Enclosed is the Decision of the BOARD OF APPEALS which has
this day been filed in the office of the Nantucket Town
Clerk.
An Appeal from this Decision may be taken pursuant to
Section 17 of Chapter 40A, Massachusetts General Laws.
Any action appealing the Decision must be brought by
filing an complaint in court within TWENTY (20) days after
this day's date. Notice of the action with a copy of the

At a Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS
originally scheduled for 1 P.M., Friday, December 9, 1994 and
continued without opening until 1:00 P.M., Friday, January 6, 1995
held in the Selectmen's Meeting Room in the Town and County
Building, Broad Street, Nantucket, Massachusetts, on the
Application of Marie E. Lemberg, of 28 1/2 Pleasant Street,
Nantucket, MA 02554, Board of Appeals File No. 078 -94, the Board
made the following Decision.
1. Applicant is seeking a Special Permit under Nantucket Zoning
By -Law Ch. 139-9 B(2) (p) to allow the construction and operation of
a commercial laundry and dry cleaning business. The laundry will
have 22 coin operated washing machines and 18 coin operated dryers.
There will be no dry cleaning facilities on -site.
The premises is located at 15 OLD SOUTH ROAD, Assessor's Map
67, Parcel 41 (portion) , as shown in Registry Plan Book 2, Page 85.
The property is zoned RESIDENTIAL COMMERCIAL -2.
2. The Board's Decision is based upon the Application and
materials submitted therewith, Site plan entitled "Lemberg
Commercial Building ", drawn by John J. Shugrue, Inc., dated
November 11, 1994, "Drainage Plan" drawn by John J. Shugrue, Inc.,
dated December 7, 1994, Landscaping Plan drawn by John D. Betar,
dated December 6, 1994, and testimony and representations made at
the hearing. There were no letters in opposition and the Planning
Board made a favorable recommendation provided the following
specific concerns were addressed: (a) A landscape plan showing all
proposed landscaping and vegetative screening. (b) The driveway and
parking area should be paved and all run -off should be contained
on the lot. A drainage analysis, stamped by a Professional Engineer
should be required. The Town Engineer, Mohamed Nabulsi could
review the calculations. (c) A negative slope from Old South Road
into the parking area should be required to prevent run -off from
draining onto Old South Road creating a safety hazard. (d) Ch.139-
12B(2)(s)(a), of the Wellhead Protection District regs., regarding
stormwater run -off should be following. Oil /water separators and
signed contracts for their maintenance should be required given the
proximity to our drinking water supply. (e) Site distances should
be a minimum of 300 feet in either direction from the driveway
entrance along Old South Road.
3. The applicant's attorney presented the case for the Applicant.
The proposal is for the construction and operation of a laundromat
with 19 coin operated washing machines and 20 coin operated dryers.
There will also be dry cleaning services provided, but all dry
cleaning will be done off - premises, the laundromat merely serving
as a drop -off and pick -up location. The laundromat will be
serviced by Town sewer and there will be holding tanks, approved
by the Nantucket DPW, installed on the premises to insure that the
pumping into the sewer system is done at off -peak hours. The plans
for the building have been approved by the HDC (file No. 26352).
Applicant intends to install paving, oil trapping catch basins,
landscaping, and parking, all in accordance with the requirements
of the By -law and as recommended by the Planning Board. The
specifics are shown on two plans of John J. Shugrue, Inc., and one
plan of John D. Betar (referred to in Paragraph 2). The site
distances for ingress and egress from Old South Road exceed all
State safety requirements and the area is zoned for commercial uses
with the Nantucket Electric Company being an immediate abutter.
There will be no chemicals or hazardous materials associated with
dry cleaning stored on the premises as the dry cleaning will be
done off -site.
4. The Board finds that the use requested will be in
conformity with the spirit and intent of the Zoning By -law, will
not have an adverse impact on the neighborhood, is in a district
where commercial uses are allowed and will not inherently be in
violation of Ch. 139 s. 7 E (4).
5. Based upon the Findings, the Board, by unanimous vote
GRANTS THE REQUESTED SPECIAL PERMIT under Ch. 139(9)(B)(2)(p) upon
the following conditions:
(a) The laundromat be connected to Town sewer and that
the facility is constructed in accordance with the plans submitted
as part of this application (plans referred to in Paragraph 2
supra).
(b) Storage, use and disposal of hazardous materials and
waste will be undertaken in accordance with federal, state and
local laws and regulations.
(c) There will be no dry cleaning performed on premises.
