Applicants are seeking a SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A (alteration/extension of a pre-exiting non-conforming use/structure) . Applicants propose to add a shed roof to the westerly side of a said to be pre-existing garage structure without increasing the non-conforming southerly side yard setback distance of 2+ feet . The garage structure is non-conforming as to side and rear yard setbacks , being sited 2± feet from the southerly side yard lot line and 4+ feet from the rear yard lot line at its closest points , in a district that requires a minimum side and rear yard setback distance of 10 feet . The Lot also contains a single-family dwelling that is non-conforming as to front yard setback being sited 23± feet from the lot line that runs along East Hallowell Lane, in a district that requires a minimum front yard setback distance of 30 feet . The premises is located at 3 EAST HALLOWELL LANE, Assessor ' s Map 30, Parcels 20 and 99 , Land Court Plan 12 , 2022-B, Lots 1 and 3 . The property is zoned Residential-2 . 2 . Our Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the Hearing . The Planning Board made no recommendation and there were no letters in the file . An attorney, representing two (2) abutters , was present to speak in favor of the Application. 3 . As part of an overall renovation of the existing garage structure, Applicants propose to add a shed roof to the structure that is sited 2± feet from the southerly side yard lot line . The roof will extend the non-conforming building line in a westerly direction without coming any closer to the side yard lot line than 2+ feet . The structure also contains a second floor apartment . The present ground cover ratio is 4 . 6+% and with the proposed addition will increase to 4 . 8±% in a district that allows a maximum ground cover ratio of 12 . 5%. 4 . The Board finds that the proposed addition of the shed roof to the westerly side of the pre-existing non-conforming garage structure would be an improvement to the structure and would not be substantially more detrimental to the neighborhood than the existing non-conformity and would be in harmony with the purpose and intent of the Zoning By-Law. 5 . Accordingly, by a unanimous vote , the Boards GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A to alter the garage structure as proposed by adding the shed roof to the westerly side of the structure without coming any closer to the southerly side yard lot line than 2± feet , and subject to the following condition: a .
