this day been filed with the Nantucket Town Clerk.
An appeal from this decision may be taken pursuant to
Section 17 of Chapter 40A, Massachusetts General Laws.
Any action appealing the decision must be brought by
filing a complaint in court within twenty (20) days after
this date. Notice of the action with a copy of the
complaint and certified copy of the decision must be given
to the Town Clerk so as to be received within such twenty
(20) days.

At a Public Hearing of the ZONING BOARD OF APPEALS held at
1:00 P.M., Friday, July 26, 1991, in the Town and County
Building, Broad Street, Nantucket, Massachusetts, on the
Application of ISLAND WOMEN CONSTRUCTION CO., INC., P. 0. Box
2076, Nantucket, Massachusetts 02584, Board of Appeals File No.
051 -91, the Board made the following Decision:
1. Applicant is seeking a Special Permit pursuant to §139 -
9B(2)(a),(b) and (c) under §139 -30A to allow use of a structure
to be constructed on the premises for Light Manufacturing,
Storage and Warehousing, including properly screened open storage
of goods and materials, and Fabrication and assembly of component
parts for off -site construction or use, with an ancillary office.
The premises are located at Lot 2 VALLEY VIEW DRIVE, Assessor's
Map 67, parcel 228.1, as shown in Plan File 15 -F, Lot 241,016A,
Lot 1. The property is zoned RC -2.
2. Our decision is based upon the application and documents
submitted therewith, the testimony and evidence presented at the
hearing, one letter expressing neighborhood concerns but not in
opposition to the project, and a favorable recommendation from
the Planning Board.
3. Applicant presented evidence that other lots in the
immediate vicinity have similar uses on site for which this Board
has granted Special Permits, specifically in BOA Files 019 -87 and
094 -87, and outlined the plans for mitigation of visual and noise
impact on the neighbors, including screening of outdoor storage,
sound board for noise insulation, keeping windows closed while
working at night, venting, provision for proper storage of
hazardous materials, and indoor storage of most materials.
Applicant stated that the working hours generally would be
between 7 A.M. and 7 P.M., but that there would be rare occasions
when work would have to be done at other times.
4. Several abutters spoke and presented letters in opposition
to the proposal citing increased tiaffic, particularly trucks, on
an inadequately constructed access road through a residential
neighborhood, the proximity of sensitive wetland areas,
additional noise, the unsightliness of outside storage of
building materials, and the potential for expansion similar to
that which has occurred at the other businesses in the same
subdivision.

Decision
5. While the concerns of the abutters are legitimate, the Board
finds that the proposed use will not be substantially more
detrimental to the neighborhood than the existing uses already
present and is in harmony with the general purpose and intent of
the Zoning Bylaw in that the area is specifically zoned for
commercial activity. The Board does not hold applicant
responsible for remedying the existing problems in the area, and
it has forwarded to the Planning Board and Traffic Safety
Committee a statement concerning the situation, particularly as
it pertains to the access road condition in the residential -
commercial zoning district, which is both intensely developed and
which will bear the brunt of future commercial expansion.
6. By unanimous vote, the Board GRANTS the Special Permit
pursuant to §139- 9B(2)(a),(b) and (c) under §139 -30A to allow use
of a structure to be constructed on the premises for Light
Manufacturing, Storage and Warehousing, including properly
screened open storage of goods and materials, and Fabrication and
assembly of component parts for off -site construction or use,
with an ancillary office subject to the following conditions:
A. No more than four (4) employees may work on the site at one
time;
B. No more than one (1) dwelling on the lot;
C. No outside commercial storage shall be permitted;
D. Applicant shall provide and maintain adequate screening and
plantings to limit the visibility of all outside storage;
E. Applicant shall provide for proper storage and disposal of
any and all hazardous materials on the premises;
F. The building to be used for manufacturing shall have
soundproofing and ventilation to mitigate the impact of
noise and dust emanating from the building;
G. Applicant shall comply with the Order of Conditions from the
Conservation Commission affecting the property; and
H. All work performed between the hours
