At a Public Hearing of the Zoning Board of Appeals held at
1:00 P.M., Friday, October 16, 1992, in the Town and County
Building, Broad Street, Nantucket, Massachusetts, on the
Application of VINCENT and SABRA VACCA, 3 Prospect Street,
Nantucket, Mass. 02554, Board of Appeals File No. 092 -92, the
Board made the following DECISION:
1. Applicants are seeking relief by Special Permit under §§139 -
30A and 139 -33A to allow the alteration and extension of a
structure said to be pre- existing and nonconforming. The
structure is nonconforming as to front and side yard setbacks,
and is on a lot which has less than the required area and
frontage. The structure is sited 3.35± feet from the front lot
line, 0.13± feet from the side lot line, and the lot contains
4,682± S.F. with 36.95± feet of frontage. The requirements of
the zoning district are for 10 foot front yard setback, 5 foot
side yard setback, 5,000 S.F. minimum lot area with 50 feet of
frontage. The proposed alterations are to add second floor space
over the existing footprint and a covered deck outside of the
setback area. The premises are located at 3 PROSPECT STREET,
Assessor's Map 55.4.4, parcel 38, as shown in Plan Book 11, page
50. The property is zoned R -1.
2. The Decision is based upon the Application and materials
submitted with it, the testimony and evidence presented at the
Hearing, and a favorable recommendation from the Planning Board.
3. The Applicants presented the plans for the additions to the
existing structure, which include adding a deck to the section of
the house outside of the setback encroachment and a second story
to the portion of the building within the side yard setback area.
The second story addition will be within the existing footprint.
4. By unanimous vote ( Waine, Balas, Leichter, O'Mara, and
Hourihan in favor) the Board finds that the alterations proposed
by the Applicants do not increase the nonconforming nature of the
structure and GRANTS the Special Permit requested under §139 -33A
to make the proposed alterations substantially in compliance with
the plans submitted, as approved by the Historic District
Commission, File No. 23,426, dated X1/92.
