At a Public Hearing of the Nantucket Zoning Board of Appeals
held at 1 : 00 P.M. , Friday, November 1 , 1996 in the Selectmen ' s
Meeting Room, Town and County Building, Broad Street , Nantucket, MA,
the Board made the following Decision on the Application of FRANCIS
BENEDICT PSARADELIS AND KATHLEEN NORA PSARADELIS, of P .O . Box 2320 ,
Nantucket , MA 02584, Board of Appeals File No . 058-96:
1 . Applicants are seeking a SPECIAL PERMIT under Nantucket Zoning
By-Law §139-8B( 2 ) (Neighborhood Service Establishments) . Applicants
propose to construct a 20 ' x 20 ' single-story structure to be used as
a beauty shop that would accommodate no more than two ( 2)
beauticians . Applicants also seek a SPECIAL PERMIT under Nantucket
Zoning By-Law §139-20 (off-street loading zone requirements ) .
The premises is located at 5 TOOMBS COURT, Assessor ' s Map 68 ,
Parcel 154, Plan Book 18 , Page 12 , Lot 10 . The property is zoned
Residential-2 .
2 . The Decision is based upon the Application and accompanying
materials , and representations and testimony received at the Public
Hearing. The Planning Board made a favorable recommendation,
suggesting that the dirt road used to access the property be
maintained at regular intervals . There was one ( 1 ) letter and one ( 1 )
petition , signed by thirteen ( 13) abutters and other interested
parties , on file in support of the Application . One ( 1 ) abutter and
the Building Commissioner were present at the Hearing and spoke in
favor as well . There was no opposition at the Hearing or on file .
3 . Applicants propose to construct a single-story structure with
approximately 410 square feet for no more than two ( 2 ) beauticians .
The Lot also contains a single-family dwelling . There are four (4)
proposed parking spaces for the beauty shop use and two ( 2 ) spaces
are provided for the existing dwelling. Applicants further
represented that the premises are served by Town sewer and that the
proposed use would not require large delivery trucks and therefore an
off-street loading facility would not be necessary.
4 . The Board finds that the grant of relief for the beauty shop
would be in harmony with the general purpose and intent of the Zoning
By-Law. Therefore , by a unanimous vote , the Board GRANTS the
requested relief by SPECIAL PERMIT under Nantucket Zoning By-Law
§139-8B( 2 ) to permit a neighborhood service establishment , i .e . , a
beauty shop, upon the following conditions :
a . The permitted use is for a beauty shop and any change in
use shall require further approval by the Board of Appeals;
b. The structure and parking shall be done in substantial
conformance with the plan attached hereto, done by John Shugrue and
dated September 24 , 1996 , and marked as Exhibit A; and
c . The structure shall be single-story and built in
substantial conformance with the plans as approved by Historic
District Commission Certificate of Appropriateness No. 29 , 336 .
Further, by a unanimous vote, the Board GRANTS relief by
SPECIAL PERMIT under Nantucket Zoning By-Law §139-20, waiving the
off-street loading zone requirement consistent with findings under
By-Law §139-20C.

Addendum
Applicants seek Special Permit Relief pursuant to Section 139-30A
under Section 139-8 B(2) to allow a beauty shop, being a neighborhood
service establishment. Applicants propose to construct a 20' x 20' single
story structure to accommodate no more than two beauticians.
Adequate on-site parking will be provided per the attached site plan
dated September 24, 1996.
