TOWN OF NANTUCKET hi • BOARD OF APPEALS yc g "APonot NANTUCKET, MASSACHUSETTS 02554 NOTICE A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at 1 : 00 P.M. , FRIDAY, SEPTEMBER 6 , 1996, in the Selectmen's Meeting Room, Town and County Building, Broad Street , Nantucket , Massachusetts , on the Application of the following: SAMUEL KISSELL, TRUSTEE, KISSELL REALTY TRUST, OWNER, AND FOR BRENDA HILL, CONTRACT PURCHASER BOARD OF APPEALS FILE NO. 049-96 Applicant (Hall ) is seeking a SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A (expansion/alteration of a pre-existing/non-conforming use/structure) and a VARIANCE under Nantucket Zoning By-Law §139-16A (Intensity Regulations - front yard setback and ground cover requirements) . Applicant proposes to add dormers to an existing single family dwelling and attached garage with a ground cover of 1602+ square feet on the Locus; and to remove an existing green house/shed with a ground cover of 445± square feet and constructing in place thereof a studio/workshop structure with a ground cover of 480+ square feet . The existing green house/shed is currently situated within a "paper road" and the new structure would be sited outside of that road lay-out . When completed the ground cover will be 2 ,082+ square feet as opposed to the current ground cover of 2 ,047+ square feet . The Locus is non-conforming as to lot size having an area of 27 ,000± square feet in a district that requires a minimum lot size of 40,000 square feet; as to ground cover having an existing ground cover of 2047+ square feet in a zone that allows a maximum ground cover of 1890+ square feet for this undersized lot; and as to front yard set',ack, with the single-fz,mily dwelling being sited 22+ feet from the front yard lot line and with the green house/shed being sited 33+ feet from the lot line at their c,losest points , in a district that requires a minimum front yard setback of 35 feet . Applicant further seeks VARIANCE relief from Zoning By-Law §139-33E( 2) (b) which limits the total ground cover to 1 , 890+ square feet in order to construct the project as proposed . The new studio/garage structure will be sited no closer to the front yard setback lot line than 22+ feet at its closest point . The premises is located at 7 SOUTH VALLEY ROAD, Assessor' s Map 43 , Parcel 142 , Land Court Plan 11461-H, Lot 22 . The property is zoned Limited-Use-General- I . O 'Mara , Chairman Applicant seeks a SPECIAL PERMIT under By-Law §139-33A and a VARIANCE under By-Law §139-16A ( front yard setback, ground cover requirements) to alter and/or extend on a pre-existing non-conforming lot (containing 27 ,000 square feet , more or less by: 1 . adding dormers to the existing single family dwelling and attached garage on the premises (with a ground cover of 1 ,602+ square feet) ; and 2 . by removing an existing green house/shed (with a ground cover of 445+) and constructing in place thereof a studio/workshop structure with a new ground cover of 480+ . When completed , all structure will have a ground cover of 2082 square feet as compared with a current ground cover of 2047 square feet . Applicant further seeks relief by VARIANCE from the provisions of By-Law §139-33E(2 ) (b) which limits the total ground cover to 1 , 890+ square feet for an this undersized lot , in order to construct the studio/workshop as proposed . The green house/shed is currently sited within a "paper road" that for all intents and purposes has never been used for access . The new structure would be placed outside of the layout of the way but due to the triangular shape of the Lot, would necessitate placing it within the 35-foot required front yard setback area but come no closer to the front yard lot line than the existing non-conforming principal structure that is sited 22+ feet from that lot line.
