filing an complaint in court within TWENTY (20) days after
this day's date. Notice of the action with a copy of the

At a Public Hearing of the Nantucket Zoning Board of
Appeals held at 1:00 P.M., Friday, January 7, 1994, in the Town
and County Building, Broad Street, Nantucket, MA, on the
Application of JOSEPH M. FIELD, 115 East Princeton Road,
Balacynwyd, PA 19004, Board of Appeals File No. 003 -94, the Board
made the following Decision:
1. Applicant seeks relief by Special-Permit under Nantucket
Zoning By -Law §139 -33A to alloy an addition onto a said to be
pre- existing non - conforming structure. Applicant proposes to add a
bay window to his single family dwelling that will increase the
ground cover on the lot from 1519± S.F. with a groundcover ratio
of 37.8 %, to 1532+ S.F. with a groundcover ratio of 38.1 %, in a
district that has a maximum groundcover ratio of 30% for
undersized lots.
The premises are located at 28 MILK STREET, Assessor's Map
55.4.4, Parcel 004, as shown in Plan Book 13, Page 3. The property
is zoned Residential Old Historic.
2. The Decision is based upon the Application and materials
submitted with it, the testimony, evidence and photographs
presented at the Hearing and an unfavorable recommendation from
the Planning Board.
3. Applicant proposes to add a bay window on the rear westerly
corner of the pre- existing non - conforming structure as part of
other renovations taking place. The premises are non - conforming as
to side yard setback being 1.7+ feet from the westerly lot line,
non - conforming as to groundcover, having a ratio of 37.8% in a
district that allows a maximum of 30% for undersized lots, with
the subject lot having 4,023 S.F. of area in a district that
requires 5,000 S.F. The additional groundcover that is being
requested is 13+ S.F. that will increase the ratio .3% to 38.1 %.
Applicant represented that the dining area in that part of the
house is very dark being overshadowed by an old growth large tree
in the backyard. It was his desire to allow more light into the
room without substantially altering the historic single family
dwelling or cutting down the trees. As the groundcover is
presently over the maximum allowed the Board finds that relief may
be granted by Special Permit. The Historic District Commission has
granted a Certificate of Appropriateness, No. 24,900. The bay window
will not violate any of the setback requirements.

4. Accordingly, by a vote of four (4) in favor (Williams,
Leichter, Waine and O'Mara) to one (1) opposed ( Balas), the Board
GRANTS to requested relief to allow the addition of a bay window
to a pre - existing, non - conforming structure, by Special Permit
under §139 -33A subject to the condition that it be constructed in
substantial conformity with the above stated HDC Certificate of
Appropriateness, No. 24,900, attached hereto with Exhibit A.

Our above mentioned client is renovating his dining room in
the back corner of the house. Several old, very large trees
block any direct sunlight into this room.
To increase the natural light in the dining room, the owner
would like to add a bay window instead of removing the trees.
