NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS
will be held at 1 : 00 P.M. , FRIDAY, JANUARY 5 , 1996 , in the
Selectmen ' s Meeting Room, Town and County Building, Broad Street ,
Nantucket, Massachusetts , on the Application of the following:

Applicant is requesting a FINDING under Massachusetts
General Laws , c. 40A, §6 , and Nantucket Zoning By-Law
§139-33A(4) (a) , that a proposed alteration of a said to be
pre-existing structure upon the Locus from use as a dwelling to
use as an ancillary structure to the two ( 2) dwelling units (a
principal single family dwelling and a cottage) upon the Locus ,
will not be substantially more detrimental to the neighborhood
than the existing non-conformities . The structure is
non-conforming as to setback, being sited 2 . 8+ feet at it
closest point from the easterly side yard lot line in a district
that requires a minimum side yard setback of 10 feet . Applicant
proposes to use the structure as a studio and beach changing
area , eliminating the dwelling unit, with any upward expansion
of the structure to be within the existing footprint and coming
no closer to the side yard lot line .
The premises is located at 45 QUIDNET ROAD, Assessor ' s
Map 21 , Parcel 21 , and is shown on Land Court Plan 8853-K, as
Lot 22 . The property is zoned Residential-2 .

The Applicant requests a finding under M.G.L., c.40A, §6, and Nantucket Zoning
By-law Section l39-33.A(4)(a), that the alteration of a pre-existing, nonconforming "' l s
structure upon the Locus, formerly used as a cottage for dwelling purposes, for use i
as an ancillary structure to the dwelling upon the Locus containing a studio and u
beach changing area, and not as a dwelling, will not be'substantially more detrimental op
to the neighborhood than the existing nonconformities. The structure is nonconforming -�
as to side yard setback, being 2.8 feet from the side lot line at its closest point. co
Alterations, including upward extensions, will be entirely within the existing ``
