C. 37 Centre Street Nantucket, MA 02554 ZONING BOARD OF APPEALS South Beach Street Nantucket, MA 02554 Map 67 17 Old South Road Parcel 041 (portion) Book 443 , Page 245 RC-2 At a Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS held at 1 P.M. , Friday, March 8 , 1996 in the Selectmen ' s Meeting Room in the Town and County Building, Broad Street, Nantucket , Massachusetts, on the Application of Marie E . Lemberg, of 28 1/2 Pleasant Street, Nantucket, MA 02554 , Board of Appeals File No . 013-96 , the Board made the following Decision. 1 . Applicant is seeking a MODIFICATION of Board of Appeals Decision File No . 078-94 in which a SPECIAL PERMIT under Nantucket Zoning By-Law Ch. 139-9B (2) (p) (laundering and cleaning services) was granted to allow the use of a proposed structure for operation of a commercial laundry and dry cleaning business with coin operated washing machines and coin operated dryers with no dry cleaning facilities on-site . The Applicant now proposed to add a 12 ' x 16 ' addition to the rear of the structure to be used for the incidental storage of items that are to be shipped off-site to be dry cleaned. The premises is located at 17 OLD SOUTH ROAD, Assessor ' s Map 67, Parcel 41 (portion) , Plan File 44-0, Lot 5 . The property is zoned RESIDENTIAL COMMERCIAL-2 . 2 . The Board' s decision is based upon the application and materials submitted therewith, and testimony and representations made at the hearing. There were no letters in opposition . 3 . The Applicant ' s attorney, Richard J. Glidden, presented the case for the Applicant . He explained that the Applicant was not requesting any change in the use that was previously approved by the Board. After the building had been completed and all of the machines and other equipment had been installed, Applicant realized that she needed more space to take in and store dry cleaning. This 12 ' x 16 ' addition at the rear of the building is to be used to store the dry cleaning . There will be no outside access to this area and it is only for storage . There is no dry cleaning to be done on site . All ground cover, green space, parking and other intensity requirements are being complied with and no relief is needed or sought . 3 . The Board finds that the use requested will be in conformity with the spirit and intent of the Zoning By-Law, will not have an adverse impact on the neighborhood, is in a district where commercial uses are allowed and will not inherently be in violation of Ch. 139-7E(4) . 4 . Based upon the findings , the Board , by a unanimous vote , GRANTS the requested MODIFICATION of the SPECIAL PERMIT granted in Board of Appeals File No . 078-94 to add the 12 ' x 16 ' addition, upon the following conditions : ( a) All requirements and conditions contained in the previous Special Permit No. 078-94 shall remain in full force and effect with no dry cleaning performed on site and no dry cleaning chemicals stored on site; (b) Said 12 ' x 16 ' addition to be constructed as shown on a sketch plan attached hereto and marked as Exhibit "A" with the screening, parking plan and loading zone provi ed as shown.
