filing an complaint in court within TWENTY (20) days after
this day's date. Notice of the action with a copy of the
complaint and certified copy of the Decision must be given
to the Town Clerk so as to be received within such TWENTY
(20) days.

At a Public Hearing of the Nantucket Zoning Board of Appeals
held at 1:00 P.M., Friday, July 8, 1994 and continued to 1:00 P.M.,
Friday, August 12, 1994, in the Selectmen's Meeting Room, Broad
Street, Town and County Building, Nantucket, Massachusetts, on the
Application of MARK ARNOLD, FOR HIMSELF, PAULA ARNOLD, TRUSTEE,
SPENJEN REALTY TRUST of 149 Orange Street, Nantucket, MA.02554,
Board of Appeals File No. 050 -94, the Board made the following
Decision:
1. Applicants seek relief by MODIFICATION of the SPECIAL PERMIT
and VARIANCE issued in BOA File No. 032 -90, in which 9 of 23 parking
spaces were waived. Applicants now propose to change the current
950+ square foot basement use, that of a community recreational
facility (video arcade), to a retail /service establishment and
replace one of two apartments in the structure with an office use.
The other uses, a second apartment and a take out bakery, will
remain unchanged.
The premises is located at 147 ORANGE STREET, Assessor's Map
55, Parcel 312, as shown on Plan File 16D, Lot 11. The property is
zoned Residential- Commercial.
2. The Decision is based upon the Application and materials
submitted with it, the testimony and evidence presented at the
hearing, no letters on file and a favorable recommendation from the
Planning Board suggesting conditions relating to the parking area,
i.e., upgrade the dirt surface in the rear, improved signage
indicating parking areas and upgrading of plantings and parking
delineation, be addressed.
3. The permitted uses under the previously granted Special Permit
and Variance, BOA File No. 032 -90 are community recreational facility
( a video game room) in the basement space; a take -out bakery; and
two (2) apartments, engendering parking requirements (in 1990) of 15
spaces, 6 spaces and 2 spaces (totalling 23) respectively.
Applicants provided 14 spaces and thus 9 spaces were waived.
Applicants propose to alter the permitted uses by changing the 950±
square feet of video arcade space to a retail /service establishment,
removing one of the two apartments and replacing it with office use
and leaving the other apartment and bakery use unchanged. The new
uses would require 19 parking spaces, 6 for the retail space, 6 for

the bakery use and 1 for the apartment use. The 14 spaces are
currently being provided on the lot.
4. In the previous Decision (032 -90), #5, condition (d) it states
that:
"The Applicant must return to the Board of Appeals for a
modification of this relief should the uses of the Lot be
modified from the current uses for residences, a take -out
bakery, and the video game room permitted hereby."
Applicants must return to this Board to alter any of the uses even if
those uses require less parking then those previously permitted.
As is generally the case, the Board requires a return for a
modification when the uses on a lot would increase the parking
requirements beyond what was permitted and /or waived.
5. Applicants acknowledge that uses have already been altered
prior to application for modification to this Board and are seeking
to rectify the situation with this application. The basement use has
been changed to a carpet store and an office has been installed on an
upper level of the structure while simultaneously maintaining the two
apartments.
6. Accordingly, the Board finds that the change in uses is not more
detrimental to the neighborhood and further finds that grant of the
modification would be in harmony with the purpose and intent of the
By -Law and GRANTS the MODIFICATION by a unanimous vote, and further
waives five (5) parking spaces to the extent necessary, from 19 to 14
spaces, 14 currently being provided, subject to the following
conditions:
a. The lines used for delineation for the parking spaces
shall be repainted by December 31, 1994;
b. One of the two apartments shall be removed from the
premises by December 31, 1994, leaving the uses on the property to be
a retail /service establishment, a take -out bakery, one (1) apartment
and one (1) office; and
C. Amending #5, condition (d) of BOA Decision (032 -90)
to read:
"Applicants shall return to the Board of Appeals for a
modification of this relief should the uses of the Lot be
modified to such an extent that the parking requirements
of all the uses exceed the nineteen (19) parking spaces
currently required."

Board of Appeals, Spenjen Realty Trust (Arnold), Case No. -
1. Applicant seeks relief by Modification of Special Permit anc
Variance (BOA #032 -90) to allow a change of use of the basement
from a community recreational facility (namely a video arcade) tc
a retail sales establishment and a change of use of the first anc
second floors from a residential apartment to an office.
2. Applicant proposes to convert approximately 950 square feet of
a basement space to a retail store and service establishment witr:
no more than three employees on peak shift.
3. Applicant proposes to convert approximately 1000 square feet
of a two level apartment to an office with no more than three
employees.
4. Other uses of the structure are a take -out bakery and a:
apartment.
5. The premises are presently benefitted by 14 parking spaces. 1:
parking spaces are required under 139 -18 (6- bakery, 6- retail sale:
and service, 6- office, 1- apartment). Due to the slope of the rea,-
of the lot and the grass area of the Northwesterly corner of th:-°
lot, providing the full 19 spaces would be physically impractica =..
and would have an adverse scenic impact on the neighborhood.
Applicant thus proposes a waiver of five parking spaces to permi•-
a total of 14 off - street parking spaces.
