Applicants state that the property is also very wet and the piers for the shed would be extremely difficult to move the 7" to correct the siting error. Applicants ask that the- Board validate the siting of the shed. 4. In a separate request for relief, Applicants represent that an addition was constructed onto a pre- existing nonconforming single- family structure, in 1979, under a validly issued Building Permit. Upon completion a Certificate of Occupancy was then issued at a time when "as- built" plot plans, done by a licensed surveyor, were not required to obtain said Certificate. An error in siting was also discovered when the new plot plan was done. The southwest side of the 1979 addition was mistakenly sited within the five -foot setback area, having a setback of 2.6+ feet from the side yard lot line. Applicant is currently making application to the Building Department for an addition to the rear of the dwelling as shown on Exhibit "A" attached hereto, a surveyed plot plan dated September 1, 1994 and done by Blackwell and Associates, Inc. The addition wil! be placed outside of the required setback areas and will not violate the ground cover requirements. Applicants request that the Board validate the current siting of the single - family dwelling either by Special Permit or Variance so that the Applicants can proceed with the permitting process. 5. As to relief for the shed, upon a motion made and seconded to grant the Variance relief requested to validate the siting of the structure under Zoning By -Law §139 -16A, three (3) members voted in favor (Waine, Williams and Leichter) on the grounds that owing to circumstances relating to soil conditions, i.e., the wet ground under the shed, and shape of the parcel, i.e., the unexplained jog in the northeasterly lot line and relocation of the shed would create an undue financial hardship on the Applicants, said relief could be justified. Two (2) members voted against the grant of relief (Balas and Angelastro) on the grounds that the tests for grant of a Variance were not met and that a literal enforcement of the provisions of the Zoning By -Law did not create a substantial hardship for the Applicants. Needing a minimum of four (4) votes to grant the Variance, relief is hereby DENIED. 6. As to relief for the single- family dwelling with addition, upon a motion made and seconded to deny Variance relief to validate the siting of the dwelling, the Board, by unanimous vote, DENIED the VARIANCE relief under Zoning By -Law §139 -16A on the grounds tha_ a Variance was not needed due to the protection against zoning enforcement as to dimensional matters under the six (6) year curative statute, M.G.L., Chapter 40A, §7 and By -Law §139- 25C(3), afforded such structures built under a duly issued Building Permit and that the six (6) year time limit for such enforcement has expired. The Board further finds that the new addition will not be constructed i,l violation of any Zoning By -Laws being sited outside of the required setback areas and within the required allowable ground cover on the Lot and that a Building Permit may be issued for the proposed addition.
