Enclosed is the Decision of the BOARD OF APPEALS which has this
day been filed in the office of the Nantucket Town Clerk.
An Appeal from this Decision may be taken pursuant to Section 17
of Chapter 40A, Massachusetts General Laws.
Any action appealing the Decision must be brought by filing a
Complaint in court within TWENTY (20) days after this day's date.
Notice of the action with a copy of the Complaint and a certified
copy of the Decision must be given to the Town Clerk so as to be
received within such TWENTY (2 ?s.

owner of an abutting property in compliance with the
Special Permit dated September 6, 1986. It was
anticipated that at a date in the not too distant future,
the Lessor would be unwilling to enter into another Lease
for the two (2) off -site parking spaces since he wants to
sell the property. In anticipation of this, Applicant
applied for and received a Variance for these two (2)
spaces at the Board of Appeals meeting of August 17, 1990.
(4) Applicant currently has Lot 2 under contract.
The current use on Lot 2 "Fast Forward" requires three (3)
parking spaces under zoning, and the parking requirements
are satisfied on the said Lot 2 without need for relief.
It is requested that the above - described Special Permit
relief and Variance relief be allowed to run with
Applicant's lot (Lot 1) to the extent that this relief is
necessary.

(b ) At the time of the Cof 1 V eyanCe , cross-easement's
will be executed so that Applicant will be allowed to
continue to use the existing parking spaces and driveway
as shown on the attached plan. For zoning purposes, an
easement is not necessary for Lot 2 the one being
conveyed, however, for practical purposes, cross easements
will be executed to accommodate the peak hours of the
business on Lot 2.
(6) No opposition was heard relative to this
application and the Planning Board's recommendation was
favorable. Counsel for the Buyer also spoke in favor of

NOTICE
A Public Hearing of the BOARD OF APPEALS will be held at 1:00
P.M., Friday, April 26, 1991, in the Town and County Building,
Broad Street, Nantucket, Massachusetts, on the Application of:
BRENT YOUNG and JULIE YOUNG
Board of Appeals File No. 025 -91
Applicant seeks a Special Permit under Sections 139 -30A and
139- 18B(1) of the Zoning Bylaw to allow off -site parking by
permanent easement and use of the driveway on the abutting lot at
1 Cherry Street which is to be conveyed out of common ownership.
In addition, Applicant seeks a determination that the Special
Permit granted in BOA File No. 096 -86 and the Variance granted in
BOA File No. 054 -90, both presently in effect, be allowed to run
with the lot to be retained and not to run with the lot to be
conveyed. No increase in intensity of use is planned, and no
changes will be made in the present parking situation.
The premises are located at 117 ORANGE STREET, Assessor's Map
55, parcel 377, as shown in Plan Book 22, page 97, Lot 1. The
property is zoned RC.

Special Permit relief is sought under Section
139- 18B(1) to allow off -site parking and use of the
driveway on the abutting lot which is now held in Common
Ownership and will be conveyed into separate ownership
(both are conforming lots). It is further requested that
a determination be made that the Special Permit (96 -86)
and Variance (054 -90) granted and presently in effect for
Lot 2 be allowed to run with Lot 1 instead since Lot 2,
standing on its own, will not need this relief.
Applicants are not proposing any changes nor any increase
in the intensity of the use for the existing buildings.
The existing parking plan previously approved by the Board
will continue to be in effect after the conveyance of Lot
2 and the cross - easements will be granted at the time of
the conveyance of Lot 2.
The premises are located at 117 Orange Street,
Assessors Map 0055, Parcel 377, Plan Book 22, Page 97 and
are zoned residential /commercial.
