Waine Chairman cc: Town Clerk Planning Board Building Commissioner ZONING BOARD OF APPEALS South Beach Street Nantucket, Mass. 02554 Map 49.3.2 11 Sconset Ave Lot 8 R -2 At a Public Hearing of the ZONING BOARD OF APPEALS held at 1:00 P.M., Friday, April 8, 1994 in the Selectman's Meeting Room, in the Town and County Building, Broad Street, Nantucket, Massachusetts, on the Application of BARBARA NATHAN, Siasconset, Nantucket, MA, Board of Appeals File No. 032 -94, the Board made the following DECISION: 1. Applicant is seeking relief by VARIANCE from the intensity regulations of Nantucket Zoning By -Law §139- 16A, setback requirements, in order to locate a house 17± feet from the front yard lot line in a district that requires a 30 foot front yard setback. The premises are located at 11 SCONSET AVENUE, SIASCONSET, Assessor's map 49.3.2, lot 8, as shown in Registry Plan Book 14, Page 9, lot 18. The property is zoned Residential -II. 2. The Decision is based upon the Application and materials submitted with it, the testimony and evidence presented at the Hearing, two letters in support of the application, one of which signed by seven people, a letter in support of the Application written by the Administrator of the Historic District Commission, and an unfavorable recommendation from the Planning Board. One abutter spoke against the application expressing concerns over safety and aesthetics. 3. Applicant's house is currently being constructed 17± feet from the front yard lot line in a district that requires a 30 foot front yard setback. Applicant, represented. the mistake arose. when the setback was measured from the edge of the road pavement rather than the edge of the lot. Applicant presented photographs to the Board depicting that her house is roughly in line with the some other houses on the street. 4. The subject property was upzoned from Residential -1, requiring a 10 foot front yard setback, to Residential -2, requiring a 30 foot front yard setback in 1984. This accounts for the alignment of some of the houses on Sconset Avenue within the current 30 foot setback requirement. Applicant purchased her property in 1994. The Applicant failed to show a recognizable hardship as the cost of moving the house is relatively minimal and would not deprive the Applicant of the value of her property. Additionally, Applicant has not convinced the Board that the shape of her lot creates a unique circumstance on which a variance could be based. Aesthetic qualities alone are never enough to issue a valid Variance. 5. The Board does not find that owing to circumstances relating to the soil conditions, shape or topography of the land or structures and especially affecting such land or structures, but not affecting the zoning district generally, a literal enforcement of the provisions of the Bylaw would involve substantial hardship, financial or otherwise, to the Applicant, and the desirable relief may be granted without nullifying or substantially derogating from the intent or purpose of the Bylaw, and, accordingly, DENIES the VARIANCE under Nantucket Zoning By -Law §139 -32 by a vote of one in favor (Williams), and four opposed (O'Mara, Leicht r, Waine, and Balas) .
