At a Public Hearing of the Nantucket Zoning Board of Appeals
held at 1:00 P.M., on November 4, 1994, in the Selectmen's Meeting
Room, Town and County Building, Broad Street, Nantucket, MA, on the
Application of JOAN E. DIPRETA, of 73 Waters Edge, Rye, NY 10580,
File No. 069 -94, the Board made the following Decision:
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket
Zoning By -Law §139 -33A to alter and extend a said to be pre- existing
nonconforming front stoop area that is sited 1.69+ feet from the
front yard lot line at its closest point by removing the existing
shed roof over the porch and constructing a gable roof that will be
extended to cover more of the porch area without coming any closer
to the front yard setback.
The premises is located at WARREN STREET, Assessor's Map
55.4.1, Parcel 39, as shown in Registry Plan File 25I, Unit 2. The
property is zoned Residential -1.
2. The Decision is based upon the Application and materials
submitted with it, testimony and evidence presented at the hearing,
and one letter in support on file. The Planning Board made no
recommendation.
3. Applicant proposes to remove an existing shed roof over the
pre- existing nonconforming front step area and replace it with a
gable roof that will extend further over the steps but come no
closer to the front lot line than the existing stoop. The stoop will
become a covered open porch and will not increase the ground cover
on the Lot.
4. The Board finds that the proposed structural change will not
be substantially more detrimental to the neighborhood than the
existing nonconforming structure and, therefore, GRANTS the SPECIAL
PERMIT under Nantucket Zoning By -Law §139 -33A, by a unanimous vote,
subject to the following conditions:
a. The proposed structure shall be built in substantial
conformance with Exhibit "A" attached hereto and labeled "North
Elevation "; and
b. The proposed alteration shall be built substantially
in conformance with Historic District Commission Certificate of
Appropriateness No. 25,956.
