Applicants are appealing the April 7, 1994, Decision of the Building Commissioner under Nantucket Zoning By-Law §139-31 , denying a building permit application for construction of a garage upon the Locus on the basis that the Locus is not entitled to Nantucket Zoning By-Law §139-33E(2) (b) relief which would permit a minimum ground cover of 1 , 500 square feet . In the alternative, Applicants seek a Variance from the ground cover ratio requirements of Nantucket Zoning By-Law §139-16A ( Intensity Regulations) . The Locus issaid to be pre-existing non-conforming as to lot area and frontage in a district that requires a minimum lot area of 120,000 square feet and frontage of 200 feet, and having been created, and held in ownership separate from all adjacent land since a time, prior to the effective date of the By-Law in 1972 . The Locus was vacant in 1972 , and a dwelling having a ground cover of about 865 square feet was built upon it in 1982 . The proposed garage would have a ground cover of about 394 square feet, bringing the total ground cover of the Locus to about 1 , 259 square feet . The premises are located at 32 GLOUCESTER STREET, TOM NEVERS , Assessor ' s Map 76 .4. 2, Parcel 206 and is shown as Lots 21-25 and 56-60 , inclusive, Block 15 , on Land Court Plan 5004-G, Certificate of Title No. 15,097 . The property is zoned Limited Use General-III . 2 . Our Decision is based upon the Application papers and supporting materials filed therewith, the denial letter by the Building Commissioner dated April 7 , 1993 (actually dated April 7 , 1994) and the testimony and representations presented at our hearing . The Planning Board Staff recommendation was unfavorable . 3 . We find that the Locus was a vacant lot in 1972, at the time of zoning inception, and has been held in ownership separate from all adjacent land since a time prior to the effective date of the Nantucket Zoning By-Law in July, 1972 . The Locus is now improved by a single-family dwelling constructed in 1982 . The Locus has a lot •(047-94) -2- . area of 20, 000+ square feet ( 120 , 000 SF being the minimum required in this district) , frontage on Gloucester Street of about 100 feet ( 200 feet being the minimum required) , and existing ground cover of 865+ SF (about 4. 325%) . Maximum ground cover in this district is 3%; however , under §139-33 .E( 2 ) (b) , a maximum ground cover of 1 , 500 SF is allowed for certain lots . 4. Upon application to the Building Department for a Building Permit to construct a 394+ SF garage on the lot that would bring the total ground cover to 1 , 259+ SF, the Building Commissioner denied the Building Permit on the grounds that the lot did not meet §139-33 .E( 2) (b) requirements as the section applies to unimproved lots only and the subject lot had been previously improved with construction of the dwelling . No additional construction was permitted up to 1 , 500 SF total ground cover as a matter of right on an improved, pre-existing non-conforming lot of record, even if the existing structure was constructed after the effective date of the zoning change which subsequently rendered the lot non-conforming . In other words, the Applicant could have applied for a total ground cover of 1500 SF under the first Building Permit but, because they did not build up to 1500 SF under that permit , they could not obtain multiple permits to imrove the property any further over time, after that point. However, if the building(s) were removed from the improved lot it would become unimproved and could obtain the benefit of the 1500 SF minimum ground cover provisions . 5 . We find no support in the By-Law for the Building Commissioner ' s position. The Applicants argue that the question of whether the lot is "improved" or "unimproved" for purposes of application of the provisions of §139-33E should be determined as of the time of the effective date of the zoning requirement which rendered the lot non-conforming. The Locus was unimproved when the zoning requirement with which it did not conform became effective in 1972 . We accept this argument, and find that the Locus, having been unimproved until a time after it became non-conforming, has the benefit of the 1500 SF ground cover maximum and may be built upon up to that maximum, whether in one structure or in several, or under one Building Permit or several . All other dimensional requirements of the By-Law, including setbacks, must be followed . 6. Accordingly, by unanimous vote, the Board finds that the Building Commissioner was in error in denying the Applicants ' Building Permit Application as to the ground cover ratio which he raised as the grounds for denial , REVERSE his decision and direct that, if the Applicants are otherwise entitled to the building permit for which they applied, it shall be issued to them. 7. ADDENDUM Pursuant to Nantucket Code Section 139-31 , Applicants hereby appeal the decision of the Building Commissioner dated April 7 , 1993, denying their application for a building permit for construction of a garage upon the Locus. In the alternative, Applicants seek a variance pursuant to Code Section 139-32 from the ground cover ratio provision of Code Section 139-16.A. ( Intensity Regulations) . The Locus was a vacant lot in 1972 and has been held in ownership separation from all adjacent land since a time prior to the effective date of the Nantucket Zoning By-law in July, 1972. The Locus is located in a Limited Use General-3 Zoning District and is improved by a single-family dwelling constructed in 1982. The Locus has lot area of about 20,000 square feet (120,000 square feet are required) ; frontage on Gloucester Street of about one hundred feet (200 feet are required) ; side yard setback of about 19 feet to about 40 feet (20 feet are required; 10 feet are required for certain lots under Code Section 139-33 .E. (3) (a) ) ; and existing ground cover of about 865 square feet (under Code Section 139-33.E. (2) (b) , a maximum ground cover of 1,500 square feet is allowed for certain lots) . The proposed garage would have a ground cover of about 394 square feet, and the Locus as so improved would have a total ground cover of about 1 , 259 square feet. The Building Commissioner denied the building permit application because his interpretation of Code Section 139-33.E does not permit construction of additional structures up to a maximum of 1 , 500 square feet of ground cover as a matter of right on an improved preexisting nonconforming lot, even if the existing structure was constructed after the effective date of the zoning increase. As the Building Commissioner interprets Code Section 139-33.E, only vacant parcels of land, which are preexisting and nonconforming , may be built upon to a maximum ground cover of 1 , 500 square feet, unless the current ground cover ratio of the particular zoning district allows for a greater ground cover. Under similar circumstances , the Building Commissioner will , however, grant permits to enlarge certain existing structures constructed after the zoning increase, up tc a maximum ground cover of 1 ,500 square feet, on the basis that such construction is in some way an extension or alteration of a preexisting structure. The basic question in this matter is whether the provision in the lead sentence of Section 139-33.E, protecting unimproved lots having at least 20 feet of frontage against being rendered unbuildable as a result of increase in dimensional zoning requirements, causes a lot containing a structure constructed after the increase in zoning requirements to not have the benefit of subparagraph (3) , which provides that a lot within the provisions of Section 139-33 .E and containing at least 5 ,000 square feet of lot area is entitled to minimum ground cover of at least 1 ,500 square feet. As so interpreted, the result currently is that while an unimproved lot can be built upon up to 1 ,500 square feet, an improved lot containing a smaller structure cannot be further built upon; however, if the building were removed from the improved lot, it would obviously become unimproved and have the benefit of the 1 , 500 minimum square foot ground cover provision. This result is absurd. It is an axiom of legal construction that the law should never be interpreted so as to create an absurd result if there is another interpretation which creates a plausible result. There is another interpretation which is plausible and correct. The question of whether the lot is improved or unimproved should not be considered as being determined as of the present time; rather, the question should be whether the lot was unimproved at the time of the effective date of the increased dimensional requirements. The Locus was unimproved as of July 1972 , when the zoning requirement became applicable, and, for that matter, was still unimproved in 1973 when the present zoning requirements became fully applicable. Therefore, as so interpreted, the Locus, being an unimproved lot at the time of the increased dimensional zoning requirements, would have the benefit of the 1 , 500 square foot provision and may be built upon up to that amount. The concept here should be that lots unimproved at the time of the zoning increase would be able to go up to 1 ,500 square feet at any time, regardless of when the improvements were constructed; improved lots containing existing structures would not have the benefit of this provision, but of course would be able to increase their ground cover by special permit under the standards applicable for enlargement of pre-existing nonconforming structures. Accordingly, Applicants respectfully ask that the requested relief be granted. In the alternative, Applicants seek a variance Po ris'aon of CCode Section Section 3139?16rAm the ground cover ratio p (Intensity Regulations) . The Locus was a vacant lot in 1972 and has been held in ownership separation from all adjacent land since a time prior to the effective date of the Nantucket Zoning By-law in July, 1972. The Locus is located in a Limited Use General-3 Zoning District and is improved by a single-family dwelling constructed in 1982 . The Locus has lot area of about 20,000 square feet (120,000 square feet are required) ; frontage on Gloucester Street of about one hundred feet (200 feet are required) ; side yard setback of about 19 feet to about 40 feet (20 feet are required; 10 feet are required for certain lots under Code Section 139-33.E. (3) (a) ) ; and existing ground cover of about 865 square feet (under Code Section 139-33 .E. (2) (b) , a maximum ground cov1 , 500 square feet is allowed for certain lots) . proposed g have a ground cover of about 394 square feet, and the Locus as so improved would have a total ground cover of about 1 , 259 square feet. The Building Commissioner denied the building permit application because his interpretation of Code Section 139-33 .E does not permit construction of additional structures up to a maximum of 1 ,500 square feet of ground cover as a matter of right on an improved preexisting nonconforming lot, even if the existing structure was constructed after the effective date of the zoning increase. As the Building Commissioner interprets Code Section 139-33.E, only vacant parcels of land, which are preexisting and nonconforming , may be built upon to a maximum ground cover of 1 ,500 square feet, unless the current ground cover ratio of the particular zoning district allows for a greater ground cover. Under similar circumstances, the Building Commissioner will, however, grant permits to enlarge certain existing structures constructed after the zoning increase, up to a maximum ground cover of 1 ,500 square feet, on the basis that such construction is in some way an extension or alteration of a preexisting structure. The basic question in this matter is whether the provision in the lead sentence of Section 139-33.E, protecting unimproved lots having at least 20 feet of frontage against being rendered unbuildable as a result of increase in dimensional zoning requirements, causes a lot containing a structure constructed after the increase in zoning requirements to not have the benefit of subparagraph (3) , which provides that a lot within the provisions of Section 139-33.E and containing at least 5 ,000 square feet of lot area is entitled to minimum ground cover of at least 1, 500 square feet. As so interpreted, the result currently is that while an unimproved lot can be built upon up to 1 ,500 square feet , an improved lot containing a smaller structure cannot be further built upon; however, if the building were removed from the improved lot, it would obviously become unimproved and have the benefit of the 1 , 500 minimum square foot ground cover provision. This result is absurd. It is an axiom of legal construction that the law should never be interpreted so as to create an absurd result if there is another interpretation which creates a plausible result. There is another interpretation which is plausible and correct. The question of whether the lot is improved or unimproved should not be considered as being determined as of the present time; rather, the question should be whether the lot was unimproved at the time of the effective date of the increased dimensional requirements. The Locus was unimproved as of July 1972, when the zoning requirement became applicable, and, for that matter, was still unimproved in 1973 when the present zoning requirements became fully applicable. Therefore, as so interpreted, the Locus, being an unimproved lot at the time of the increased dimensional zoning requirements, would have the benefit of the 1 , 500 square foot provision and may be built upon up to that amount. The concept here should be that lots unimproved at the time of the zoning increase would be able to go up to 1 ,500 square feet at any time, regardless of when the improvements were constructed; improved lots containing existing structures would not have the benefit of this provision, but of course would be able to increase their ground cover by special permit under the standards applicable for enlargement of pre-existing nonconforming structures.
