Applicant is seeking relief by VARIANCE pursuant to
Nantucket Zoning By -Law §139 -32A from the requirements of
Nantucket Zoning By -Law §139 -16A (minimum lot size), in order to
validate the subject Lot 24, of a four lot subdivision, as a
separately buildable lot. The locus has 71,584± square feet of
lot area in a zone that requires a minimum lot size of 80,000
square feet. Applicant proposes to relocate an existing single
family dwelling from abutting Lot 26 onto the subject Lot. In
addition, or in the alternative, Applicant is seeking a
MODIFICATION of BOA Decision 026 -75 which would require no relief
but a finding that the movement of the dwelling from Lot 26 to
Lot 24 is within the scope and intent of said Decision. See BOA
Files No. 026 -75, 088 -88, 115 -88.
The premises is located at 47 WEST MIACOMET ROAD, Assessor's
Map 86, parcel 007, as shown in Land Court Plan 17368 -I, Lot 24.
The property is in the Moorlands Management District.

Locus is subject to and has the benefit of a Variance granted at the August 26, 1975
meeting (BOA File No. 26 -75) which allowed a redivision of Lots 11 and 17 on Land Court
Plan No. 17368 -F into Lots 24, 25, 26 and 27 as shown on Land Court Plan 17368 -I.
Only two lots were to be buildable with one (1) single - family dwelling on each of the two
(2) lots. Lots 25 and 27 are owned by the Land Bank. Lot 26 is owned by the contract
purchaser for Lot 24 and there is a single - family dwelling on Lot 26 which is becoming
dangerously close to the water. Applicant seeks a Variance under 139 -32A from 139 -16A
whereby Lot 24 will be validated as a buildable lot and he will be allowed to move his
existing dwelling from Lot 26 to Lot 24 which is an undersized lot. (Relief has already
been given for the substandard frontage). Lot 26 would remain vacant and unbuildable
with only one dwelling on Lots 24 and 26 as per the original intent of the Variance. In the
alternative, Applicant seeks a modification of decision No.026 -75 which would require no
relief but a finding that the movement of the dwelling from Lot 26 to Lot 24 is within the
scope and intent of said decision.
