At a Public Hearing of the Zoning Board of Appeals held at 1:00 P.M.,
Friday, February 11, 1994 in the Town and County Building, Broad Street,
Nantucket, MA on the application of Jennifer T. Modisette, Executrix of the
Estate of Mary M. Torrey, Board of Appeals File No. 012 -94, the Board made the
followina Decision:
1. Applicant is seeking relief by Special Permit under Nantucket Zoning
By -Law, Section 139- 16.C.2 to validate what is said to be an unintentional front
and side yard set back intrusion. Applicant's deck (attached to a single family
dwelling) is sited 4.44 + /- feet, at its closest point from the front yard lot line, in a
district that requires a ten foot front yard set back. A portion of the dwelling on
the northerly side of the lot is sited .80 +/- from the lot line and a portion of the
dwelling along the westerly side of the lot is 4.46 + /- feet from the lot line. In
addition to or in the alternative, the Applicant is seeking Variance relief pursuant
to Section 139 -32A from the requirements of Section 139 -16A (Intensity
Regulations) to validate the siting of the structure and deck. In the alternative,
Applicant, pursuant to Section 139 -31 A and B, is Appealing the Decision of the
Building Commissioner, dated December 28, 1993, denying the issuance of a
Certificate of Occupancy.
The premises are located at 22 King Street, Siasconset, Assessor's Map
73.4.2, Parcel 71. The property is zoned Residential -1.
2. The Decision is based upon the Application and materials submitted
with it, the testimony, plans and photographs and the Planning Board's
recommendation. There were no letters in opposition. A representative of the
Casino was present but did not make any statement in favor of or in opposition
of the Application.
3. The testimony presented at the hearing indicates that the house was in
existence prior to 1971. In 1982, Building Permit Application No. 2431 -82 was
filed to construct an addition and second floor. The addition is part of the wart
which extends along the westerly lot line towards the shed and is shown as 4.46
+/- feet from the lot line. The second floor addition extends over the new portion
of the structure and over a portion of the structure which is shown as .80 +/- feet
from the northerly lot line. Special Permit relief may granted pursuant to Section
139 -16 C.2 to validate the unintentional setback intrusion which is not greater
than five feet into a required yard and not closer than four feet from the lot line
and if the burden of correcting the intrusion substantially outweighs any benefit
to an abutter of eliminating the intrusion. In this case the addition was
constructed in 1983 when formal surveys for construction were not common and
the structure is now more than ten years old. It would require a significant
amount of time and money if the Applicant were required to remove and relocate
the addition to cure the de minimus zoning violation.
In 1983 Special Permit relief to increase the height of a structure along a
preexisting nonconforming set back line was not required. Special Permit relief
pursuant to Section 139 -33A may be granted upon a finding by the permit
granting authority that the nonconforming distance is not made more
nonconforming and the extension will not be substantially more detrimental to
the neighborhood. In this case the second floor addition did not increase the
nonconforming set back line and the addition is not substantially more
detrimental to the neighborhood. The addition has been in existence since 1983.
In 1983, Building Permit No.3033 -83 was issued for the construction of a
deck. As shown on the plan the deck is situated 4.44 + /- feet from the lot line. A
ten foot set back is required. The way abutting the property is a twelve foot
abutters' way. Based upon the photographs and testimony is appears that no
one else uses that portion of the way which is directly in front of Applicant's
house and the area is used for parking by the Applicant and as part of their yard.
There is a hedge along the easterly border of the way along the line of the
Casino property. Variance relief pursuant to Section 139 -32 from Section 139 -
16A (Intensity Regulations) may be granted where the Board finds that owing to
circumstances relating to the shape or topography of the land or structures and
especially affecting such land or structures but not affecting generally the zoning
district in which it is located, a literal enforcement of the provisions of the By -law
would involve substantial hardship financial or otherwise to the Applicant, and
the desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent or purpose
of such bylaw. Since the deck is approximately 8 1112 feet into the set back-
Special Permit relief is not available to cure this set back violation. Variance
relief may be granted due to the nature and use of the way by the Applicant
which relates to the shape and topography of the lot, the location of the structure
on this particular piece of property, the fact the a literal enforcement of the By-
law would involve substantial hardship to the Applicant, requiring the removal of
the deck and possible loss of a pending sale of the property, and that relief may
be granted without substantial detriment to the public good and without nullifying
or derogating from the intent or purpose of the by law.
4. The appeal of the Building Commissioner's Decision was withdrawn
without prejudice at the request of the Applicant and upon the unanimous vote of
the Board.

5. For the reasons set forth above, a Special Permit
under Section 139 -16C.2 to validate the unintentional rear yard
setback intrusion, was GRANTED by a unanimous vote. A Special
Permit under Section 139 -33A to validate the northerly side yard
intrusion, was also GRANTED by unanimous vote. Variance relief
under Section 139 -16A to validate the front yard intrusion,
was GRANTED by a four (4) to one (1) vote, (Waine, Williams,
Angelastro and Hourihan voting in favor) and (Balas voting in
the negative) on the condition that:
A) There shall be no further.construction within the
setbacks; and
B) The structure is sited as per Exhibit A, attached
hereto.

Applicant's deck (attached to a single family dwelling) is
sited 4.44+ feet, at its closest point, from the front yard
lot line, in a district that requires 10 feet, and the
dwelling is sited .08+ feet, at its closest point, from the
northerly side yard lot line, in a district that requires 5
feet (the dwelling is said to be pre- existing, non - conforming
as to rear yard setback, being sited 4.46+ feet from the lot
line where 5 feet is required). In addition or in the
alternative, Applicant is seeking a VARIANCE pursuant to
§139 -32A from the requirements of §139 -16A (Intensity
regulations) to validate the siting of the structure and deck.
In the alternative, Applicant is APPEALING the Decision of the
Building Commissioner, dated December 28, 1993, denying the

ADDENDUM
Applicant is seeking relief by Special Permit pursuant to Section 139 -16
(c) (2) to validate unintended set back intrusions into front and side yard set
backs that are less than five (5) feet into the required set back but are at least
four (4) feet from the lot line.
In the alternative, Applicant is seeking Variance relief pursuant to Section
139 -32A, from Section 139- 16.A., Intensity Regulations to validate an
unintended intrusion into a required front yard set back of ten (10) feet to 4.44
feet. The intrusion is on a front yard along a 12' Way used exclusively by the
Applicant.
In 1982 and 1983 the former owners of the property, Benjamin and Mary
Torrey (now deceased) filed Building Permit Applications for the construction of a
first and second floor addition and the addition of a deck and had the work done.
The Torrey heirs are in the process of selling the property, and the
violations came to light when an as -built plan was obtained.
To clear up the Building Permits and sell the property, Special Permit
relief is required.
The Board can find that the burden of correcting the intrusions
substantially outweigh any benefit to an abutter of eliminating the intrusion.
In the alternative, Applicant appeals the Decision of the Zoning
Enforcement Officer of the Town of Nantucket dated December 28, 1993 (a copy
of which is attached hereto), pursuant to Section 139 -31 A and B.
The property is located at 22 King Street, Siasconset, Assessor's Map
7342 -71. The property is zoned Residential -1.
