1. Applicants seek relief by VARIANCE pursuant to Nantucket
Zoning By -Law §139 -32A from the requirements of Nantucket Zoning
By -Law §139 -16A (Intensity Regulations - lot size and maximum ground
cover) in order to expand the existing single family dwelling. The
existing 89,859+ square foot lot is the result of a 1994 merger of
undersized Lot 34, containing 56,716+ square feet of lot areas and
abutting Lot 59, containing 33,143 square feet of lot area. A minimum
lot size of 120,000 square feet is required in this zone. The
existing dwelling has 2,485+ square feet of ground cover, or 2.77%
ground cover ratio, in a zone that allows a maximum ground cover
ratio of 3 %. Applicant proposes to demolish and rebuild part of the
existing dwelling to add a garage with living space overhead
ancillary to the primary dwelling unit, increasing the overall ground
cover by 420+ square feet for a total of 2,905+ square feet, or
3.23 %.
In the alternative, and to the extent necessary, Applicants
request VARIANCE relief from Nantucket Zoning By -Law §139 -16A to
validate the lot as reconfigured, and relief by SPECIAL PERMIT under
Nantucket Zoning By -Law §139 -33A in order to build an addition onto
the existing dwelling.
The premises is located at 86 and 88 (portion) POCOMO ROAD,
Assessor's Map 15, Parcels 41 and 42 (portion). The property is
zoned Limited Use General -III.
2. The Decision is based upon the Application and materials
submitted with it and the testimony, plans and photographs presented
at the Hearing. There were four (4) letters in support in the file
and the Planning Board made an unfavorable recommendation stating
that there were no grounds for a grant of a Variance.

3. Applicants represent that they have owned 86 Pocomo Road, Lot
43, from 1983 to the current time. Based upon the "as- built" plot
plan by Nantucket Surveyors, Inc. the lot area is 56,716 square feet,
with a ground cover of 2,485+ square feet and a ground cover ratio of
4.4 + %.
On May 4, 1994 the Applicants purchased a portion of an
abutting vacant parcel of land known as 88 Pocomo Road (portion), Lot
59, which technically merged with the property already owned by the
Applicants.
As of May 4, 1994, with the properties merged under zoning,
the total lot area now is 89,859+ square feet with a ground cover of
2,485+ square feet and a ground cover ratio of 2.765 %.
4. Applicants propose an addition, a garage with living space
over it, to the existing dwelling. With the addition, the ground cover
would be increased to 2,905+ square feet and the ground cover
ratio would be increased to 3.233 %, or 209+ square feet over the
maximum ground cover ratio allowed of 3 %.
Applicants further represent that the vacant Lot 59, prior to
being subdivided and sold to the Appicants, could have potentially
supported two dwellings with a total ground cover of approximately
2,800+ square feet. Applicants argue that since they purchased
approximately one -third of the vacant lot, enlarging their own lot,
they should be entitled to an additional 900+ sauare feet of ground
cover. However, Applicants are requesting only 209+ square feet in
this Application. Applicants further argue that the proposed enlargec
structure on the combined lots is more conforming, having a 3.233%
ground cover ratio, than the existing structure on the original lot,
having a 4.4 +% ground cover ratio. If Applicants had not purchased a
portion of Lot 59, they would have been entitled to come before us
and ask for Special Permit relief to construct an addition.
5. The Board finds that owing to the shape of the lots, the
siting of the existing building in close proximity to the bank and
the topography of the building site and the benefit to the neighbors
not having a house, possibly two, constructed on the abutting vacant
lot, all affect this particular property in a manner which does not
generally affect the LUG III zoning district and a literal
enforcement of the By -Laws would involve substantial hardships to the
Applicants and be more detrimental to the neighborhood and justifies
the grant of relief to validate the two Lots 59 and 34 as
reconfigured as one lot. However, the Board did not find sufficient
grounds to allow an increase of ground cover ratio beyond the maximum
allowable 3 %, that they would otherwise be entitled to as a matter of
right.
6. Accordingly, by a unanimous vote, the Board hereby GRANTS a
a VARIANCE under Zoning By -Law §139 -16A to allow a maximum ground cover
ratio of 3% and, to the extent necessary, validate the combined Lots
59 and 34 as reconfigured as one lot. Said relief may be
granted without substantial detriment to the public good and without
nullifying or substantially derogating from the intent or purpose of

the By -Law subject to the following conditions:
a. Lots 59 and 34 shall be merged as one lot for zoning
purposes; and
C. The ground cover ratio shall not exceed 3% or 2,695
square, feet.

ADDENDUM
Applicants seek to expand an existing single family dwelling. The existing
dwelling is on a Lot acquired by the Applicants in 1983 which did not conform to
zoning. The Applicants acquired a parcel of adjoining vacant land in 1994. The
combined property now owned by the Applicants is more conforming than the
single Lot previously owned by the Applicants, but it still does not conform to
current zoning requirement of minimum lot size.
Applicants propose to remove a portion of the existing dwelling and
construct an addition for a net increase of ground cover of 420 square feet. The
increase in ground cover would increase the ground cover ratio to 3.233% or
209.37 +/- feet. The proposed addition exceeds the permitted ground cover ratio
because of the topography and location of the existing dwelling. Due to the
topography of the land area there can be only one floor of living space above
ground level or the addition will exceed the recommended height limitations of
the Historic District Commission. Applicant seeks variance relief pursuant to
Section 139 -32A.

the lot as it exists upon the zoning merger of Lot 34 and 59 to the extent
