At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, September 6 , 1996 , at 1 : 00 P.M. , in the Selectmen' s Meeting Room, in the Town and County Building, Broad Street, Nantucket , Massachusetts, the Board made the following decision on the application of ANTHONY M. HOFFMAN and ANNE S . HOFFMAN, as Trustees of FIFTY-NINE EASTON STREET NOMINEE TRUST, Owners, and NANTUCKET YACHT CLUB, Applicant, c/o Reade & Alger Professional Corporation, Post Office Box 2669 , Nantucket , Massachusetts 02584 , File No . 046-96 : 2 . The Applicant requests the following relief in connection with its proposal to convert the existing use of the structure now existing upon the Locus, consisting of a 6-unit lodging house and manager' s apartment to an employer dormitory during periods while the Nantucket Yacht Club is in operation, to be continued as a 6-unit lodging house with manager' s apartment during the off-season, with rooms to be rented to Club members : (a) A SPECIAL PERMIT for the use of the existing structure as an employer dormitory for up to 14 occupants, pursuant to Nantucket Zoning By-law 5139-7 .D (4) ; the Applicant requests that the decision expressly provide that the Locus . may continue to be used as a 6-unit lodging house with apartment as now used at any time when it is not being used as an employer dormitory. (b) Waiver of the required parking spaces for the proposed use as an employer dormitory for up to 14 occupants, which requires eight (8) spaces under By-law § 139-18 .D, while the present use as a lodging house with dwelling unit requires nine (9) spaces . In this regard, the Applicant requests the following specific relief : (i) A SPECIAL PERMIT under By-law §139-18 .B (2) and (3 ) , reducing the number of required parking spaces by the maximum 30o thereunder, from eight (8) to six (6) ; (ii) A VARIANCE from the requirements of By-law §139-18 .D, further reducing the number of spaces to the one (1) conforming space which may be physically provided upon the Locus ; and (iii) In the alternative, a FINDING under M.G. L. c . 40A, §6 , and By-law §139-33 .A, that the alteration of use of the Locus , as to applicable parking requirements, will not be 1 substantially more detrimental to the neighborhood than the pre- existing nonconformity. The Locus is nonconforming in the following respects, all of which are said to antedate the Nantucket Zoning By-law or were the subject of Variance relief in Board of Appeals Case No. 097- 85 : (a) The use as a lodging house in the Residential-1 zoning district ; (b) The nonconformity with side yard setback requirements as measured from Cornish Street (five feet required) is zero, with the building actually encroaching on Cornish Street ; (c) Lot area; minimum lot area in this district is 5 , 000 square feet , while the area of the Locus is about 3 , 240 square feet ; (d) Ground cover ratio of the existing structure upon the Locus is about 33 . 8% ; the maximum allowed in this district is 30% ; and (e) As to parking, with none of the on-site spaces required by By-law §139-18 provided. The subject property (the "Locus" ) is situated at 59 EASTON STREET (Assessor' s Map 42 . 4 . 1 , Parcel 88 . 1) , and is shown upon plan recorded with Nantucket Deeds in Plan Book 20 , Page 51, as Lot 32B . The Locus is situated in as RESIDENTIAL-1 zoning district . 3 . Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board recommendation was favorable, provided that requirements for adequate safeguards are imposed as part of any decision. Two neighbors appeared personally or by counsel expressing concerns or opposition; the Applicant presented fourteen written expressions of support fom neighbors, most of whom are on the list of parties who received notice of this a lic Lion as required by law. 77�P�t-2- w� ` '6 (Q O� • C 4 . The zoning history of the Locus is set forth in the decision of the Board of Appeals in Case No . 097 -85 , a certified copy of which is recorded with Nantucket Deeds in Book 240 , Page 217 . That decision ratified by Variance relief the separation of the Locus , an undersized lot, from adjacent land in common ownership, and noted that the lodging house on the Locus dated from some 70 to 80 years before 1985 . The only condition of that decision was to bar additions to ground over or upward expansion; no such addition is proposed in the present case . 5 . The Board of Appeals took into consideration the proximity of the Locus to the facilities of the Nantucket Yacht Club, and the fact that the demand for parking spaces by the proposed employee occupants would be tempered thereby. The Applicant presented evidence that the Club has had an exemplary record of managing and controlling its existing dormitory facilities . Further, it was represented that the proposed dormitory rooms would be reserved for executive staff, and the Applicant was agreeable to a condition limiting use of the facility as an employer dormitory to employees of the Club only. The fact that the Applicant would keep the existing use and license as a lodging house, for occupancy by Club members and their guests only, during the off-season, was also presented as evidence that the Applicant would be further motivated to maintain the condition of the Locus at a high level . As to the requested parking relief, it was further noted that the proposed use as an employer dormitory would actually require one less parking space than the present and continuing alternative use as a lodging house . One neighbor who appeared in order to express her concern stated that the removal of vegetation in order to accommodate the one feasible parking space, with access to it from Cornish Street, would be undesirable and would have no practical beneficial effect ; the Applicant agreed that it would not cut this vegetation to create such a parking space if relief were granted from all parking requirements . 5 . Accordingly, by a UNANIMOUS vote of the five members sitting on this case, the Board of Appeals GRANTED all of the requested relief, subject to the conditions set forth in Paragraph 6 , as follows : (a) A SPECIAL PERMIT under By-law §139-7 .D (4) for the use of the existing structure as an employer dormitory for up to fourteen (14) occupants in, with the express permission for the structure to be further used as asix-unit lodging house with apartment as now used at any time when it is not being used as an employer dormitory, the Board finding that the proposed use would be in harmony with the general purpose and intent of the By-law. (b) A SPECIAL PERMIT under By-law §139-18 .B (2) and (3 ) , reducing the number of parking spaces for the proposed new use by the maximum 30% permitted thereby, from eight (8) to six (6) , the Board finding that the granting of this special permit would be in harmony with the general purpose and intent of the By-law, and that compliance with the parking requirements of §139-18 would be physically impossible for the Applicant to provide and would be contrary to sound traffic and safety considerations . (c) A VARIANCE from the on-site parking requirements of By-law §139-18 , eliminating the requirement that the Applicant provide any parking spaces upon the Locus, the Board finding that owing to circumstances relating to the shape and topography of the Locus and the structures thereon (consisting of the existng configuration ' of the Locus and structures) and especially affecting the Locus but not affecting generally the zoning district in which the Locus is situated, a literal enforcement of the provisions of the By-law would involve substantial hardship to the Owner and Applicant (in that the required parking spaces 3 for any use of the structure as presently configured cannot physically be provided) , and that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the By-law (in that the proposed use as an employer dormitory will actually require one fewer space than the pre-existing, nonconforming use as a lodging house, and the employer dormitory use is permitted by exception while the lodging house use is nonconforming) . (d) A FINDING under M.G.L. c . 40A, §6 , and By-law §139- 33 .A, that the alteration of use of the Locus, as to applicable parking requirements and waiving all parking requirements , will not be substantially more detrimental to the neighborhood than the pre-existing nonconforming use, in that the number of required parking 1paa beighborhood and there will be no other adverse impacts upon the 6 .
