Notice of the action with a copy of the complaint and certified copy of the Decision must be given to the Town Clerk so as to be received within such TWENTY (20) days. n,�4 Z3::� -Waive Chairman cc: Town Clerk Planning Board Building Commissioner ADDENDUM Applicant seeks Variance Relief pursuant to Section 139-32A from Section 139-16A, Intensity Regulations, to validate the existing structures now situate on the Lot which have a total ground cover ration of 5.35% in a zone with permitted ground cover of 4%. The Lot as shown at Plan Book 16, Page 38 was created in 1964 and shows the existing structures and one additional structure which has since been removed. The Lot was held in the joint names of a husband and wife from 1964 until 1973 when the wife died. The Lot and abutting property owned in the name of Frank H. Powers may have technically merged under zoning. In 1985, the Lot was deeded into the joint names of Frank H. Powers and Donalda A. Powers. Frank H. Powers died in 1985. There is a settlement agreement filed in the Nantucket Probate Court by the heirs of Frank H. Powers pertaining to his property interests. Donalda Powers is in the process of selling the property and the zoning issue was raised when a mortgage plot plan was prepared on behalf of the buyers. The Board may find that owing to circumstances relating to the shape or topography of such land and structures and especially affecting such land or structures, but not affecting generally the zoning district in which it is located, a literal enforcement of the provisions of the Zoning Bylaw would involve substantial hardship, financial or otherwise to the Applicant. The desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the such bylaw.
