Applicant is seeking relief under Nantucket Zoning By -Law §139 -33A to allow the construction of an enclosed entry -way room addition onto the front of a said to be pre- existing nonconforming single - family dwelling. The Lot contains 12,682+ square feet of lot area in a district that requires a minimum lot size of 20,000 square feet. The dwelling is nonconforming as to setbacks being sited 23.2± feet from the front yard lot line in a district that requires a 30 -foot front yard setback and has a zero easterly side yard setback at its closest point in a district that requires a ten foot side yard setback. The proposed 64+ square foot addition would be sited 20.31+ feet from the front yard lot line. In the alternative, Applicant is seeking relief by VARIANCE pursuant to Nantucketk Zoning By -Law §139 -32A from the requirements of Nantucket Zoning By -Law §139 -16A (Intensity Regulations - setbacks) in order to construct the aforementioned addition. The premises is located at 12 TENNESSEE AVENUE, MADAKET, Assessor's Map 60.1.2, Parcel 5, as shown in Land Court Plan 3092 -S, Lot 2. The property is zoned Residential -2. 2. The Decision is based upon the Application and materials submitted with it, testimony and evidence presented at the Hearing and no letters on file. The Planning Board made no recommendation. 3. Applicant proposes to add an enclosed entry -way onto the front of a pre- existing nonconforming single - family dwelling. The addition will come closer to the front yard lot line than the existing structure thus making it more nonconforming. No other alteration is planned. 4. The Board finds that the proposed addition would be an intensification of the nonconforming front yard setback and is unable to justify grounds for a grant of a Variance under Zoning By -Law §139 -16A and a literal enforcement of the provisions of the Zoning By -Law would not involve a substantial hardship, financial or otherwise, to Applicant. Therefore upon a request by Applicant to WITHDRAW WITHOUT PREJUDICE the request for VARIANCE relief, the x(072 -94) -2- Board so voted unanimously. 5. Accordingly, the Board, by a vote of four (4) in favor (Waine Williams, Leichter and Hourihan) and one (1) opposed (Sevrens) GRANTS the requested SPECIAL PERMIT relief under Zoning By -Law §139 -33A to alter and extend a pre - existing nonconforming structure by adding an entry -way room onto the front of the dwelling and further finds that said alteration and extension will not be substantially more detrimental than the existing nonconforming structure, subject to the following conditions: a. The addition shall not increase the nonconforming front yard setback and be sited no closer to the lot line than 23.2± feet; and b. The addition shall substantially conform to the Conservation Commission's Order of Conditions #5E -48 -414. The property is situated at 12 Tennessee Avenue, Madaket and is zoned Residential - 2. The Lot has an area of 12,682± square feet and the cottage is non - conforming as to side and front yard set back requirements. The existing ground cover is 1,103 square feet (8.70). The proposed addition would add sixty -four square feet to the cottage and increase the ground dover to 1, 167± square feet (9.2%) . The maximum ground cover allowable in the R -2 Zoning district is 12.50. The front of the cottage is 23.2 feet from Tennessee Avenue and the required front yard set back is thirty (30.00) feet.
