At a Public Hearing of the Zoning Board of Appeals held at
1:00 P.M., Friday, May 6, 1994, in the Town and County Building,
Broad Street, Nantucket, Massachusetts, on the application of
JEFFREY ALEXANDER and JOAN DODGE, c/o Reade & Alger Professional
Corporation, Post Office Box 2669, Nantucket, Massachusetts
02584, Board of Appeals File No. 035 -94, the Board made the
following decision:
1. Applicant is seeking a FINDING under Massachusetts
General Law, c.40, §6 and Nantucket Zoning By -Law §139 -33A, to
alter an existing structure, said to be pre- existing and
nonconforming, by demolishing the western part of the structure
containing 384+ square feet, and constructing a 384+ square foot
addition. The current structure is nonconforming with respect to
frontage, minimum lot area, and side yard setback requirements.
Required frontage is 50 feet; required minimum lot area is 5,000
square feet, and required side yard setback is 5 feet. Frontage
for this lot is 34.6+ feet, actual lot area is about 2,550 square
feet +, and side yard setback is 0.9+ feet at its closest point
to the lot line. The proposed structure would decrease the
intensity of the current side yard setback nonconformities by
eliminating two incidences of northerly side yard setback
intrusions and leaving one corner of the structure at .9+ feet
and another corner at 1.0+ feet from the northerly side yard lot
line, as they are currently existing. In the alternative,
Applicant seeks a SPECIAL PERMIT under Nantucket Zoning By -Law
§139 -33A, for the demolition and construction of the addition.
The premises are located at 59 FAIR STREET, Assessor's map
55.4.1, parcel 127 (the "Locus "). The property is zoned
Residential -Old Historic.
2. The Decisions is based upon the Application and
materials submitted with it and the testimony and evidence
presented at the hearing. There was no opposition to the
Application.
3. We find that the proposed demolition of the 384+ square
foot western portion of the structure, and the construction of a
new 384+ addition as shown upon the plans submitted by the
applicant, and approved by Historic District Commission
Certificate of Appropriateness No. 24671, will not intensify the
nonconforming nature of the existing residential structure upon
the Locus, but will in fact decrease the intensity of existing

side yard setback intrusions, and further find that the proposed
alterations will not be substantially more detrimental to the
neighborhood.
4. Accordingly, the Board unanimously makes the finding
under M.G.L. c.40A §6, and By -law Section 139 -33.A, that the
proposed project will not be substantially more detrimental to
the neighborhood than the pre - existing nonconforming structure.
The request for special permit relief was withdrawn by unanimous
consent.

the Selectmen's Meeting Room, Broad Street, Nantucket,
Massachusetts, on the Application of:

Applicant is seeking a FINDING under Massachusetts General
Law, c.40, §6 and Nantucket Zoning By -Law §139 -33A, to alter an
existing structure, said to be pre- existing and nonconforming, by
demolishing the western part of the structure containing 384±
square feet, and constructing a 384± square foot addition. The
current structure is nonconforming with respect to frontage, this
lot contains 34.6± feet of frontage in a zoning district that
requires 50 feet; this lot contains 2,550± square feet of area in
a district that requires a 5,000 square foot minimum lot size; and,
the current structure is located .9± feet from the northerly side
yard lot line in a district that requires a 5 foot side yard
setback. The proposed structure would decrease the intensity of
the current side yard setback nonconformities by eliminating two
incidenceSof northerly side yard setback intrusion5and leaving one
corner of the structure at .9± feet and another corner at 1.0± feet
from the northerly side yard lot line, as they are currently
existing. In the alternative, Applicant seeks a SPECIAL PERMIT
