At a Public Hearing of the Nantucket Zoning Board of Appeals ,
held at 1 :00 P.M. , Friday, july 12, 1996, in the Selectmen' s Meeting
Room, Town and County Building, Broad Street , Nantucket, Massachusetts ,
on the Application of the ARTISTS' ASSOCIATION OF NANTUCKET, of P.O.
Box 1104, Nantucket, MA 02554, Board of Appeals File No. 038-96 , the
Board made the following Decision:
1 . Applicant is seeking VARIANCE relief pursuant to Nantucket
Zoning By-Law §139-32 from the requirements of §139-16A (Intensity
Regulations - rear yard setback) . Applicant proposes to construct an
exterior stairway, providing a secondary means of access to second
floor space, onto the rear of the structure that will encroach upon the
required five (5) foot rear yard setback by 36+" . See also Board of
Appeals File No. 003-96 that allowed construction of the new building
onto which the proposed stairway is to be added .
The premises is located at 19 WASHINGTON STREET, Assessor' s Map
42 . 3 . 1 , Parcel 95, Plan Book 9, Page 33 . The property is zoned
Residential-Commercial .
2 . The Decision is based upon the Application and materials
submitted with it and testimony and evidence presented at the Hearing.
The Planning Board made a favorable recommendation. There was no
opposition on file .
3 . Applicant was granted Special Permit and Variance relief in BOA
Decision 003-96 to demolish a derelict structure and construct a new
2 1/2 story structure that was to be used primarily as an art gallery
for the display and sale of members ' art work as well as for lectures
and possibly classes . Applicant represented that the new 760±
square-foot structure would comply with all front , side and rear yard
setback requirements and would increase the ground cover ratio from
41+% to 54+%. The existing building violated the required side yard
setback distance of five ( 5) feet by being sited 1 . 89+ feet from the
southerly side yard lot line . Applicant now represents that during the
design process, after the previous hearing, it was realized that in
order to bring the second floor space up to the Building Code, a second
means of access was needed to the second floor . Due to the layout of
the small interior space of the first floor, Applicant states that it
would be impossible to include a second stairway within the structure
and be able to provide the handicapped lift as well . Applicant will
maintain the proposed footprint with the addition of the exterior
stairway that would encroach upon the required rear yard setback
distance of five ( 5) feet by 36+" .
4 . The Board expressed concern that the exterior stairway would be
used as a primary access and was assured by a representative of the
Artists ' Association of Nantucket that they would take steps to make
sure that the stairway would not be used as an access unless in an
emergency. Therefore , the Board finds that a grant of relief by
Variance to add the exterior stairway within the five-foot rear yard
setback area by 36+" would be in keeping with sound health and safety
considerations and due to the small size of the Lot , 1 ,414+ and
structure , 760+ square feet, and owing to circumstances relating to the
soil conditions , shape or topography of such land or structures and
especially affecting such land or structures but not affecting
generally the zoning district in which it is located, a literal
enforcement of the provisions of this Zoning By-Law would involve
substantial hardship, financial or otherwise , to the Applicant , and the
desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent or purpose of such By-Law.
5 . Accordingly, by a unanimous vote, the Board GRANTS the requested
relief by VARIANCE under Nantucket Zoning By-Law §139-16A to add an
exterior stairway to the rear of the proposed structure that would
encroach upon the five-foot rear yard setback area by 36+" upon the
following conditions:
A) The exterior stairway shall be used solely for the purpose
of providing emergency access and not as a primary means of access to
the second floor space; and
B) All other conditions as stated i BO . Decision No. 003-96
shall be in full force .
