Waine a' man cc: Town Clerk Planning Board Building Commissioner Assessor's Map 55 Parcel 312 R -C TOWN OF NANTUCKET BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 147 Orange Street At a Public Hearing of the Nantucket Zoning Board of Appeals, originally scheduled for 1:00 P.M., Friday, December 9, 1994, and continued without opening, to 1:00 P.M., Friday, January 6, 1995, in the Selectmen's Meeting Room, in the Town and County Building, Broad Street, Nantucket, MA, on the Application of MARK ARNOLD, FOR HIMSELF, AND PAULA E.ARNOLD, TRUSTEE OF SPENJEN REALTY TRUST, P.O. Box 675, Nantucket, MA 02554, Board of Appeals File No. 080 -94, the Board made the following Decision: 1. Applicants are seeking a MODIFICATION of SPECIAL PERMIT 050 -94, paragraph #6, condition (b), in order to maintain the existing two (2) apartments in a multi -use structure. See BOA File No. 032 -90. The premises is located at 147 Orange Street, Assessor's Map 55, Parcel 312, as shown on Plan File 16D, Lot 11. The property is zoned Residential - Commercial. 2. The Decision is based upon the Application and materials submitted with it, the testimony and evidence presented at the Hearing, and no letters of support or objection on file. The Planning Board recommended that, as a condition of the grant of relief, the Applicants be required to upgrade the parking area in the rear. 3. Applicants are seeking to modify BOA Decision File No. 050 -94, (which modified BOA Decision File No. 032 -90) in which Applicants were granted relief to alter the uses in a multi -use structure. As a condition for said grant of relief, Applicants were required to remove one (1) of the existing two (2) apartments so that the four (4) remaining uses in the building would be limited to: a retail /service establishment, a take -out bakery, one (1) apartment and one (1) office. The allowed uses required 19 parking spaces, with 6 allocated spaces for the retail space, 6 for the bakery use, 6 for the office use and 1 for the apartment use, keeping the total number of spaces below the MCD threshold number of 20 parking spaces. Applicants are now before the Board seeking to reduce the size of the office space, dropping the parking requirement from six (6) to five (5) and permission to maintain the second apartment that would require one (1) parking space, making the total number of parking spaces required 19. A portion of the office space would be reallocated to the second apartment. Condition (b) of paragraph # 6 of BOA Decision 050 -94 reads as follows: "One of the two apartments shall be removed from the premises by December 31, 1994, leaving the uses on the property to be a retail /service establishment, a take -out bakery, one (1) apartment and one (1) office." There are currently tenants in both apartments, with one of the tenants also being the lessor of the office space. Applicants submit that the impact on the parking would be negligible and that they would be amenable to a condition that the office space and the abutting apartment be rented to the same entity. Applicants further argue that condition (b) of paragraph #6 is in conflict with condition (c) which reads as follows: "Applicants shall return to the Board of Appeals for a modification of this relief should the uses of the Lot be modified to such an extent that the parking requirements of all the uses exceed the nineteen (19) parking spaces currently required." The confusion lies in the fact that under (b) Applicants must remove one of the apartments, but under (c) they would be allowed to maintain all five (5) of the proposed uses should the parking requirements not exceed 19. In this case, reducing the size of the office and maintaining the second apartment would constitute no additional parking and thus would be allowable under condition (c). 4. The Board, as it did in BOA Decision File No. 050 -94, expressed concern about the intensity of the use of the structure and felt that increasing the uses from four (4) to five (5), by allowing the second apartment to remain would be inappropriate whether or not there was an increase in the parking requirements. The Board further noted that at the previous Hearing on BOA Application File No. 050 -94, Applicants assured the Board that it would be acceptable to have a condition requiring the removal of the second apartment in order to be allowed to alter the uses as proposed. 5. Accordingly, upon a motion made and seconded to grant the requested modification, the relief was DENIED by a vote of three (3) in favor (Williams, Leichter and Sevrens) on the grounds that there was no increase in parking and two (2) opposed (O'Mara and Waine) on the grounds that there were insufficient grounds to warrant a grant of relief to intensify the uses in the structure from four (4) to five (5).
