RICKARD BOARD OF APPEALS FILE NO. 062-96 Applicant is seeking a SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A (alteration/expansion of a pre-existing non-conforming use/structure) . Applicant proposes to demolish a said to be pre-existing 763+ square-foot garage structure located to the rear of the property and reconstruct a new garage/apartment with the same footprint and ground cover in its place. The Locus currently contains three ( 3) said to be pre-existing structures : a two-story dwelling ( 1 , 842+ square feet) , a garage sited at the front of the Lot (611+ square feet) , and the subject garage at the rear of the Lot (763+ square feet) . The Locus is non-conforming as to ground cover ratio, having a ratio of 8 ,04+%, or 3 , 216+ square feet , in a district that allows a maximum ground cover ratio of 7%; and as to side yard setback, with the front garage structure being sited 1 . 97+ feet from the westerly side yard lot line at its closest point and with the subject garage structure being sited 2 . 16+ feet from the westerly side yard lot line at its closest point in a district that requires a minimum side yard setback of ten ( 10) feet. In the alternative and to the extent necessary, Applicants are seeking a VARIANCE under Nantucket Zoning By-Law §139-16 ( Intensity Regulations) for the same project . The premises are located at 12 POLPIS ROAD, Assessor' s Map 54, Parcels 182 , 183 , 122 and 123 , Land Court Plan 10937-B, Lots 13 - 16 , inclusive. The property is zoned Limited Use General-I . ADDENDUM "A" The Applicants, LYDLE RICKARD and ROWENA RICKARD, seek a • Special Permit pursuant to §139-33A of the By-Law to demolish a pre- • existing, non-conforming 763+ square'foot garage on the rear of their property at.12 Polpis•Road and to:reconstruct.a garage/apartment with same . • foot print and ground cover in its place. • There are currently three (3) pre-existing structures on the property: a two-story dwelling (1,842+ square feet ground cover), a garage at the front of the property (611+ square feet ground cover), and a garage at the rear of the property (763± square feet ground cover). The aggregate ground cover of existing structures is 3,216± square feet (8.04%). The maximum ground cover allowable in this LUG-1 Zoning District is seven (7%) percent. Both garages are non-conforming as to sideline set back requirements. The front garage is approximately 1.97+ feet from the westerly sideline, at its closest point. The Applicants currently hold a duly issued building permit (No. 13553-96) to demolish and rebuild the rear garage. The proposed conversion and renovation of the rear garage will eliminate a dilapidated structure and enhance the neighborhood. The existing sideline setback and excess ground cover non-conformities will not increase the requested Special Permit is in harmony with the intent and purpose of the Nantucket Zoning By-Law, and the proposed project will not be more substantially detrimental to the neighborhood than the existing use of the property.
