DECISION:
1 . At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, August 9, 1996 , at 1 : 00 P.M. , in the
Selectmen' s Meeting Room, in the Town and County Building, Broad
Street, Nantucket, Massachusetts, the Board made the following
decision on the application of HARDY' S INC. and the ESTATE OF
ANITA F. HARDY, Owners, and INTRUM CORP. , Contract Purchaser, c/o
Reade & Alger Professional Corporation, Post Office Box 2669 ,
Nantucket, Massachusetts 02584 , File No. 040-96 :
2 . The applicants are requesting a MODIFICATION of the
Decision made by the Board of Appeals in Case No. 043-95 (the
"Decision" ) , in which a FINDING that the alteration of the pre-
existing nonconforming commercial structure upon the subject
property would not be substantially more detrimental to the
neighborhood than the existing structure, and granted SPECIAL
PERMIT relief under Nantucket Zoning By-law §139-18 .B (3) to waive
all of the required parking spaces and under §139-20 to waive the
loading zone requirement . The applicants request that the Board
determine that the total number of grandafthered parking spaces
is forty-two` (42) , rather than forty (40) as set forth in
Paragraph 6, subparagraph (d) of the Decision, and ask that the
Board strike the condition stated in Paragraph 6 , subparagraph
(c) of the Decision which reads as follows :
The uses on the first floor of the premises
shall be limited to up to five (5) retail
units . . . .
It is intended that the Decision, as so modified, shall permit
the use of the subject property, as limited by the other
conditions of the Decision, without limitation as to the number
of retail establishments so long as the total number of parking
spaces required for all uses does not exceed the forty-two (42)
grandfathered spaces . The subject property (the "Locus" ) is
situated at 5 SOUTH WATER STREET, Assessor' s Map 42 . 3 . 1 , Parcel
1
132 , shown on Land Court Plan 35745-B as Lot 1, and is zoned as
RESIDENTIAL-COMMERCIAL.
3 . Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board
recommendation was unfavorable . There was no support nor
opposition presented at the public hearing.
4 . The applicants presented their contention that the
correct number of grandfathered parking spaces should have been
calculated by the Board of Appeals as 42 , as set forth in the
application filed in Case No . 043-95, rather than 40 as
determined by the Board in the Decision. However, the Board
pointed out that the owners of the Locus, as applicants
presenting the application in Case No. 043-95, conceded that the
historic maximum nunber of employees in the hardware store upon
the Locus has been 15, rather than 21 as set forth in the
application. During the course of the hearing, however, it was
determined that the amount of square footage in the second story
of the structure upon the Locus was incorrectly presented in Case
No. 043-95 ; the correct amount of' storage space is 4 , 171 square
feet, requiring five parking spaces at the rate of one space for
each 900 square feet of gross floor area, rather than 3 , 775
square feet, requiring four spaces .
5 . The applicants also requested that the provision of the
Decision which limited the uses on the first floor of the
building upon the Locus to five retail units be stricken as
inappropriate, on the grounds that the provisions of the By-law
do not calculate parking requirements differently based upon the
number of retail units . The applicants presented a hypothetical
plan showing six retail establishments, and the Board considered
that it would be more appropriate to reestablish the number of
permitted rental units than to remove any limitation thereon.
6 . Based upon the foregoing, the Board acted by a vote of
four members in favor (Williams, Hourihan, Leichter and Waine)
and one member opposed (Sevrens) to modify the Decision by
determining that , the correct number of grandfathered parking
spaces for the uses upon the Locus is 41 rather than 40 as set
forth in the Decision; to modify the condition in Paragraph 6 ,
subparagraph (c) of the Decision so that the uses upon the first
floor of the building upon the Locus shall be limited to up to
six (6) retail units, which may interchangably be used as office

space; and to modify the language in Paragraph 6 , subparagraph
(d) of the Decision so that it shall provide that all uses upon
the Locus shall be limited so that the total number of parking
spaces required for the uses in effect at any time shall not
exceed the 41 grandfathered spaces .
6 . Except as expressly herein modified, all provisions of
the Decision shall be unaffected hereby and shall be and remain
in full force and effect .
