1. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, May 11,
2016, at 11:00 A.M., at 4 Fairgrounds Road; Nantucket, Massachusetts, the Board made the
following decision on the application of AMOS B. HOSTETTER, JR., STEPHEN W.
KIDDER and MICHAEL J. PUZO, as Trustees of A &B REALTY TRUST, c/o Reade,
Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584,
File No. 12 -16:
2. The applicants are seeking relief by Special Permit pursuant to Nantucket Zoning By -law
§139 -33.A, in order to relocate the pre- existing, nonconforming structures upon the locus,
consisting of a single - family dwelling and a garage which are nonconforming as to front yard
setback from Baxter Road. The existing setbacks are approximately 3.8 feet relative to the garage
and 21.6 feet relative to the dwelling in the SR -20 zoning district where the minimum front yard
setback requirement is thirty (30) feet. The proposed alterations consist of relocating the
structures to the north, while maintaining the same front yard setbacks. The applicants further
propose to install a basement beneath the dwelling as so re- located. No new nonconformities
would be created. The subject property is located at 53 BAXTER ROAD, SIASCONSET, and is
shown upon Assessor's Map 49, Parcel 17, and upon Land Court Plan 20574 -A. The property is
situated in the Siasconset Residential -20 zoning district.
3. Our decision is based upon the application and accompanying materials, and
representations and testimony received at our public hearing. There was no Planning Board
recommendation, on the basis that no matter of planning concern was presented. Except for the
presentation by the applicants' representative, there was no support nor opposition at the public
hearing.
4. As explained by the applicants' representative, the proposal is to relocate the pre- existing,
nonconforming structures upon the locus, consisting of a single - family dwelling and a garage
(both as previously altered pursuant to Special Permit relief issued by the Board of Appeals in
Files Nos. 098 -87 and 116 -87), by moving them in a northerly direction, thus increasing their
separation from the coastal bank. As shown upon plan entitled, "Existing Conditions Site Plan
of Land in Nantucket, MA. ", dated March 15, 2016, prepared by Blackwell & Associates, Inc.,
and attached herewith as "Exhibit A ", both structures now lie within the front yard setback of
(thirty) 30 feet from the easterly sideline of Baxter Road, with setbacks from the front lot line
being approximately 3.8 feet for the garage and 21.6 feet for the dwelling.

5. As shown upon plan entitled, "Proposed Conditions Site Plan of Land in Nantucket,
MA. ", dated March 22, 2016, prepared by Blackwell & Associates, Inc., and attached herewith
as "Exhibit B ", the front yard setbacks of each structure would remain unchanged once relocated
in a northerly direction. The applicants further propose to place a basement under the dwelling
in its new location. Accordingly, the applicants request relief from the Zoning Board of Appeals
pursuant to Nantucket Zoning By -law §139-33.A, for the alteration, by relocation, of the pre-
existing, nonconforming structures upon the locus while maintaining the existing nonconformity
in front yard setback and creating no new nonconformities.
6. Locus is, and will be, in conformity with all other dimensional zoning requirements,
except for the pre- existing, nonconforming driveway entrance width of about 43.3 feet, measured
at the edge of pavement; the applicants also filed an application with the Nantucket Planning
Board for a Special Permit under By -law §139-20.1.0 in order to relocate the driveway entrance
and maintain a width of about 37.9 feet at edge of pavement, which has been granted.
7. Based upon the foregoing presentation, the Zoning Board of Appeals made the finding
that the proposed alteration to the structures and conditions upon locus, as shown upon "Exhibit
B ", would not be substantially more detrimental to the neighborhood than the pre- existing,
nonconforming conditions, and unanimously voted to GRANT relief for the proposed changes
by SPECIAL PERMIT pursuant to Zoning By -law §139 -33.A, upon the condition that no
exterior work shall be performed between Memorial Day and Labor Day in any year.
