Applicant seeks Modification of the existing Special Permit to allow a change in use of a nonconforming structure from office use to an equal or less intensive residential or retail use. The original Special Permit, BOA File No. 001 -87, permitted only low - intensity office use. No exterior structural changes or expansion is planned; only interior renovations are to be performed. 2. Our decision is based upon the application and documents filed therewith, the testimony and evidence presented at the hearing, a favorable recommendation from the Planning Board. There was no opposition to granting the relief requested. 3. The subject premises have been used as office space subject to the restrictions placed upon such use in Application No. 001- 87, and the parking for this building and the adjacent lot is also governed by said permit. 4. The restriction to low- intensity office use was made to maintain the quiet character of the neighborhood, and any substantial expansion of use would not be in keeping with the original decision. 5. Subject to the foregoing limitations, it will not be substantially more detrimental to the neighborhood to permit some flexibility in permissible use of the premises. 6. By unanimous vote, the Board grants the relief requested to allow, in addition to low - intensity office currently permitted, either residential or retail use of the premises subject to the conditions contained in the prior Special Permit, which shall remain in effect, as modified by the following conditions: A. the premises may be used as one (1) single family dwelling unit; or B. the premises may be used as one retail store, not to exceed 499 S.F. of retail space, with the remainder of the building to be used for storage ancillary to the retail use in the building; and hell"" .
