TURRENTINE, P.O. Box 504, Nantucket, MA 02554, Board of Appeals File No. 064 -94, the Board made the following Decision: 1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By -Law §139 -33A to allow the demolition of the rear one -story portion and deck of an existing single family dwelling and to allow the construction of a new two -story addition with deck on the same foot print. The dwelling is sited on an undersized lot having 3886+ square feet of area in a zoning district that requires a 5,000 square foot minimum lot size. The structure is said to be pre- existing nonconforming as to setbacks, having a zero side yard setback on the westerly lot line in a district that requires 5 feet and as to ground cover, having 1378+ square feet of ground cover with a ground cover ratio of 35.5 +% in a district that allows a 30/ maximum ground cover ratio, or 1166.t square feet of ground cover for this lot. Applicant further proposes to relocate a said to be pre- existing shed that is nonconforming as to its present setback, being sited .06+ feet, at its closest point, from an easterly side yard lot line, to a location 30 feet to the north, 20 feet from the front yard lot line and sited 3± feet from the easterly side yard lot line. The premises is located at 2 FARMER STREET, Assessor's Map 42.3.2, Parcel 103, as shown in Registry Plan Book 44 -S. The property is zoned Residential Old Historic. 2. The Decision is based upon the Application and materials submitted with it, the testimony, evidence and photographs presented at the Hearing, a letter on file objecting to the proposed relocation of the shed, stating that it would infringe on the enjoyment of the rear portion of the abutter's yard, and a letter on file from another abutter supporting the project. The Planning Board made no recommendation on the demolition and reconstruction of the addition but did state that the relocation of the shed should meet the setback requirements. 2. Applicant proposes to demolish an existing one -story addition on the rear of the dwelling and construct a new two -story addition that would be sited in the same footprint as the existing portion of the structure that currently does not violate the setback requirements as shown on the surveyed plot plan marked as Exhibit "A ". (064 -94) , -2- Y. The proposed alteration is part of a larger overall renovation plan for the entire structure and a new foundation would be constructed under the new addition. Applicant further proposes to relocate the existing shed to a point farther north along the same easterly side yard setback line to relieve the congestion in the rear of the lot. The new location is represented to be more practical in that it would be closer to the street and more readily accessible to store bikes and tools, uses ancillary to the principal dwelling use on the Lot. The shed would be sited 3+ feet from the side yard lot line instead of the .06+ feet that it is currently located as well as increase the distance between the house and the shed. 3. Taking the requests for relief separately, i.e., the demolition and reconstruction of the addition and the relocation of the shed, the Board makes the finding that the proposed demolition and reconstruction of the rear portion of the dwelling would not be substantially more detrimental to the neighborhood and in keeping with the purpose and intent of the Zoning By -Law, and therefore GRANTS, by unanimous vote, the requested SPECIAL PERMIT under Zoning By -Law §139 -33A subject to the following conditions: A. The demolition and reconstruction of the new addition shall be done in substantial conformity with the Historic District Commission's Certificate of Appropriateness #26,109; and B. The addition shall be sited as shown on Exhibit "A" attached hereto. 4. The Board expressed concern that if there was a possibility of relocating the shed to a site outside of the five foot setback area then Applicant did not show grounds for grant of relief by Special Permit. Accordingly, upon a request by the Applicant, the Board, by a unanimous vote, allows the WITHDRAWAL WITHOUT PREJUDICE of that part of the Application that concerns the relocation of the shed.
