The Board of Appeals at a Public Hearing held on Friday, June 3,
1994, at 1:00 p.m. in the Town and County Building, Nantucket,
Massachusetts made the following Decision on the application (045 -94)
of VIRGINIA S. NEWHOUSE of P.O. Box 164, 15 Liberty Street, Nantucket,
Massachusetts 02554.
1. Applicant seeks a Variance under Nantucket Zoning By -Law
Section 139 -32A from the minimum lot size requirements of the By -Law
to allow the re- division of two (2) conforming lots located on Rose
Lane so as to create one (1) lot of approximately 7,680 square feet
with an existing single - family dwelling and a second vacant lot
containing approximately 3,825 square feet on the condition that no
structures will be placed on the newly created non - conforming
undersized lot and said lot will be held in the same ownership as
other land of the Applicant situated at 15 Liberty Street, Nantucket,
Massachusetts. The Premises are located at 15 ROSE LANE, Assessor's
Map 42.3.4, Parcel 23, Lot B, Land Court Plan No. 15478 -A. The
property is zoned RESIDENTIAL -OLD HISTORIC.
2. Our findings are based upon the application papers, plans,
and representations and testimony received at the hearing on

the basis that there are no grounds for a variance."
3. Applicant's home at Rose Lane currently straddles the
common boundary line between the two (2) Rose Lane parcels owned by
the Applicant. Applicant intends to reconfigure these two (2)
conforming parcels so that her dwelling is entirely within the
confines of one lot. Such a reconfiguration of lot lines will
create one conforming lot with an area of approximately 7,678+
square feet and a second non - conforming lot with an area of 3,829
square feet. A minimum lot area of 5,000 square feet is required in
this RESIDENTIAL OLD HISTORIC zoning district. Rose Lane is a
public way which is travelled infrequently; it divides the two (2)
parcels owned by the Applicant from other land she owns at 15
Liberty Street. Applicant submits that the fact her home straddles
the common boundary line between the two (2) Rose Lane parcels
constitutes a unique set of circumstances which affect the
structures on her land, the relocation of the dwelling to cure this
encroachment would involve a substantial hardship, and a grant of
Variance Relief on the conditions stated herein will not undermine
the intent and purpose of the Nantucket Zoning By -Law.
4. We find that the location of the existing dwelling
constitutes a set of unique circumstances which affect the
Applicant's Rose Lane property and do not affect generally other
property in the Residential Old Historic District; in fact, this is
a case of first impressions for the Board. Further, we find that
Variance Relief is warranted in this case on the condition that the
Applicant record a deed restriction for the benefit of other lane

owned by her situated at 15 Liberty Street which restricts the
newly created, non - conforming undersized lot with an area of
approximately 3,829 square feet so that no structures shall be
constructed on this lot and it shall be held in the same ownership
as her other land at 15 Liberty Street shown as Lot A on Land Court
Plan No. 15478 and Lot B on Land Court No. 16,788. The intent and
purpose of this Variance Relief is to allow the Applicant to obtain
A.N.R. endorsement from the Nantucket Planning Board for a Plan
which shows two (2) Rose Lane lots with respective areas of 7,678±
square feet and 3,829± square feet, and to cure any zoning
violation which may result from the creation of this 3,829± square
foot lot.
Accordingly, by a vote of 4 -1 (Balas dissenting), the Board
hereby grants Variance Relief under Section 139 -32A of the By -Law
to allow the Applicant to create two (2) newly configured lots on
Rose Lane as stated herein -on the following conditions:
(a) Applicant shall record a Deed Restriction at the Nantucket
Registry District which prohibits the building of structures
on the newly configured undersized, non - conforming lot on Rose
Lane containing approximately 3, 829 square feet; and
(b) the newly created undersized, non - conforming lot on Rose
Lane containing approximately 3,829 square feet shall be held
in the same ownership as other land of the Applicant situated
at 15 Liberty Street and shown as Lot A on Land Court Plan No.
15,478 -A and Lot B on Land Court Plan No. 16,788 -A.

ADDENDUM A
Application of Virginia Newhouse
The Applicant is the owner of four parcels of land. Two of
these parcels have merged for zoning purposes (Lot B on L. Ct.
Plan No. 16788 -A - a nine foot wide strip - and Lot A on L. Ct.
Plan No. 15478 -A)., These two parcels together are known as 15
Liberty Street and contain approximately 3,213 square feet of
land area. These lots, now merged, pre -date the zoning code and
are validly grandfathered therefrom. The other two parcels are
separate Land Court parcels known as 11 and 15 Rose Lane, both of
which conform to current zoning requirements and which are
located immediately behind the Liberty Street parcel as shown on
the attached tax map. Rose Lane, an infrequently travelled
public way, prevents the Liberty Street parcel from merging with
the other parcels. However, the house presently existing on the
Rose Lane parcels straddles the common boundary line between the
two parcels.
Rather than move the existing house and in order to
facillitate the Applicant's preferred estate plan, the Applicant
requests that she be allowed to resubdivide the property with the
goal of having two parcels conforming with respect to zoning's
minimum lot size requirements, rather than the one non - conforming
but validly grandfathered and two conforming parcels that now
exist. Specifically, a small portion of property on Rose Lane
(containing 3,829 square feet and shown as lot 2 on the sketch
plan) would be combined with the Liberty Street parcels (Lot 1 on
the sketch plan) for a total resulting lot area of 7,042 square
feet. The remainder of the Rose Lane land would be a single lot
with an area of 7,678 square feet and would encompass the
existing Rose Lane dwelling.
In order to accomplish this goal, the Applicant requests a
variance under Section 139 -32 from the minimum lot size
requirements of Section 139 -16 with respect to a lot to be
created (now shown as Lot 2 on the sketch plan) on the condition
that said lot will forever be held in common ownership with the
parcels known as 15 Liberty Street and that the Liberty Street
parcels and this portion of the Rose Lane property be treated as
if one parcel for all zoning purposes, notwithstanding the
division caused by the public way, Rose Lane.
Y The unique facts relating to the lots' shape given the
impact of Rose Lane as described above specifically affect these
parcels but do not generally affect the zoning district, and
satisfy the statutory criteria for variance relief. The
Applicant and /or her heirs will suffer hardship without the
relief given the other arrangements that would have to be made in
connection with this property. The requested relief will
accomplish a decrease in the potential density of this area and
therefore is consistant with the intent and purpose of the Zoning
Code.
