
setback area and not closer than four (4) feet to a lot line, and that the burden of correcting the de
minimis intrusions would substantially outweigh any benefit to any abutter of eliminating the
intrusion.
6. Accordingly, by a UNANIMOUS vote (5-0) of the sitting Board, the Zoning Board of
Appeals GRANTS a SPECIAL PERMIT pursuant to Zoning By-law Section 139-16.0 (2) to
validate the unintentional side yard setback intrusions of the garage, as shown upon Exhibit A
hereto.
