At a Public Hearing of the ZONING BOARD OF APPEALS held at
1:00 P.M., Friday, April 8, 1994, in the Selectmen's Meeting Room,
in the Town and County Building, Broad Street, Nantucket,
Massachusetts, on the Application of GREGORY E. AND EVE B. MASKELL,
P.O. Box 1455, Nantucket, MA 02554, Board of Appeals File No.
025 -94, the Board made the following Decision:
1. Applicants are seeking relief by SPECIAL PERMIT under
Nantucket Zoning By -Law §139- 9B(2)(b) (storage and warehousing) to
construct a building to be used for the storage and warehousing of
gardening equipment and supplies. The proposed structure will be
1450+ square feet.
The premises are located at 84 OLD SOUTH ROAD, Assessor's
Map 68, Parcel 416, as shown on Land Court Plan 16514 -23, Lot 516.
The property is zoned Residential - Commercial -2.
2. The Decision is based upon the Application and materials
submitted with it, the testimony and evidence presented at the
hearing, one letter of opposition and a favorable recommendation
from the Planning Staff.
3. Applicant represented that the proposed building would be
used for storage and warehousing in connection with his landscaping
business. Work related vehicles and equipment would be stored
within the structure with limited outside storage of materials. The
structure would also contain a small office. Applicant stated that
he employs approximately five (5) employees at any given time and
their personal vehicles would be parked on the premises during
working hours with most of the work taking place off -site. It was
further represented that there were several commercial businesses
in the immediate area though there was a residential area bordering
the property to the east. An abutter expressed concern about
screening along the lot line bordering the residential area.
Applicant agreed to maintain and enhance the existing screening
around the perimeter of the lot.

4. Accordingly, by unanimous vote, a SPECIAL PERMIT was GRANTED
under §139- 9B(2)(b) to allow construction of a building that will be
used for the storage and warehousing of landscaping related equipment
and vehicles, and such grant of relief is in harmony with the purpose
and intent of the Zoning By -Law subject to the following conditions:
A. There will be no commercial activity on Sundays;
B. Applicants shall maintain the existing screening and
enhance the screening around the perimeter of the lot;
C. The structure shall be built substantially in conformance
with Exhibit "A" attached hereto; and
D. The structure shall be built substantially in conformance
with the Certificate of Appropriateness File No. 25,320, issued by
the Historic District Commission.
